"Thoreson, a special education teacher, was still in her pajamas. The agent let her change clothes and hug her partner goodbye before taking her into custody.

The law makes it a Class A misdemeanor, punishable by up to one year in jail and $3,000, to wear a mask “with the intent to conceal the identity” of the wearer while “congregating in a public place with other individuals wearing a mask, hood, or other device that covers, hides, or conceals any portion of the individual’s face.” The bill exempts public gatherings to celebrate “Halloween, a masquerade, or other similar celebration,” but does not include exemptions for masks worn during protests, or worn for health, religious, or other reasons. As written, the law can cover a protester wearing a mask to avoid retaliation for their political speech, if there are other individuals in the crowd also wearing a mask—for instance, a medical mask to avoid spreading or contracting a contagious disease.

"Mr Prince rose to prominence during the war on terror as the founder of #Blackwater, a private military company. The firm earned over a billion dollars providing armed personnel to various branches of the US government before becoming implicated in a number of scandals. In 2007 its contractors killed 14 Iraqi civilians, including a nine-year-old child. The massacre made Mr Prince the face of the Iraq fiasco. He sold the company and disappeared from the public eye.
"But in recent months Mr Prince has reemerged. He has popped up in some of the most dangerous, contested places in the world, from Ukraine to Haiti to the DRC. They are places the Trump administration is interested in too.
"For the Weekend Intelligence the Economist’s Africa Correspondent, Tom Gardner, flew to Cape Town to meet with Prince, the mercenary in CEO’s clothing. Prince is defiant after his years in the political wilderness. And he’s spying some big opportunities. The global mercenary business is on the brink of a new boom. States, across Africa and beyond, are fracturing. The international system is fraying. With UN peacekeepers drawing down, from Mali to Congo to Lebanon, mercenaries of different stripes can expect to fill the void."

Excerpt: "Late Wednesday afternoon, private prison company CoreCivic announced it would be reopening a notorious family detention center in South Texas, under an amended contract with US Immigration and Customs Enforcement (ICE). The facility, first built in 2014, will house up to 2,400 people, including children. It had been shut down last year to save costs, after years of reports suggesting poor treatment, including a report of one toddler who died due to a lack of medical care.
"The reopening is part of a trend. CoreCivic isn’t the only company bringing back facilities. We are at the beginning of what looks like a private prison boom, as the groups profit off President Donald Trump’s plans for mass deportation. They are set to make billions. As the Washington Post reported, the GEO Group and CoreCivic stand to benefit in particular from #Trump’s immigration plans—the companies hold at least 16 vacant facilities that can be reopened within months for mass detention and deportation.
"The GEO Group announced in late February that it would be reopening #DelaneyHall in #NewarkNJ, as a “massive” immigration detention center with 1,000 beds. In California, ICE is considering repurposing and reopening the women’s prison #FCIDublin, closed last year due to mass #SexualAbuse, for #ImmigrantDetention. In Baldwin, Michigan, ICE and the GEO Group have expressed interest in reopening #NorthLake Correctional Facility, a former private prison shuttered in 2022. (A Biden administration order directed the Department of Justice to allow contracts with private prison groups to expire.) In #LeavenworthKS, CoreCivic looks likely to partner with ICE to reopen yet another shuttered private prison, documents obtained by the #ACLU revealed.
"As of February 27, ICE held 43,759 detainees, according to the Transactional Records Access Clearinghouse, a nonpartisan data-gathering organization. Trump is putting pressure on ICE to increase the number of arrests per day. His administration has already fired one ICE director, ostensibly for not deporting enough people.

