"Both Human Rights Watch and the cross-party law reform organisation Justice say recent legislative changes have created a chilling effect on lawful protest and should be repealed. Their reports, simultaneously published on Thursday, also say that proposals for more curbs should be halted.
"They highlight the arrest of Republic #AntiMonarchy protesters during King Charles’s coronation, charges and arrests of #ProPalestinian demonstrators and long sentences for #ClimateProtesters as examples of the crackdown on the right to peaceful dissent.
"Fiona Rutherford, chief executive of Justice, said: 'Year by year, we see police powers grow, as our fundamental right to protest is treated more like a privilege. The law in this area has become dangerously unbalanced, empowering the state to silence voices it should be safeguarding. Reversing this trend is essential to restoring trust, protecting rights and preserving a healthy democracy.'
"Lydia Gall, a senior Europe and Central Asia researcher at Human Rights Watch, said: 'The UK is now adopting protest-control tactics imposed in countries where democratic safeguards are collapsing. The UK should oppose such measures, not replicate and endorse them.'
"Both reports say that the Police, Crime, Sentencing and Courts Act 2022 and the #PublicOrderAct 2023 were watershed moments, criminalising large amounts of previously lawful protest activity and placing a greater emphasis on preemptive containment of protest through criminal law.
The 2022 law granted police authority to impose conditions on public assemblies on grounds such as causing 'serious unease' or being 'too noisy', described by Human Rights Watch as 'vague and subjective'.
"Members of the public can be arrested for carrying items – described as innocuous by Justice – including cable ties, bike locks or glue, on suspicion that they may be used for 'locking‑on'."

"A tense, day-long standoff outside a South Burlington, Vermont house ended Wednesday night with federal immigration agents removing three people inside and a series of violent clashes between police and hundreds of #activists who tried to impede the apprehension.
"It marked the first major confrontation between protesters and federal immigration authorities in Vermont. Federal law enforcement deployed #TearGas and #flashbangs on a normally busy street in the state’s second largest city to disperse the activists who had surrounded their vehicles. Roughly 60 local and state law enforcement officers were also on scene, though the departments sought to distance themselves from ICE’s conduct.
"The incident began when a man fled Immigration and Customs Enforcement agents who had been surveilling a Dorset Street residence where he was staying.
"According to an ICE affidavit, the subject of the warrant was Deyvi Daniel Corona-Sanchez, a Mexico native who was removed from the United States in 2022, and later illegally reentered the country. In January, Corona-Sanchez was arrested by Middlebury police and charged with drunk driving, the affidavit says.
"Following a multi-vehicle crash, Corona-Sanchez escaped to a house on Dorset Street, authorities said.
"A growing number of protesters and police assembled outside throughout the day as immigration authorities waited for a criminal warrant to enter and arrest him.
"A neighbor, Richard Landsman, said an Ecuadoran family with two children had lived in the house for roughly a year. At one point in the afternoon, people helped a child leave the house; they were driven away.
"When the warrant came through after roughly nine hours, federal agents approached the front door with #TacticalGear and weapons drawn. They were supported by #VermontStatePolice troopers.
"Police wrenched away protesters blocking the front entrance and ICE agents broke down the door. Federal agents removed three people from inside, forcing them into an unmarked car. They attempted to drive off, but protesters linked arms and blocked the street. Confrontations ensued, and the agents eventually managed to drive off by running over a median and exiting via a driveway."

"Unresolved Issues Pertaining to State National Guard Units:
A State Governor has not deployed that State’s National Guard to another State without the consent of the receiving Governor. It would violate state sovereignty and be subject to litigation.
An unresolved question is whether the President can commandeer a State’s National Guard when a Governor has actively deployed that National Guard.
The U.S. Supreme Court has not ruled on whether the President can order one State’s National Guard units to deploy to another state and engage in civilian law enforcement pursuant to 32 U.S.C. § 502(f). This issue may be addressed by the Supreme Court in the appeal from Illinois.

