Most #CriticalMinerals are on #IndigenousLands. Will miners respect #TribalSovereignty?

by Taylar Dawn Stagner, March 26, 2025

"#Mining — whether for #FossilFuels or, increasingly, the critical minerals in high demand today — has a long history of perpetuating violence against #IndigenousPeople. Forcibly removing tribal communities to get to natural resources tied to their homelands has been the rule, not the exception, for centuries.

"Today, more than half of the mineral deposits needed for a global energy transition — including #lithium, #cobalt, #copper, and #nickel to make things like #batteries and #SolarPanels — are found near or beneath Indigenous lands.

"In 2007, the United Nations adopted a resolution called the Declaration on the Rights of Indigenous Peoples [#UNDRIP] that included the right to free, prior, and informed consent to the use of their lands, a concept known as #FPIC. This principle protects #IndigenousPeoples from being forcibly relocated, provides suitable avenues for redress of past injustices, and gives tribes and communities the right to consent to — and the right to refuse — #extractive industry projects like #mining.

"There’s a lot at stake: When followed, FPIC promises a process that gives Indigenous peoples a voice in how their homelands are used, as well as the right to say no to development altogether. And when it’s not, which is the vast majority of the time, #TribalCommunities are further #disenfranchised, facing #violence and #ForcedRelocation as their #sovereignty and rights are ignored.

"There are an estimated 5,000 tribal communities around the world, encompassing roughly 476 million people across 90 countries, according to the U.N. Different tribes have different opinions on mining, but rarely is their legal right to refuse extraction projects recognized, even under the 2007 declaration.

"Grist talked with five experts to better understand what free, prior, and informed consent should look like in this new era of mineral extraction. Their responses have been edited for length and clarity."

Japan hauls rare earth-rich mud from deep sea in bold test mission

    Story by BeckhamLangford
    Feburary 3, 2026

"Japan’s own planners acknowledge the uncertainties. Jan briefings on the test mining plan stressed that, However, key aspects remain unknown, including the quality of the minerals and the economics of lifting and processing such vast volumes of mud. Mining the mud had previously been seen as too expensive compared with land-based deposits, and even with new technology, the cost of pumping, dewatering and refining the material at scale is still an open question. Analysts also point out that any move toward commercial production will face intense scrutiny from environmental regulators and coastal communities, who want clearer evidence on how sediment plumes, noise and habitat disruption will affect #DeepOcean #ecosystems around the site."

  8. Trump to approve land swap for Rio Tinto copper mine opposed by Native Americans

    By Ernest Scheyder
    April 18, 2025

    - Forest Service to republish environmental report within 60 days
    - Publication needed to approve land swap for Resolution project
    - Native groups oppose project on religious grounds
    - Related case still pending at Supreme Court

"The #Trump administration said on Thursday it would approve a land swap needed for #RioTinto and #BHP to build one of the world's largest copper mines, despite concerns from Native Americans that it would destroy a site of religious value.
The move is likely to escalate tensions between Indigenous groups vocal about the need to preserve historical lands and Western governments eager to boost critical minerals production and offset China's sector dominance.

"The U.S. Forest Service, which is part of the Agriculture Department, said it will republish within 60 days an environmental report needed for the #ResolutionCopper project land swap to occur.

"Congress and then-President #BarackObama approved the mine in 2014 after it was added at the last minute to a must-pass military funding bill [#NDAA] with the condition that an environmental report be published.

"The underground mine - which President Donald Trump approved in his first term before successor Joe Biden reversed him - would supply more than a quarter of U.S. appetite for copper and be a key part of Trump's plan to boost U.S. mining.

"Copper is used in construction, transportation, electronics and many other industries. The United States imports roughly half of its copper needs each year.

"Yet the mine's construction would cause a crater that would swallow the Oak Flat site where Arizona's San Carlos Apache worship. That has fueled strong opposition from all but one of the state's 22 Native American tribes, as well as the National Congress of American Indians.

"Apache Stronghold, a nonprofit group comprised of the San Carlos Apache Tribe and conservationists, asked the U.S. Supreme Court last September to block the land swap. The court has not yet decided whether to take that case.
Were the court to do so, however, the Forest Service said on Thursday it 'may reevaluate how to proceed' regarding the land swap.

" 'The U.S. government is rushing to give away our spiritual home before the courts can even rule, just like it's rushed to erase Native people for generations,' said #WendslerNosie, an #ApacheStronghold leader."