"In response to the weekend’s attack on the East Melbourne Hebrew Congregation, Victorian Premier Jacinta Allan has announced she will forge ahead with new anti-protest measures and more #police powers.
"In doing so, she is following what has become the new normal for state governments across the country: using acts of racism and violence as a pretext to #ClampDown on unrelated democratic rights.
"Taking to the streets in peaceful protest is one of the main ways for people to come together and express our political views when our representatives aren’t listening to us. But this right is not without limits. Every person has a right to worship in safety. The attack on East Melbourne Synagogue was not a protest; it was an act of antisemitism. The suspect has been apprehended and charged with a multitude of criminal offences.
"Two other incidents over the weekend, the targeting of a business with ties to the Gaza Humanitarian Foundation — a US-backed #Israeli organisation linked to the massacres of unarmed #Palestinians seeking aid — and a weapons company with links to the Israeli military, are also being referred to as justifying new laws. It is important not to conflate these actions against Israel with an attack against a Jewish place of worship. International human rights law, as well as our current laws, already place limits on protests that involve intimidation and violence.
"So what is actually being proposed in response? The Allan government is suggesting the creation of a new criminal offence for wearing a #FaceCovering at peaceful protests, banning 'dangerous attachment devices' (e.g. a #chain, a #BikeLock) — which have long been used in non-violent civil disobedience — and #criminalising peaceful protests around places of religious worship.
"The ban on face coverings would be a first in #Australia. It would mirror measures used in #authoritarian states that force people to submit themselves to various forms of #StateSurveillance.
"#VictoriaPolice has been using facial recognition software for years without any regulatory or legislative framework to prevent breaches of privacy. This technology, combined with a ban on face coverings at protests, would essentially amount to an obligation on behalf of individuals to submit to surveillance by the state, corporations and other groups that surveil protesters.
"Unless you’re a #MiningCompany spending hundreds of millions buying politicians’ favour or can wine and dine decision-makers, peaceful protest is one of the main ways for people to hold governments and corporations to account. Protests for the eight-hour workday, #WomensRights, #FirstNationsRights and the #AntiWar movement have led to significant improvements in all of our lives.
Know something?"Many people attending protests wear face coverings to protect their privacy and anonymity. For temporary migrants, the consequences of identification can include visa cancellation and detention. #FarRight groups, abusers of gender-based violence and other political groups have all been documented as engaging in doxing, surveillance and retaliatory violence against people identified at peaceful protests.
"Even with exemptions, a ban would mean that people who wear facemasks for reasons of health, disability status, or religious or cultural reasons would be at risk of police targeting and made to justify their use of a face mask.
"Adding new repressive police powers against peaceful protesters only serves to increase the risk of escalating violence at already heightened public demonstrations. People will not stop taking to the streets on issues they care about, even if the state tries to stifle their voices. Donald #Trump’s deployment of the #NationalGuard in response to protests in LA shows us how deploying more state force at protests increases rather than decreases the risk of violence.
"A ban on protests outside or within a certain proximity to places of worship would mean police could arrest those engaging in peaceful protests for a genuine, non-discriminatory purpose — for example, protests by survivors of #ClergySexualAbuse or by congregants against the political activities of their own religious institutions.
"It would also have the unintended consequence of rendering large areas of the state no-go zones for peaceful protest, due to the high number of places of worship. Similar laws in #NSW are already being challenged for their #unconstitutionality.
"Taken together, this suite of laws, which would provide police with extraordinary powers against people peacefully raising their voices against #injustice, would have a chilling effect, deterring #MarginalisedGroups from attending protests and exercising their rights to freedom of expression, which the Victorian government has sought to protect.
"Ultimately, banning face coverings at peaceful protests and banning protests outside places of worship would not have done anything to prevent what occurred over the weekend. Premier Allan knows this. Yet she is stuck in the same reactive law-and-order merry-go-round that saw NSW Premier Chris Minns enact fear-based, repressive anti-protest measures in response to what we now know was an opportunistic criminal conspiracy.
"Encouraging people to express their political views peacefully is the antidote to non-peaceful forms of protest and is something that all governments should be encouraging and facilitating. At times like this, we should be able to trust our politicians not to fuel division and panic through misguided and knee-jerk responses, but to take measures to address the root causes of racism and hatred."

"Restrictions on various protest movements justified on public safety grounds were documented in many member states. In #Germany, the Berlin Assembly Authorities implemented a temporary blanket ban targeting pro-Palestine demonstrations. Initially, the ban targeted celebrations of the mass murder and pro-Hamas demonstrations but later extended to all pro-Palestinian protests. Similarly, in #Latvia, an unregistered #FreePalestine movement protest was banned after an assessment by the state security service that the event would, among other risks, harm the country’s international interests.
"The Estonian police banned a protest in support of #Palestinians, which was later declared unlawful by the administrative court. In #Hungary, Prime Minister #ViktorOrbán publicly prejudiced support for Palestinians by linking it with terrorism, equating solidarity with civilians victims to threats to the public order. As the fifteen attempts to organise protests were successively banned, the government and the Prime Minister re-asserted their power by deciding what can be demonstrated for, namely, topics in line with their political interests. Following the Covid-19 pandemic and the war in Ukraine, the Hungarian government has repeatedly declared and extended the state of danger, allowing for the adoption of emergency decrees restricting, among other rights, the freedom to assemble. Both the Hungarian Supreme Court and Constitutional Court upheld the protest bans on the basis of public safety and security, legalising the practice of police-authorised restrictions in times of conflict.