"There, a judge scheduled a date for the two sides to meet again on #November25. In that hearing, CoreCivic will be allowed to present arguement that a Kansas court’s decision barring CoreCivic from housing #ICEDetainees should be overturned.
"The United States Department of Justice [#DOJ] filed a statement of interest on September 22 to address what it called 'an aggressive and unlawful effort' by the City of Leavenworth to interfere with federal immigration enforcement.
"The U.S. District Court was filed against the City of Leavenworth, Mayor #HollyPittman, Mayor Pro Tem #NancyBauder, and city commissioners Griff Martin, Jermaine Wilson, and Edd Hingula.
" 'The United States has a strong interest in countering state and local efforts to harass federal contractors, in the proper application of the Constitution and its Supremacy clause,' the DOJ said in its statement of interest, 'and in the foundational principles that protect the Federal Government from unconstitutional state and local interference.' "In March, the City of Leavenworth adopted a resolution preventing CoreCivic from using the former federal prison as an immigration detention center. It then filed a lawsuit asking a judge to block the private prison operator’s attempt to open the facility without its approval.

It stated that during CoreCivic’s 30 years of operation, there were 'multiple widely publicized scandals resulting from its gross mismanagement of the Facility,' which burdened the City in 'countless ways.' "

:Mast’s new bill claims to target a narrow set of people. One section grants the secretary of state the power to revoke or refuse to issue passports for people who have been convicted—or merely charged—of material support for terrorism...
"The other section sidesteps the legal process entirely. Rather, the secretary of state would be able to deny passports to people whom they determine 'has knowingly aided, assisted, abetted, or otherwise provided material support to an organization the Secretary has designated as a foreign terrorist organization.'
"Rubio has previously boasted of stripping the visas and green cards from several immigrants based purely on their peaceful expression of #ProPalestine views, describing them as '#Hamas supporters.'

Authorities adopted #RestrictiveLaws and banned #websites and #platforms that won’t comply. Technology has been perfected to monitor and manipulate online traffic.
"While it’s still possible to circumvent restrictions by using virtual private network apps, those are routinely blocked, too.
"Authorities further restricted internet access this summer with widespread shutdowns of cellphone internet connections and adopting a law punishing users for searching for content they deem illicit.

"Twenty protesters, ages 22 through 87, were arrested in May for blocking Commercial Street.
"Ten of those protesters were arraigned on Thursday morning while the remaining 10 will be arraigned later this month.
"The Maine Coalition for Palestine says they were bringing attention to the #genocide in #Gaza.
"The protesters were charged with class E misdemeanors for obstructing a public way.
"One of the people taken away in handcuffs was #BobSchaible, who's in his 80s [87 to be exact].
"He says this was his first time being arrested and said he would do it all over again to inspire action to get humanitarian aid to Gaza.
" 'Congress has to take a stand. We want the Portland people, more of them, to know what is happening,' Schaible said.
"Maine Voices for Palestinian Rights Chair Abby Fuller helped organize the protest in May.
" 'We have written our congressional representatives, we've called them, we've held rallies in the streets, we've done all kinds of things -- everything we can think of. And our government has not changed its policy of support for Israel,' Fuller said.
"Fuller was also arrested and charged with obstructing a public way."

Thu, July 10, 2025Jul. 10—"A group of pro-Palestinian demonstrators gathered outside the #CumberlandCountyCourthouse on Thursday morning ahead of a court hearing for their peers who were arrested at a protest in May.
"More than a dozen people rallied with signs and a #PalestinianFlag as 10 people — half of the group that was previously arrested — awaited their arraignments. During their hearings, they each pleaded not guilty to one count of #obstructing a public way. The rest of the group will appear in court at a later date, the protesters said.
"Jamila Levasseur, 70, of #WaldoME, was one of the 20 people arrested in Portland on May 21 after police accused them of blocking the intersection of Commercial and Pearl streets near the U.S. Custom House. She said at the time that she'd be arrested as many times as necessary to bring attention to the widespread #starvation and ongoing #Israeli airstrikes in #Gaza.
"When appearing at the stand, Levasseur told District Court Judge Jed French that she was 'protesting against #genocide in #Gaza' before entering her not-guilty plea. She referenced Israeli Prime Minister Benjamin #Netanyahu's recent talks with President Donald #Trump, recognizing their joint strikes on #Iran and discussing plans for a 60-day #ceasefire that would halt Israel's war against Hamas in Gaza.
" 'Those are the #WarCriminals,' Levasseur said. 'We're not criminals.'
"Levasseur said she couldn't have anticipated that the war would still be going on 21 months after it began. She said she's thankful that a group of attorneys stepped forward to represent the protesters for free, and that the May demonstration in the Old Port attracted a new, larger crowd of supporters.
" 'More and more people are waking up, learning what's going on, horrified, and want to do something,' Levasseur said. 'The people we were arrested with, I didn't even know them all when we were arrested. ... It's not the usual suspects. It's just more ordinary people.'
"Levasseur and #AbigailFuller, 65, of Portland, were also arrested at a February 2024 protest on Franklin Street for obstructing a public way. Their charges in those cases have since been dropped.
"Fuller, who is also a lecturer at the University of Southern Maine, said she felt supported by the group of people outside the courthouse while walking into her arraignment. She pleaded not guilty and also told the judge she was protesting genocide when she was arrested.
" 'It feels good to be starting the process,' Fuller said. 'The Maine courts system takes a really long time, often, to get through, but this is the first step.'
"Fuller said she appreciates seeing new faces at protests, especially as airstrikes and shootings in the #GazaStrip continue, killing people attempting to receive #HumanitarianAid.
" 'Unfortunately, Palestinian deaths are not on the front pages of the newspaper anymore,' Fuller said. 'So, we're trying to keep that in the public eye.' "