U.S. Courthouse, 401 West Washington Street, Phoenix, Arizona 85003

WASHINGTON – "A coalition of #WesternApaches, other #NativePeoples, and non-Native #allies asked a federal court late yesterday to stop the U.S. government from handing over their sacred site at Oak Flat to a multinational mining giant as early as June 16, 2025.

"In #ApacheStronghold v. United States, the Ninth Circuit Court of Appeals last year refused to stop the federal government from transferring #OakFlat to #ResolutionCopper, a Chinese-owned mining company that plans to turn the site into a massive mining crater, ending Apache religious practices forever (Watch the short video linked below to learn more).

"The emergency appeal comes after the government announced last week it will forge ahead with the transfer even though the case is currently under consideration by the #USSupremeCourt."

  10. #Kerala fishermen up in arms against #DeepSeaMining proposal off #Kollam coast

    March 22, 2025

"The fishermen in Kerala have already launched several protests against the proposed plan to open up the sea to private mining companies as part of the Union Government’s ‘Blue Economy’ initiative.

"All the fishermen’s associations stand united in their protests against this proposal, alleging that it would bring an end to the fisheries sector in the country, not only in the #ArabianSea but also in the #BayOfBengal.

“ 'The mining, according to the scientific report we have, can disturb the seabed and completely destroy fish spawning habitats. It can also release poisonous gases trapped on the #DeepSeaFloor, causing severe #environmental issues,' Kerala Minister for Fisheries, Saji Cherian, told PTI.

"He said that deep-sea mining requires huge investments and heavy machinery, meaning only #multinational #corporations will be involved, making these areas completely inaccessible to poor fishermen.

"The Kerala government, which is strongly opposing this project, passed a resolution in the Assembly urging the Centre to withdraw it.

"The Minister said the proposed site, off the Kollam shore in Kerala in the Arabian Sea, is very rich in marine resources and serves as a lifeline for fishermen from Kerala and other states.

“ 'We have a highly diverse and extensive fish population in this area. The mining will completely wipe out this habitat, severely affecting the livelihood of fishermen in our region,' Saji Cherian said."

  11. #NPR: The U.S. takes a step toward allowing #mining on the ocean floor, a fragile #ecosystem

by Julia Simon, April 25, 2025

"President #Trump signed an executive order Thursday aimed at making it easier for companies to mine the deep seafloor, saying it would create 'a robust domestic supply for critical minerals.'

"There is currently no commercial-scale deep-sea mining anywhere in the world. But companies have long eyed the ocean floor as a potential source of metals like nickel, cobalt, manganese and copper, which are used in batteries for electric vehicles and other technologies.

"The world has no rulebook for deep-sea mining. One company is pushing forward anyway

"These metals can be found in potato-sized nodules lying on the ocean floor. Many of the nodules are in the middle of the Pacific ocean, beyond the legal territory of individual countries.

"Thursday's order might circumvent ongoing international negotiations to regulate deep-sea mining.

"Those regions have traditionally been overseen by an international organization, the #InternationalSeabedAuthority (#ISA). The ISA has hosted talks for years to try to hammer out a rulebook to govern a potential seabed mining industry. The U.S. did not ratify the treaty that governs the seabed, and is not a voting member of the ISA, though in the past under previous administrations it has respected the ISA process.

"In his executive order, Trump instructed federal agencies to expedite the process for reviewing and issuing permits for mining on the seafloor in both U.S. and international territory. It will use a U.S. law from 1980, the "#DeepSeabed Hard Mineral Resources Act."

"Scientists and environmental groups condemned the order, arguing that opening the deep seabed for mining could disrupt important marine ecosystems, and damage the fishing industry.

" 'This is being planned on some of the least resilient #ecosystems on the planet,' says Douglas McCauley, professor of ocean science at the University of California Santa Barbara. 'It would have #catastrophic biological consequences.'

"Underwater mining can create plumes of sediment that could suffocate marine life, and degrade the #FoodWebs that fish depend on, McCauley says.

"There are also important questions about whether we actually need to be mining the seabed to get enough of these minerals for technologies like batteries, says Micah Ziegler, assistant professor of energy and chemical systems at Georgia Institute of Technology.

"While a couple of years ago researchers were concerned about the limitations of land-based mining for metals like cobalt and nickel, a variety of alternative #battery chemistries have been developed that might reduce the need for those elements, Ziegler says."