"Which states have criminalised protest and what forms of protest are criminalised?
"#HumanRights organisations have been increasingly critical towards some Australian states over new legislation which seemingly targets #EnvironmentalProtests in the midst of a global #Climatecrisis.
"There are dozens of protest regulations across many states, with five (#NSW, #Queensland, #SouthAustralia, #Tasmania and #Victoria) introducing forms of #AntiProtest regulation most recently. South Australia's new laws, passed just last month, increase maximum fines from $750 to $50,000 along with potential jail time, and were prompted by disruption of an #OilAndGas conference by protestors in early May.
"In the aftermath of protests which sought to block port operations and shut down economic action to draw attention to demands for climate action, the NSW Parliament passed legislation which could see protestors face up to a $22,000 fine and/or prison for a maximum of two years. The legislation targets individuals who block major roads and new tunnels and/or disrupt #port operations in major ports such as #Newcastle and #PortBotany.
"In 2022, Tasmania passed anti-protest laws by way of the Police Offences Amendment (Workplace Protection) Bill 2022 under the guise of protecting Tasmanian workers. Under these laws, any protestor who obstructs a workplace during protests could face up to 12 months in prison, the Human Rights Law Centre reported:
" '…community member protesting the destruction of #OldGrowthForests on a forestry site could face a penalty of over $13,000 or 2 years in prison; and An organisation supporting members of the community to protest could be fined over $45,000.'
"Similar laws were also passed in Victoria. #AntiLogging protestors who 'hinder, obstruct or interfere with timber-harvesting operations' can face up to 12 months in prison and/or a $21,000 fine. PVC and metal pipes which are often used in protest activities are now prohibited in working sites, with additional powers provided to police to search suspect individuals who are 'reasonably suspicious'.
"In 2019, on public safety grounds, Queensland passed legislation which bans locking devices as modes of civil disobedience. These are tactics used to make it difficult for police to remove protestors and are often used by protestors to lock themselves to property and #pipelines to prevent construction of environmentally-harmful projects. Protestors face up to two years in prison and/or a $6,000 fine. It was rationalised on the basis of activists lacing devices with 'butane canisters' and other devices which were harmful for law enforcement. However, there is no evidence of the use of these devices."

"The proposed anti- protest laws include:
- Banning the flags and symbols of listed terrorist organisations in public, to give Victoria Police more powers and fill in any gaps in Commonwealth anti-Terror legislation. Listed terrorist organisations include #Hamas, Hezbollah and several other groups, including white nationalist and racist violent extremist (NRVE) right-wing groups.
- Banning the use of #FaceMasks at protests, which are being used to conceal identities and shield agitators from crowd-control measures like #capsicum spray. A mask ban in public demonstrations will focus on prohibiting the wearing of face coverings at protests and providing police with the power to require their removal. Exemptions would apply for legitimate health, religious or cultural reasons.
- Banning the use of glue, rope, chains, locks and other dangerous attachment devices that protestors use to cause maximum disruption and endanger others

"Secretary of State #MarcoRubio said Thursday the State Department has revoked 300 or more #StudentVisas, as the White House increasingly targets foreign-born students whose main transgression seems to be #activism.
"Rubio warned that the administration was looking out for 'these lunatics.' Around the country, #scholars have been picked up, in some cases by masked immigration agents, and held in #DetentionCenters, sometimes a thousand miles from their homes with little warning and often with few details about why they were being detained.
"'It might be more than 300 at this point. We do it every day. Every time I find one of these lunatics, I take away their visas,' Rubio said at a news conference in Guyana, where he was meeting with leaders.
"Many of those rounded up by Trump officials attended or were part of the pro-Palestinian movement that swept college campuses last year, and while the administration hasn’t said publicly why these students are being singled out over others, at least one sought by U.S. Immigration and Customs Enforcement appeared on lists made by far-right pro-Israel groups as targets for deportation.
"And Trump allies, many in government again, telegraphed for months before he took office that they’d seek to deport students who openly advocated for Hamas or other U.S.-designated terrorist groups or after they participated in an unauthorized campus #protest and were suspended, expelled or jailed.