House Republicans look to help Trump strip tax-exempt status of nonprofits he says support terrorism

"Unusual language added Monday to a reconciliation bill from the House Ways and Means Committee — the tax-writing committee — would allow for terminating the tax-exempt status of groups the administration deems 'terrorist supporting organizations.' The language mirrors a bill from the last Congress that passed in the House but did not pass the Senate.
"The definition and criteria for determining whether or how an organization supports terrorism are unclear. The bill also targets nonprofits in other ways, echoing complaints by Trump, who has called the tax-exempt status a 'privilege' that has been 'abused.' Trump has threatened to revoke tax-exempt status for groups that don’t abide by his directives or agree with his views."

#Harvard professors sue #Trump administration over funding cut threats

"The Harvard chapter of the American Association of University Professors sued the Trump administration Friday over what they call an 'unlawful and unprecedented' attempt to use federal funding cuts to restrict #FreeSpeech.
"The #DepartmentOfEducation announced in late March that it would review $8.7 billion in federal grants and contacts given to Harvard, alleging that the school failed to prevent #antisemitic discrimination on campus.
"The Trump administration then unveiled a broad set of demands on April 4 the university must agree to in order to keep getting federal funding, including cutting all diversity, equity and inclusion programming, and modifying any programming and departments that 'fuel antisemitic harassment.' The administration gave Columbia University a similar set of demands in March, which the school agreed to.
"The lawsuit by the professors' group, filed in #Massachusetts federal court, alleges that the administration's federal funding review violates the #TitleVI of the #CivilRightsAct, which prohibits discrimination in programs that receive federal funds. The court filing says the law requires specific procedures to cut federal funds and that the Trump administration has not taken any of those steps.
"The group said in a press release that the administration's actions are in effort to create a chilling effect among universities and faculty to stop speech that the president does not like.
" 'Eliminating discrimination and protecting all students is important,' said Nikolas Bowie, a Harvard law professor and the secretary-treasurer of the school's #AAUP chapter, in a statement. 'But Trump is defying the Civil Rights Act, terrifying students, and illegally holding hostage grants for hospitals and scientific research so he can accomplish his real goal of punishing academics for our politics.'
"The lawsuit says that the actions by the administration have 'already caused severe and irreparable harm by halting #academic #research and #inquiry at Harvard.'
"This is the second suit that the Harvard AAUP chapter has filed against the Trump administration this year. The first was a joint suit with other chapters, including one from Columbia, over federal efforts to deport #MahmoudKhalil and students that engaged in #ProPalestinian #activism."

"Trump said last weekend he would 'love' to send American criminals there — and would even be 'honored' to, depending on 'what the law says.' White House Press Secretary Karoline Leavitt confirmed this week that the president has discussed this idea privately, too, adding he would only do this 'if it’s legal.'
"El Salvador’s president, #Nayi Bukele, has for months been offering to hold U.S. citizens in his country’s prison system, which he has turned into 'a judicial black hole' rife with 'systematic #torture,' as one #HumanRights advocate recently told Rolling Stone.
"Legal experts agree that sending American citizens to prison in El Salvador would be flagrantly illegal under both U.S. and international law — and that the idea itself is shockingly #authoritarian, with few parallels in our nation’s history.
"The Trump administration is indeed discussing this idea behind the scenes, two sources familiar with the matter confirmed to Rolling Stone. In their most serious form, these conversations have revolved around attempting to denaturalize American citizens and deport them to other countries, including El Salvador.

