"Filed in Washington DC circuit court, the lawsuit challenges the EPA’s rollback of the '#EndangermentFinding', which states that the buildup of heat-trapping #pollution in the atmosphere endangers #PublicHealth and welfare and has allowed the EPA to limit those emissions from #vehicles, #PowerPlants and other #industrial sources since 2009. The rollback was widely seen as a major setback to US efforts to combat the #ClimateCrisis.
"The suit was brought by the American Public Health Association [#APHA], #AmericanLungAssociation, the #CenterForBiologicalDiversity, the #EnvironmentalDefenseFund, the #NaturalResourcesDefenseCouncil [#NRDC], the #SierraClub and 11 other public health and environmental organizations. The lawsuit was filed by green legal organizations #CleanAirTaskForce and #Earthjustice and it names the EPA and the agency’s administrator, #LeeZeldin, as defendants.
" 'EPA’s repeal of the endangerment finding and #safeguards to limit vehicle emissions marks a complete dereliction of the agency’s mission to protect people’s health and its legal obligation under the #CleanAirAct,' said #GretchenGoldman, president and CEO at the #UnionOfConcernedScientists, another one of the groups behind the lawsuit. 'This shameful and dangerous action by the Trump administration and EPA Administrator Zeldin is rooted in falsehoods not facts and is at complete odds with the public interest and the best available science.' "

PUBLISHED: June 5, 2025 at 9:34 AM PDTON THE KLAMATH RIVER, Calif. (AP) — "As a youngster, Barry McCovey Jr. would sneak through metal gates and hide from security guards just to catch a steelhead trout in #BlueCreek amid northwestern California redwoods.
"Since time immemorial, his ancestors from the Yurok Tribe had fished, hunted and gathered in this watershed flanked by coastal forests. But for more than 100 years, these lands were owned and managed by #TimberCompanies, severing the tribe’s access to its homelands.
"When McCovey started working as a fisheries technician, the company would let him go there to do his job.
" 'Snorkeling Blue Creek … I felt the significance of that place to myself and to our people, and I knew then that we had to do whatever we could to try and get that back,' McCovey said.
"After a 23-year effort and $56 million, that became reality.
"Roughly 73 square miles (189 square kilometers) of homelands have been returned to the Yurok, more than doubling the tribe’s land holdings, according to a deal announced Thursday. Completion of the land-back conservation deal along the lower #KlamathRiver — a partnership with #WesternRiversConservancy and other #EnvironmentalGroups — is being called the largest in California history.
"The Yurok Tribe had 90% of its territory taken during the #CaliforniaGoldRush in the mid-1800s, suffering massacres and disease from settlers.
" 'To go from when I was a kid and 20 years ago even, from being afraid to go out there to having it be back in tribal hands … is incredible,' said McCovey, director of the Yurok Tribal Fisheries Department."

"Banks was the Penobscot Nation’s representative on the Maine-Indian State Tribal Commission from 1987 to 2021, making him its longest-serving member. He also served on many local, regional and national organization boards, including the National Tribal Environmental Council, Native American Fish and Wildlife Society, National Indian Policy Center, and the Tribal Operations Committee with the federal EPA.
"But arguably Banks’ most noteworthy accomplishment involves bringing a Wabanaki voice and leadership to the historic #PenobscotRiverRestorationProject (1999-2016) in which two dams nearest to the sea were removed and a stream-like bypass channel was completed around a third dam at Howland.
"Completed in 2016, the $63 million restoration project opened almost 2,000 miles of habitat for 11 species of sea-run fish that had been choked off from their spawning grounds for almost two centuries by dams across the river.
"Since then, the river has come back alive with millions of river herring joined by Atlantic salmon, shad, sturgeon and other species in numbers that hadn’t been seen on the Penobscot River for nearly two centuries. Laura Rose Day credits Banks with a key intervention in 2002, when it looked like negotiations that had been going on for three years between #EnvironmentalGroups and the #hydro company owner were about to collapse.
" '[John] asked for a few minutes,' she wrote in a 2014 Christian Science Monitor commentary recalling the moment. 'Removing an eagle feather from a cloth wrap, he circled the table, laying the feather on each shoulder. He reminded us that, no matter whom we served, we were also responsible for being the voice for all the creatures of the river – the birds, the fish, and all of the people as well. The common goal had to be the health of the river.' "