"Earlier this month, while hunting for #ColumbiaUniversity students to deport over their ties to #Gaza protests, the #Trump administration convinced a federal judge to sign off on search warrants for two students’ dorm rooms — then raided the residences with U.S. Immigration and Customs Enforcement agents.
"As details about the warrants have emerged, however, so have allegations that federal agents misled the court and secured the warrants under 'false pretenses,' as one of the students whose room was searched, #YunseoChung, claimed in a lawsuit challenging her deportation.
"The warrants were predicated on probable cause that Columbia was 'harboring' students who were in the country illegally, court filings indicate. Chung, however, is a lawful permanent resident, notwithstanding the Trump administration’s efforts to deport her based on her arrest and citation at a Gaza sit-in. She has lived in the U.S. since she was 7 years old.
"'The basis for this entire operation is constitutionally invalid.'
"'The idea that they went before a federal magistrate judge and said, ‘We have to search Ms. Chung’s residence for evidence of Columbia harboring her’ — that shows they’re willing to lie to a judge,' said Nathan Yaffe, an immigration attorney.
"Yaffe represents both Chung and the other Columbia student who was targeted by the search warrants, #RanjaniSrinivasan, who left the country in mid-March.
"Most of the materials relating to the search warrants remain under seal in federal court, and Columbia declined to comment on them, citing student privacy protections. ICE did not respond to The Intercept’s questions about the warrants.
"'If the government falsified information to get the warrant, that is its own bundle of serious problems,' said Joshua Colangelo-Bryan, an attorney at #HumanRightsFirst who also represents Chung. 'But even if not, the basis for this entire operation is constitutionally invalid.'"

"The founders of the new special entity called #2USV have a long history with the U.S. government. Blackwater was formed by Prince in 1996 to provide training services to law enforcement, military personnel and other government agencies. It gained widespread attention for its work in Iraq and Afghanistan, providing security services for U.S. officials and military personnel, with critics viewing its rise as a result of the U.S. military’s overextension in the Middle East.
The military contractor came under scrutiny in 2007 following the #NisourSquareMassacre, when #Blackwater contractors opened fire and killed 17 Iraqi civilians and wounded 20 others — raising questions about oversight and accountability of private contractors. Several contractors were charged with manslaughter, and four were convicted in 2014. Trump pardoned them at the end of his first term in December 2020.

Alien and Sedition Acts
"The Alien and Sedition Acts were a set of four laws enacted in 1798 that applied restrictions to #immigration and #speech in the United States. The Naturalization Act of 1798 increased the requirements to seek citizenship, the #AlienFriendsAct of 1798 allowed the president to imprison and deport #NonCitizens, the Alien Enemies Act of 1798 gave the president additional powers to detain non-citizens during times of war, and the Sedition Act of 1798 criminalized false and malicious statements about the federal government. The Alien Friends Act and the Sedition Act expired after a set number of years, and the Naturalization Act was repealed in 1802. The Alien Enemies Act, as amended, is still in effect as 50 U.S.C. ch. 3.
"The Alien and Sedition Acts were passed by a Congress controlled by the Federalist Party, and they were directed against the other party at the time, against Democratic-Republicans, the party typically favored by new citizens. Only Democratic-Republican journalists were prosecuted by these laws. Publicity from Sedition Act trials caused massive criticism and contributed to the Federalists being removed from power in the 1800 election.
"The Acts were supported by the Federalist Party, and supporters argued that the bills strengthened national security during the Quasi-War, an undeclared naval war with France from 1798 to 1800. The acts were denounced by Democratic-Republicans as suppression of voters and violation of free speech under the First Amendment. While they were in effect, the Alien and Sedition Acts, and the Sedition Act in particular, were used to suppress publishers affiliated with the Democratic-Republicans, and several publishers were arrested for criticism of the Adams administration. The Democratic-Republicans took power in 1800 because of backlash to the Alien and Sedition Acts, and all but the Alien Enemies Act were eliminated by the next Congress.