"The right to peaceful protest is essential to our democracies, allowing people to come together with a unified voice to support or oppose key issues. It serves as a powerful mechanism for individuals to hold their governments to account and is often the last resort when prior messages go unheard. However, politicians often perceive this right as a threat, especially when force of numbers demonstrates support for an issue."In our recently published Rule of Law report, Liberties’ members reported an increase in restrictions on the right to peaceful protest in all countries - from bans on individual protests to the disproportionate use of force by the police and legislative changes. A widespread trend emerged of restricted #ProPalestine protests and #EnvironmentalDefenders receiving particularly harsh penalties.
Bans on Protests
"Restrictions on various protest movements justified on public safety grounds were documented in many member states. In #Germany, the Berlin Assembly Authorities implemented a temporary blanket ban targeting pro-Palestine demonstrations. Initially, the ban targeted celebrations of the mass murder and pro-Hamas demonstrations but later extended to all pro-Palestinian protests. Similarly, in #Latvia, an unregistered #FreePalestine movement protest was banned after an assessment by the state security service that the event would, among other risks, harm the country’s international interests.
"The Estonian police banned a protest in support of #Palestinians, which was later declared unlawful by the administrative court. In #Hungary, Prime Minister #ViktorOrbán publicly prejudiced support for Palestinians by linking it with terrorism, equating solidarity with civilians victims to threats to the public order. As the fifteen attempts to organise protests were successively banned, the government and the Prime Minister re-asserted their power by deciding what can be demonstrated for, namely, topics in line with their political interests. Following the Covid-19 pandemic and the war in Ukraine, the Hungarian government has repeatedly declared and extended the state of danger, allowing for the adoption of emergency decrees restricting, among other rights, the freedom to assemble. Both the Hungarian Supreme Court and Constitutional Court upheld the protest bans on the basis of public safety and security, legalising the practice of police-authorised restrictions in times of conflict.
"Further restrictions, including bans on #slogans and #signs during #demonstrations, sought to criminalise protesters. Several individuals were arrested or fined for displaying signs or slogans related to Palestine. In #Belgium, activists faced administrative sanctions for carrying a #PalestinianFlag or the #keffiyeh. Similarly, in the #Netherlands, attendees of an #ExtinctionRebellion demonstration were prohibited from mentioning the conflict in the Middle East. The enforcement of restrictions went as far as arrests, as Croatian activists were charged with misdemeanor after projecting a message in support of Palestine on a building across from the Israeli Embassy in Zagreb.
"In Hungary, a demonstrator faced criminal charges after wearing a gas mask and removing it after being asked by the police. In a worrying trend of criminalising protest activities, several activists were arrested and charged with sedition before an Extinction Rebellion demonstration in the Netherlands.
Disproportionate use of force by the police
"The criminalisation of environmental and pro-Palestine protesters was worsened by the violent repression of the police through excessive use of force. This was particularly notable in Sweden, where student encampments in support of Palestinians were forcibly displaced and participants were charged with criminal offenses. #PainGrips, water guns and #WaterCannons were used against environmental activists, pro-Palestinian and anti-immigration demonstrators in Germany, the #Netherlands and #Ireland.
"Environmental activists faced similar fates, The NGO ‘#FranceNatureEnvironnement’ reported concerns to the UN Special Rapporteur on Environmental Defenders following the violent repression of protesters during a demonstration against the A69 highway. In #Sweden, a woman was dismissed from her job at the Swedish Energy Agency for participating in an environmental demonstration and a growing number of #EcoActivists were fined for participating in peaceful protests."

This required our Tribe to be vigilant. No one should be surprised that warrior society burials are found in this area, near the pipeline route.