"Florida’s government has said the site will have no environmental impact. Last week, Uthmeier described the area as a barren swampland. He said the site 'presents an efficient, low-cost opportunity to build a temporary detention facility because you don’t need to invest that much in the perimeter. People get out, there’s not much waiting for ’em other than alligators and pythons,' he said in the video. 'Nowhere to go, nowhere to hide.'
"But local #indigenous leaders have said that’s not true. Saturday’s protest was led by #NativeAmerican groups, who say that the site will destroy their sacred homelands. According to The Associated Press, #BigCypress is home to 15 traditional #Miccosukee and #Seminole villages, as well as ceremonial and burial grounds and other gathering sites.
" 'Rather than Miccosukee homelands being an uninhabited wasteland for alligators and pythons, as some have suggested, the Big Cypress is the Tribe’s traditional homelands. The landscape has protected the Miccosukee and Seminole people for generations,' Miccosukee Chairman Talbert Cypress wrote in a statement on social media last week.
"#EnvironmentalGroups, meanwhile, have disputed the state’s claims that the site will have no environmental impact. On Friday, the #CenterForBiologicalDiversity, #FriendsOfTheEverglades, and #Earthjustice sued the Department of Homeland Security in the U.S. District Court for the Southern District of Florida. They argued that the site was being constructed without any of the environmental reviews required by the #NationalEnvironmentalPolicyAct.
" 'The site is more than 96% wetlands, surrounded by Big Cypress National Preserve, and is habitat for the endangered #FloridaPanther and other iconic species. This scheme is not only cruel, it threatens the #Everglades #ecosystem that state and federal taxpayers have spent billions to protect,' said Eve Samples, executive director of Friends of the Everglades.
"Governor #RonDeSantis used emergency powers to fast track the proposal, which the Center for Biological Diversity says has left no room for #PublicInput or #EnvironmentalReview required by federal law.
" 'This reckless attack on the Everglades — the lifeblood of Florida — risks polluting sensitive waters and turning more endangered Florida panthers into roadkill. It makes no sense to build what’s essentially a new development in the Everglades for any reason, but this reason is particularly despicable,' said Elise Bennett, Florida and Caribbean director and attorney at the Center for Biological Diversity."

"The president’s remarks, during an event at the White House, began to confirm what advocacy groups have been quietly warning: Trump’s campaign of retribution is coming next for them.
" 'It’s supposed to be a charitable organization,' Trump said about CREW, in particular. 'The only charity they had is going after Donald Trump. So we’re looking at that. We’re looking at a lot of things.' "

"#Environmental groups are concerned about a draft decision from the Department of Environmental Protection that brings #JuniperRidgeLandfill in #OldTown one step closer to expanding.
"The Maine Department of Environmental Protection has issued a draft decision approving the expansion's public benefit determination, despite opposition from the #PenobscotNation, area residents and #EnvironmentalGroups.
"Opponents have brought up concerns about odors and contamination from the #PFAS-filled sludge at the #landfill.
"Alexandra St. Pierre with the #ConservationLawFoundation said the group was disappointed by the draft approval and wants the department to give greater weight to comments from the public.
"'We're hoping that Maine DEP will stop making this unnecessary space for waste and make more space for people's voices and the real needs of the community,' she said.
"In the draft, the department outlines several conditions of the approval, including conducting an odor study and installing a system for treating landfill leachate for PFAS.
"Dana Colihan with the environmental nonprofit Slingshot said it's insulting for the DEP to say the expansion is consistent with #EnvironmentalJustice for the surrounding community.
'"When we think about the odors, the #AirPollution, the #contamination of the #PenobscotRiver from the minimally treated leachate, and how all these factors threaten the Penobscot Nation and working-class #Mainers living and the surrounding communities, I can't fathom how the state can argue that this fulfills the required environmental justice criteria,' Colihan said.
"The draft is available for public comment until Friday, Sept. 27, and the DEP is expected to publish the final decision Wednesday, Oct. 2."

State agency in Maine rejects #Canadian #mining company’s rezoning application

BREWER, #Maine (AP) — A state agency on Wednesday rejected a Canadian mining company’s zoning application for a proposed mine on #PickettMountain in northern Penobscot County, near #BaxterStatePark and the #KatahdinWoods & Waters National Monument.
"The Maine Land Use Planning [#LUPC] Commission voted 5-2 against #Wolfden's request to rezone on 374 acres (150 hectares), which would've been the first of several hurdles to building a #MetallicMine in the #Katahdin region.
"The panel had numerous concerns including the economic feasibility of the proposed mine. The panel also considered the impacts on #TribalLands, #wildlife, #water resources, the outdoors economy and other factors.
#EnvironmentalGroups and the #PenoboscotNation opposed the project.
"'This ruling is a great victory for the precious waters and lands of the Katahdin region and the people that rely upon them for sustenance and well-being,' said Penobscot Tribal Chief #KirkFrancis.
"Wolfden withdrew its first application after the commission’s staff pointed to multiple errors and inconsistencies with its proposal. It was resubmitted in January 2023 with a goal of addressing the concerns."