#UNH drops charges against 7 out of 12 people arrested during #ProPalestine #protests

Published August 1, 2024"A University of New Hampshire prosecutor this week dropped criminal charges against seven of the people arrested during a May 1 pro-#Palestine protest after they reportedly accepted plea agreements.
"The seven cases were dismissed nearly three months after UNH police charged 12 people with disorderly conduct and trespassing, nine of whom were set to be arraigned in Dover District Court on Wednesday.
"The agreements involved 30 hours of community service and a period under which the arrestees must remain in 'good public standing', according to Adeena Ahsan, a UNH graduate student who was not arrested but had been in communication with those offered plea deals.
"UNH prosecutor #FrankWeeks [who is also a police captain] declined to comment on the nature of the plea deals.
"Of the other five people arrested, charges had already been dropped against a 'counter-protester' after a friend of his emailed then-President of UNH James Dean that he had been 'mistaken for a protester,' according to a report from the Boston Globe.
"Cases remain pending against the other four, including against two students who are also facing assault charges. One of them, 21-year-old rising UNH senior #AidanTurner, has said he was mistakenly identified and then violently #arrested by Weeks, the UNH prosecutor who is also a police captain. His case is currently set to go to trial on Sept. 10.
"The other, 29-year-old graduate student #SebastianRowan, has been charged with two counts each of assault on a police officer and #ResistingArrest. His case is currently before a grand jury with an indictment decision expected by Aug. 21, according to court records.
"The other two people – 21-year-old #JasonPerra and 19-year-old #LoganONeill – have trials scheduled for October 2 and 9, respectively. Both have been charged with criminal trespassing and disorderly conduct. It was not immediately clear whether they had been offered a plea deal or not."

The project is over budget and behind schedule, with a lot of hard work left to do. Its opponents hope that makes #FossilFuel companies think twice about building the next one.

Published Jan 16, 2024"As day broke over the small mountain town of #EllistonVirginia, one Monday in October, masked figures in thick coats emerged from the woods surrounding a construction site. Three of them approached three excavators and, one by one, locked themselves to the machines, bringing the day’s work to a halt. As they did so, several dozen of their fellow protesters gathered around them, unfurling banners and chanting amid the groaning and beeping of construction equipment.
"They made their way across the field, over patches of bare earth, around sections of rusty pipe meant for burial beneath the mountain. Eventually the metal tubes will form yet another section of the Mountain Valley Pipeline, which will soon carry 2 billion cubic feet of #fracked #methane from the #ShaleFields of #WestVirginia to #NorthCarolina each day. Their breath billowed in the crisp air. Beyond them stretched a bright blue sky, and mountains tinged with yellow. The past night’s rain pooled on the muddy and compacted soil beneath their feet.
"Workers in highlighter-yellow vests and hard hats milled around, some looking amused, others frustrated. One or two engaged with the #protesters, only to be told off by an irate site manager. A few miles away at the West Virginia state line, another three dozen or so activists did much the same atop #PetersMountain. One even managed to crawl under an excavator and lock herself in place, despite the cold. The others rallied around, enclosing her in a tight, protective circle.
Some might wonder why they bothered. After all, the project is, by the Mountain Valley Pipeline company’s estimate, 94 percent complete and will be wrapped up before summer. It stalled for several years amid legal fights over various permits, but Senator #JoeManchin, a moderate Democrat from West Virginia, almost single-handedly revived it in 2022 in exchange for his support of key Democratic priorities. Since then, the Biden administration and the Supreme Court have all but assured its completion. With the approximately 303-mile pipeline approaching the final stretch after almost a decade’s work, it might seem hardly worth fighting at this point.
"A large contingent of steadfast opposition begs to differ — and will enthusiastically explain why. The pipeline is six years behind schedule, about half a billion dollars over budget, and, despite promises that it would be done by the end of last year, delayed once again. The remaining construction is over rugged terrain, with hundreds of water crossings left to bridge. The company recently postponed, shortened, and rerouted its planned extension into North Carolina, a proposal long stymied by permitting problems with the main line. And, just last month, #Equitrans, which owns the #pipeline and many others across the country, was said to be considering selling itself. The road to the pipeline’s completion remains rocky, its opponents argue, with many opportunities to make finishing it as difficult as possible.
"'We cannot let them destroy our land and water,' said a young woman named Ericka. Like many interviewed for this story, she gave only her first name out of fear of reprisal from #MountainValleyPipelineLLC, which has begun suing #protesters in a bid to silence them. She had brought her three children to occupy the land that day. 'What are we going to drink? Where are we going to live? People have to come here and stop this.'"