The scenes of guard dogs menacing Tribal members are reminiscent of the violence of #WhiteSupremacists in the #DeepSouth during the 1950’s and 60’s, but it was in North Dakota, in this day and age. It was on the news and on the internet.
"Many of the protesters were Native American veterans of the United States armed forces. Energy Transfer used attack dogs against peaceful protesters and war heroes. But the jury sided with the out-of-state, unlicensed security with the attack dogs, instead of North Dakota veterans who supported Standing Rock.
"A Texas oil company has come to North Dakota, and its lawyers and propaganda machine are weaving stories about how the Standing Rock Sioux Tribe and our supporters have lied, and how the poor pipeline company, a trillion dollars richer than in 2016 when this all started, should receive extra millions from non-profit organizations. It’s a funny thing about liars – they always accuse everyone else of lying. The Greenpeace trial was marked by secrecy.
"The court is not making the transcript public. The documents obtained by Greenpeace about Energy Transfer’s terrible safety record are protected by a secrecy order and are not available to the public. The judge exhibited so much bias in favor of Energy Transfer that a team of international human rights lawyers felt compelled to monitor the trial. One prominent monitor stated 'In my six decades of legal practice, I have never witnessed a trial as unfair as the one against Greenpeace that just ended in the courts of North Dakota.'
"Standing Rock has tried to work for greater transparency on DAPL. It is our experience with the Army Corps of Engineers and Energy Transfer that all documents relating to DAPL pipeline safety are heavily redacted, and kept secret. What are they hiding? Who is looking out for the communities that may be affected by an oil spill? And why didn’t the North Dakota court allow Greenpeace to address these questions at the trial?

"A #Lakota organizer said in a video deposition played to jurors Monday that the #StandingRockSiouxTribe led the protests against the Dakota Access Pipeline, not Greenpeace.
"#NickTilsen, an Oglala Sioux Tribe citizen and #activist, called the notion that Greenpeace orchestrated the protests 'paternalistic.'
"'I think that people underestimate the complexity and the sophistication of tribal nations,' Tilsen said.
"Tilsen’s deposition was the latest testimony heard by the nine-person jury in the marathon trial between pipeline developer Energy Transfer and Greenpeace.
"#EnergyTransfer claims Greenpeace secretly aided and abetted destructive and violent behavior by protesters during the #demonstrations, which took place in south central #NorthDakota near the #StandingRockReservation in 2016 and 2017. It also claims that Greenpeace orchestrated a misinformation campaign to defame the company, leading a group of banks to back out of financing the project. Energy Transfer seeks roughly $300 million from the environmental organization."Greenpeace denies Energy Transfer’s allegations. The group says it has never condoned violence, and only played a supporting role during the protests.
"Tilsen said he got involved in the protests before Greenpeace. He was invited to join the cause by former Standing Rock Chairman Dave Archambault and his sister, Jodi Archambault, he said.
"'They called me and said, ‘Hey, we need your help at Standing Rock,’ Tilsen said.
"Standing Rock has long opposed the Dakota Access Pipeline, stating the project poses a pollution threat, infringes on tribal sovereignty and has disrupted sacred cultural sites.
"It was Standing Rock leadership that laid the groundwork for the protests against the pipeline’s construction in 2016, Tilsen said.
"He said organizers later invited Greenpeace to support the camps, including by providing supplies and nonviolent direct action training. Tilsen said he only felt comfortable reaching out to Greenpeace because a friend of his, Cy Wagoner, worked there.
"He said since Wagoner is from the #NavajoNation, he trusted that Greenpeace would respect Standing Rock’s leadership of the camps.
"Indigenous communities are often reluctant to invite outside nonprofits to help with Native rights issues, Tilsen added. He said they often don’t understand Native nations’ unique relationship with the U.S. government.
"Greenpeace wasn’t a big part of the protests, Tilsen said.
"'To be honest, most of the tribal nations didn’t know who Greenpeace was,' he said.
"Countless other groups — including representatives from more than 300 Native nations — came to the protest camps in solidarity with Standing Rock, said Tilsen.
"'Quite frankly, our list of allies was hundreds,' he said.
"Tilsen said he was involved in several protest actions against the Dakota Access Pipeline in 2016 and 2017, including those that involved marching on the pipeline easement, jumping in front of equipment and using lockboxes — also known as 'sleeping dragons' — to disable construction machinery.
"None of the protest actions were coordinated by Greenpeace, he said.
"Tilsen said he never saw or endorsed any destruction of property or acts of violence toward construction workers or law enforcement. He also pushed back on the assertion that any of the protest activities he participated in qualified as trespassing.
"The pipeline passes through land recognized as belonging to the #SiouxNation under #treaties signed by the U.S. government in 1851 and 1868. The U.S. government later annexed that land in violation of those treaties.
"Tilsen asked how Lakota citizens could be trespassing on land that was unlawfully taken from them.
"'This is the conundrum we find ourselves in,' he said.
"Employees of Greenpeace said during video depositions played last week that the environmental organization brought 20 to 30 lockboxes to the camps.
"Tilsen said while he saw many lockboxes during protests, he wasn’t sure where any of them came from. He also said he never heard anyone from Greenpeace tell demonstrators to use the devices.
"Tilsen said that David Khoury, an employee for Greenpeace, helped identify potential sites for protest actions. Tilsen added that while Wagoner — another Greenpeace employee — didn’t plan protest activities, he trained people on how to conduct them.
"The trial, which is before Southwest Central Judicial District Judge James Gion, is expected to last roughly four more weeks."