  12. As #Norway Considers #DeepSeaMining, a Rich History of Ocean Conservation Decisions May Inform How the Country Acts

In the past, scientists, industry and government have worked together in surprising, tense and fruitful ways

by Christian Elliott, April 21, 2025

"At the #Arctic #MidOceanRidge off the Norwegian coast, molten rock rises from deep within the Earth between spreading tectonic plates. Black smoker vents sustain unique ecosystems in the dark. Endemic species of long, segmented bristle worms and tiny crustaceans graze on bacteria mats and flit among fields of chemosynthetic tube worms, growing thick as grass. Dense banks of sponges cling to the summits and slopes of underwater mountains. And among all this life, minerals build up slowly over millennia in the form of #sulfide deposits and #manganese crusts.

"Those minerals are the kind needed to fuel the global green energy transition—#copper, #zinc and #cobalt. In January 2024, Norway surprised the world with the announcement it planned to open its waters for exploratory deep-sea mining, the first nation to do so. If all went to plan, companies would be issued licenses to begin identifying mineral deposits as soon as #Spring2025. To some scientists who’d spent decades mapping and studying the geology and ecology of the Norwegian seabed and Arctic Mid-Ocean Ridge, the decision seemed premature—they still lacked critical data on the area targeted for mining. The government’s own Institute of Marine Research (IMR) accused it of extrapolating from a small area where data has already been collected to the much larger zone now targeted

“ 'Our advice has been we don’t have enough knowledge,' says Rebecca Ross, an #ecologist at IMR who works on Norway’s #Mareano deep-sea mapping initiative. She says the decision was based solely on the #geology of the area. Taking high-resolution scans of the seabed and sampling its geology is the first step when research ships enter a new area, but critical biological and ecological research is more difficult and tends to come later—which is the case on the ridge area targeted for mining. Ross says it’s certain that area contains vulnerable marine ecosystems that would be affected by the light and noise pollution and sediment plumes generated by mining. The IMR estimates closing the knowledge gap on the target area could take ten years.

"The same conflict, with a partial scientific understanding misinterpreted and used to justify resource extraction, is playing out in the #Pacific, where mining pilot projects are already underway in international waters. Years before, scientists funded by industry scouted the #seabed there, discovering both valuable minerals and new forms of life."

  13. #Oxygen produced in the #DeepSea raises questions about extraterrestrial life

"Over 12,000 feet below the surface of the sea, in a region of the Pacific Ocean known as the Clarion-Clipperton Zone (#CCZ), million-year-old rocks cover the seafloor. These rocks may seem lifeless, but nestled between the nooks and crannies on their surfaces, tiny sea creatures and microbes make their home, many uniquely adapted to life in the dark.

"These deep-sea rocks, called polymetallic #nodules, don't only host a surprising number of sea critters. A team of scientists that includes Boston University experts has discovered they also produce oxygen on the seafloor.

"The discovery is a surprise considering oxygen is typically created by plants and organisms with help from the sun -- not by rocks on the ocean floor. About half of all the oxygen we breathe is made near the surface of the ocean by phytoplankton that photosynthesize just like land-dwelling plants. Since the sun is needed to carry out photosynthesis, finding oxygen production at the bottom of the sea, where there is no light, flips conventional wisdom on its head. It was so unexpected that scientists involved in the study first thought it was a mistake.

"This was really weird, because no one had ever seen it before," says Jeffrey Marlow, a BU College of Arts & Sciences assistant professor of biology and coauthor on the study, which was published in Nature Geoscience.

As an expert in microbes that live in the most extreme habitats on Earth -- like hardened lava and deep-sea hydrothermal vents -- Marlow initially suspected that microbial activity could be responsible for making oxygen. The research team used deep-sea chambers that land on the seafloor and enclose the seawater, sediment, polymetallic nodules, and living organisms. They then measured how oxygen levels changed in the chambers over 48 hours. If there are plentiful organisms breathing oxygen, then the levels would normally decline, depending on how much animal activity is present in the chamber. But in this case, oxygen was increasing.

" 'We did a lot of troubleshooting and found that the oxygen levels increased many more times following that initial measurement,' Marlow says. 'So we're now convinced it's a real signal.'