Attorneys asked if I came to Standing Rock resistance camp because the Army Corps issued a permit. My response: No. I came for the #water,and I came because #LaDonnaBraveBull Allard asked me to come. I came because #Enbridge, the Canadian #pipeline company, had proposed a Sandpiper #pipeline across our territory in northern Minnesota and we defeated them, only to find that they later financed 28% of the #DakotaAccessPipeline. "There’s another big trial starting Monday in #MandanNorthDakota, too, in Morton County District Court. There, Judge James Gion will preside over a jury trial in the case of Energy Transfer v. Greenpeace. Energy Transfer charges that Greenpeace effectively orchestrated and was a force driving the Standing Rock resistance. That allegation is pretty surprising to the thousands of people who came to Standing Rock without even hearing about Greenpeace being there. That case will be heard behind #ClosedDoors, no livestreaming, and yet somehow a judge in a small county without a law clerk will make sure the justice of a jury trial is carried out. The case with a multitude of pretrial motions is described as the largest in North Dakota history, so carrying out justice, well that’s a challenge.

That’s something you are not supposed to do in North Dakota, it seems, where oil money slicks through all the systems. In North Dakota, the message seems to be, No one should oppose a pipeline project. No one."

#Republicans Are Already Trying to Grant #Trump Dangerous Powers

November 15, 2024"House Republicans are trying to push through a bill that would give President-Elect #DonaldTrump powers as president to designate #nonprofit organizations as '#TerroristSupporting' even after it was seemingly defeated earlier this week.
"The Stop Terror-Financing and Tax Penalties on American Hostages Act #HR9495 would allow the secretary of the treasury the ability to revoke any nonprofit organization’s tax-exempt status by branding it with a terrorism label. Earlier this week, the bill failed to receive the necessary two-thirds majority in the House to advance to the Senate.
"But on Monday, the House Rules Committee plans to hold a hearing that could set up a new vote on the bill, which initially had the support of all but one Republican and 52 Democrats. With the GOP only holding a seven seat majority in the chamber, they would need the support of more Democrats to advance the bill, which was introduced to combat #protests against #Israel’s war on #Gaza.
"Under any circumstances, the bill would threaten #FirstAmendment rights to #FreeSpeech, but after Trump’s election last week, there are now fears that the president-elect could use these new powers to crack down on his enemies with little recourse. Many #universities and #NewsOutlets are nonprofit organizations in addition to #activist groups.
"After the bill’s initial failure on Tuesday, the American Civil Liberties Union [#ACLU] celebrated the rejection of 'new broad and easily abused powers.'
"'The freedom to #dissent without fear of government retribution is a vital part of any well-functioning democracy, and now is not the time to grant the executive branch new powers to investigate and functionally shut down and silence its critics,' said Kia Hamadanchy, senior policy counsel for the ACLU, in a statement.
"Now, the bill could be given a retooling and sent up for a vote again, giving a president who has already threatened to use the #military against his critics even more sweeping powers. The question is if #Democrats will recognize the bill as granting dangerous powers to the presidency, or see it as a chance to clamp down on protesters they have tried to ignore at their peril for the past year.'"

"A majority of Democrats in the House of Representatives rejected the bill on Tuesday out of fear that it could grant President-Elect Donald Trump legal tools with which to target his ideological foes, but Republicans are swiftly pressing ahead.
"The #StopTerrorFinancing and Tax Penalties on American Hostages Act, which would empower the secretary of the Treasury to designate any #nonprofit as a '#terrorist supporting organization' and revoke its tax-exempt status, is set to go before the Committee on Rules on Monday for a hearing that could tee up the bill for a new floor vote.
"The hearing was announced Thursday evening, just two days after 144 Democrats and one Republican voted against the bill as part of a fast-track parliamentary procedure that required a two-thirds majority.
"The bill, also known as #HR9495, has come under withering criticism from a broad coalition of organizations that say its sponsors are pushing it as a means of cracking down on free speech — particularly speech in support of #Palestine. In a joint statement earlier this week, a coalition of #ArabAmerican and #MuslimOrganizations pledged to continue to fight the bill.
"'This bill was designed to #criminalize organizations and #activists who oppose the U.S.’s unconditional support of #Israel’s #genocide of Palestinians and the slaughter of #Lebanese civilians,' read the statement, which was signed by the Council on American-Islamic Relations, American Muslims for Palestine, and others. 'We will continue to stand firm in protecting all organizations’ freedom to speak and operate without fear of political retribution.'
"Offices for the chair and ranking member of the Ways and Means Committee, through which the bill must pass, did not respond to requests for comment.
"With #ProIsrael groups lobbying for the bill, it gained popularity among House Democrats, in part due to a provision providing tax relief to Americans held hostage abroad.
"The reelection of Trump, however, galvanized opponents, including Rep. #LloydDoggett, D-Texas, who led the charge to reject the bill on Tuesday. Doggett doubled down on Thursday after learning of the newly scheduled Rules Committee hearing.
"'In this mislabeled bill, House Republicans are hiding behind hostages,' Doggett said in a statement to The Intercept. 'Their rush to reconsider this bill is solely to offer Trump more and more power, while Trump’s nominees for key #NationalSecurity posts this week indicate how he will be using it.'"

"South Dakota’s governor and attorney general today backed down from their unconstitutional attempts to silence pipeline protestors. In response to a lawsuit we filed alongside the ACLU of South Dakota and the Robins Kaplan law firm, the state has agreed to never enforce the unconstitutional provisions of several state laws that threatened activists who encourage or organize protests, particularly protests of the #KeystoneXL [#KXL] pipeline, with fines and criminal penalties of up to 25 years in prison.
"The settlement agreement reached today and now headed to the court for approval is an important victory for the right to protest. It comes soon after a federal court temporarily blocked enforcement of the pieces of the laws that infringed on First Amendment protected speech, and makes the court’s temporary block a permanent one.
"The laws include the #RiotBoostingAct, which gave the state the authority to sue individuals and #organizations for 'riot boosting,' a novel and confusing term. The court warned against the laws’ broad reach, noting that the laws could have prohibited:
- Sending a supporting email or a letter to the editor in support of a protest
- Giving a cup of coffee or thumbs up or $10 to protesters
- Holding up a sign in protest on a street corner
- Asking someone to protest"Under the First Amendment, that is impermissible.
"The court rightly recognized the stakes of this case. And it put these #AntiProtest efforts in perspective, asking 'if these riot boosting statutes were applied to the protests that took place in Birmingham, Alabama, what might be the result?' The answer: 'Dr. King and the Southern Christian Leadership Conference could have been liable under an identical riot boosting law[.]'
"Indeed, South Dakota’s unconstitutional anti-protest efforts echoed the suppression of past social movements. From the start, South Dakota Governor Kristi Noem called on 'shut[ting] down' 'out-of-state people' who come into South Dakota to 'slow and stop construction' of the pipeline. Her harmful calls were reminiscent of government attempts throughout our history to delegitimize and minimize significant #SocialMovements as the work of 'outside agitators,' including Reverend #MartinLutherKingJr.
"South Dakota’s quick and costly retreat (they’ll have to compensate plaintiffs for attorney’s fees under the settlement agreement) should serve as a lesson for other legislatures considering similar efforts to silence dissent.
"In the last few years, we have witnessed a legislative trend of states seeking to criminalize protest, deter political participation, and curtail freedom of association. These bills appear to be a direct reaction from politicians and corporations to some of the most effective tactics of those speaking out today, including water protectors challenging pipeline construction, Black Lives Matter, and those calling for boycotts of Israel. These legislative moves are aimed at suppressing dissent and undercutting marginalized and over-policed groups voicing concerns that disrupt current power dynamics.
"But the First Amendment guarantees people the right to voice their opposition. This includes our clients — four organizations (the #SierraClub, #NDNCollective, #DakotaRuralAction, and the #IndigenousEnvironmentalNetwork - #IEN) and two individuals (#NickTilsen with NDN Collective and #DallasGoldtooth with Indigenous Environmental Network) — all of whom are protesting construction of the Keystone XL pipeline and encouraging others to do the same.
"Construction of the Keystone XL pipeline may be imminent. Pre-construction activities resumed this month, and a hearing on the new Draft Environmental Impact Statement for the pipeline, which will serve as the basis for approval of any future permits, is coming up next Monday.
"With the laws we challenged proclaimed unenforceable, protesters and protectors no longer have to worry about incarceration or fines as they protest against the construction. That is, at a minimum, how democracy should work."