"He and his colleagues were aboard a research vessel tasked with learning more about the ecology of the CCZ, which spans 1.7 million square miles between #Hawaii and #Mexico, for an environmental survey sponsored by The Metals Company, a deep-sea mining firm interested in extracting the rocks en masse for metals. After running experiments on board the vessel, Marlow and the team, led by Andrew Sweetman at the Scottish Association for Marine Science, concluded the phenomenon isn't primarily caused by microbial activity, despite the abundance of many different types of microbes both on and inside the rocks.

"#PolymetallicNodules are made of rare metals, including #copper, nickel, cobalt, iron, and manganese, which is why companies are interested in mining them. It turns out, according to the study, that those densely packed metals are likely triggering "seawater electrolysis." This means that metal ions in the rock layers are distributed unevenly, creating a separation of electrical charges -- just like what happens inside of a battery. This phenomenon creates enough energy to split water molecules into oxygen and hydrogen. They named this "dark oxygen," since it's oxygen made with no sunlight. What remains unclear is the exact mechanism of how this happens, if oxygen levels vary across the CCZ, and if the oxygen plays a significant role in sustaining the local ecosystem."

  14. Breaking News! (via @bsnorrell.blogspot.com )

Feds Charge Ahead with Plan to Destroy #OakFlat

#SupremeCourt poised to consider #ApacheStronghold’s appeal

By Becket Law, Censored News, April 17, 2025

WASHINGTON – "The U.S. government today announced that it is forging ahead with plans to transfer a #NativeAmerican #SacredSite to a multinational mining giant in as few as 60 days, despite a
federal lawsuit challenging the action as illegal.

"In Apache Stronghold v. United States, Apache Stronghold—a coalition of #Apaches, other Native peoples, and non-Native allies—sued to stop the federal government from transferring Oak Flat to
Resolution Copper, a Chinese-owned mining company that plans to turn the site into a massive mining crater, ending Apache religious practices forever.

"The government has announced it will now forge ahead with the transfer even though the case is currently under consideration by the U.S. Supreme Court.

"Since time immemorial, #WesternApaches and other Native peoples have gathered at Oak Flat, outside of present-day #SuperiorAZ, for sacred religious ceremonies that cannot take place anywhere else. Known in Apache as Chi’chil Biłdagoteel, Oak Flat is listed in the #NationalRegisterOfHistoricPlaces and has been protected from #mining and other harmful practices for decades.
These protections were targeted in December 2014 when a last-minute provision was slipped into a must-pass defense bill [#NDAA] authorizing the transfer of Oak Flat to the Resolution Copper company.

"#ResolutionCopper now plans to turn the sacred site into a two-mile-wide and 1,100-foot-deep crater.

"The majority owner of Resolution Copper, Rio Tinto, sparked international outrage when it deliberately destroyed 46,000-year-old Indigenous rock shelters at one of Australia’s most significant cultural sites.

" 'The feds are barreling ahead to give Oak Flat to Resolution Copper, even as the Supreme Court considers whether to hear the case,' said Luke Goodrich, vice president and senior counsel at Becket. 'This makes the stakes crystal clear: if the Court doesn’t act now, Oak Flat could be transferred and destroyed before justice can be served.' "

By Wendsler Nosie, Apache Stronghold, March 13, 2025, via #CensoredNews

"In the heart of #TontoNationalForest in #Arizona lies a place that my people, the #WesternApache, still hold above all others. This place is Chi'chil Biłdagoteel, also known as Oak Flat. To us, it is more than a stretch of land; it is sacred and holy. It is where our ancestors walked, where we gather to pray, to carry out ceremonies passed down through generations, and to speak to our Creator.

"This land is part of who we are as a people, and its spirit is bound to our own.
Now, the federal government plans to give our sacred Oak Flat to a multinational #mining #corporation owned by the Chinese Communist Party. This will not just scar the land; it will destroy it, poisoning the environment and trampling on our tribal rights. But the deepest wound will be the loss of our spiritual home, a place our people cannot exist without. We are fighting this in the courts, all the way to the #USSupremeCourt. But this is about more than law and policy—this is about survival of our way of life and the spirit of this sacred land.

  16. A river ‘died’ overnight in #Zambia after an acidic waste spill at a #Chinese-owned #mine

By RICHARD KILLE and JACOB ZIMBA
    March 15, 2025

KITWE, Zambia (AP) — "Authorities and environmentalists in Zambia fear the long-term impact of an acid spill at a Chinese-owned mine that contaminated a major river and could potentially affect millions of people after signs of #pollution were detected at least 100 kilometers (60 miles) downstream.