Private Donors Supply Spy Gear to Cops
There's little public scrutiny when private donors pay to give police controversial technology and weapons. Sometimes, companies are donors to the same foundations that purchase their products for police.

"In 2007, as it pushed to build a state-of-the-art #surveillance facility, the Los Angeles Police Department cast an acquisitive eye on software being developed by #Palantir, a startup funded in part by the Central Intelligence Agency's [#CIA] #VentureCapital arm.
"Originally designed for spy agencies, Palantir's technology allowed users to track individuals with unprecedented reach, connecting information from conventional sources like crime reports with more controversial data gathered by surveillance cameras and license plate readers that automatically, and indiscriminately, photographed passing cars.
"The LAPD could have used a small portion of its multibillion-dollar annual budget to purchase the software, but that would have meant going through a year-long process requiring public meetings, approval from the City Council, and, in some cases, competitive bidding.
"There was a quicker, quieter way to get the software: as a gift from the Los Angeles Police Foundation, a private charity. In November 2007, at the behest of then Police Chief William Bratton, the foundation approached #TargetCorporation, which contributed $200,000 to buy the software, said the foundation's executive director, Cecilia Glassman, in an interview. Then the foundation donated it to the police department.
"Across the nation, private foundations are increasingly being tapped to provide police with technology and weaponry that -- were it purchased with public money -- would come under far closer scrutiny.
"In Los Angeles, foundation money has been used to buy hundreds of thousands of dollars' worth of license plate readers, which were the subject of a #CivilRights lawsuit filed against the region's law enforcement agencies by the American Civil Liberties Union of Southern California and the #ElectronicFrontierFoundation. (A judge rejected the groups' claims earlier this year.)
"Private funds also have been used to upgrade 'Stingray' devices, which have triggered debate in numerous jurisdictions because they vacuum up records of cellphone metadata, calls, text messages and data transfers over a half-mile radius.
"New York and Los Angeles have the nation's oldest and most generous police foundations, each providing their city police departments with grants totaling about $3 million a year. But similar groups have sprouted up in dozens of jurisdictions, from #AtlantaGeorgia, to #OaklandCalifornia. In #Atlanta, the police foundation has bankrolled the surveillance cameras that now blanket the city, as well as the center where police officers monitor live video feeds.
"Proponents of these private fundraising efforts say they have become indispensable in an era of tightening budgets, helping police to acquire the ever-more sophisticated tools needed to combat modern crime.
"'There's very little discretionary money for the department,' said Steve Soboroff, a businessman who is president of the Los Angeles Police Commission, the civilian board that oversees the LAPD's policies and operations. 'A grant application to the foundation cuts all the red tape, or almost all of the red tape.'
"But critics say police foundations operate with little transparency or oversight and can be a way for wealthy donors and corporations to influence law enforcement agencies' priorities.
"It's not uncommon for the same companies to be donors to the same police foundations that purchase their products for local police departments. Or for those #companies also to be #contractors for the same police agencies to which their products are being donated.
"'No one really knows what's going on,' said Dick Dadey of #CitizensUnion, a good government group in New York. 'The public needs to know that these contributions are being made voluntarily and have no bearing on contracting decisions.'
"Palantir, the recipient of the #LosAngelesPolice Foundation's largesse in 2008, donated $10,000 to become a three-star sponsor of the group's annual 'Above and Beyond' awards ceremony in 2013 and has made similar-sized gifts to the #NewYorkPolice foundation. The privately held Palo Alto firm, which had estimated revenues of $250 million in 2011 and is preparing to go public, also has won millions of dollars of contracts from the Los Angeles and New York police departments over the last three years.
"Palantir officials did not respond to questions about its relationships with police departments and the foundations linked to them. The New York City Police Foundation did not answer questions about Palantir's donations, or its technology gifts to the NYPD.
"Donna Lieberman, executive director of the New York #CivilLibertiesUnion, said she saw danger in the growing web of ties between police departments, foundations and private donors.
"'We run the risk of policy that is in the service of #moneyed interests,' she said."