"The spill happened on Feb. 18 when a tailings dam that holds acidic waste from a #CopperMine in the north of the country collapsed, according to investigators from the Engineering Institution of Zambia.

"The collapse allowed some 50 million liters of waste containing concentrated acid, dissolved solids and heavy metals to flow into a stream that links to the #KafueRiver, Zambia’s most important waterway, the engineering institution said.

"'It is an #environmental disaster really of catastrophic consequences,' said Chilekwa Mumba, an environmental activist who works in Zambia’s Copperbelt Province."

  17. #OakFlat Update on #USSupremeCourt case!

    By #ApacheStronghold, December 16, 2024

    Supreme Court update

"Thank you to all of our supporters who are continuing to pray about our #SupremeCourt petition to #ProtectOakFlat. As you may know, the Supreme Court considered our petition for the second time at its conference on December 13, 2024. Since we did not receive notice about it’s decision to take the case, the Court intends to consider it again at its next conference on January 10, 2025. Under that schedule, we could hear on January 10 or 13 whether the Court will take our case. Or the Court may take additional time for further consideration.

"Either way, we take this as an encouraging sign that the Court is devoting extra time to our case and giving it careful examination. We ask all of our supporters to continue praying that the Justices will agree to hear our case and protect Oak Flat—just as the sacred places of other faiths have long been protected throughout the country.

Thank you again for your support."

  20. U.S. Supreme Court to Consider #ApacheStronghold's Case to #SaveOakFlat in December

By Brenda Norrell, Censored News, Nov. 22, 2024

WASHINGTON -- "The U.S. Supreme Court will likely consider Apache Stronghold's case on December 6, Apache Stronghold said today. The U.S. government plans to turn Apaches ceremonial place Oak Flat over to an international mining giant to destroy it with a massive copper mine that would poison the land and water.
Apache Stronghold said if the Supreme Court considers the case on December 6, they could hear on December 9 whether the high court will take the case, or it could take more time to consider it.

"'Either way, we take this as an encouraging sign that the Court is devoting extra time to our case and
giving it careful examination. We ask all of our supporters to continue praying that the justices will agree to hear our case and protect Oak Flat -- just as the sacred places of other faiths have long
been protected throughout the country,' Apache Stronghold said today.

"The Supreme Court had scheduled to consider the case for review on November 22, but rescheduled the case for December 6.

"Apache Stronghold's Wendsler Nosie, Sr. pointed out that a writ of certiorari would order the lower court to forward all documents on the case to the U.S. Supreme Court. However, the Supreme Court is selective and only hears cases when at least four of the justices believe the case raises a significant federal question that is in the public interest."

  22. The Silent Killers in #IndianCountry: #Copper, #Lithium, #Uranium and #Plutonium

Judge finds plutonium plants in #NewMexico and #SouthCarolina violated environmental laws

    By #BrendaNorrell, #CensoredNews, Oct. 10, 2024

"The U.S. government's plan for increased plutonium production at #LosAlamos National Laboratory, in the heart of Pueblo lands in northern New Mexico, has been delayed by a federal judge.

"Continuing the U.S. legacy of poisoning Indian country with #radiation, this comes as the U.S. government is granting leases to foreign #mining companies targeting Native #sacred lands and communities.

"#CopperMining is targeting San CarlosApache's sacred #OakFlat; #Hualapai are suing the US Department of Interior to halt lithium mining at their sacred spring Ha'Kamwe'; and the U.S. government is promoting the ongoing digging into the #Paiute Massacre Site in northern Nevada for #lithium, in violation of all federal laws that protect Native religious and historic sites, the environment and endangered species.

"Uranium mining in the Grand Canyon threatens #Havasupai's aquifer, the haul route endangers everyone in the Four Corners region, and the uranium mill at White Mesa Ute in #Utah is poisoning #Utes.

"Interior Sec. #DebHaaland said in Farmington, N.M., that Los Alamos Labs would be the leader in the so-called '#GreenEnergy transition' in the #FourCorners region.

"More than 500 radioactive #UraniumMill sites remain on the #NavajoNation that have not been cleaned up by the U.S. #EPA, which deceives the public by announcing plans and promises to clean up the #ColdWar sites.

"In the current federal lawsuit, a federal judge in South Carolina ruled that U.S. energy officials illegally neglected to study impacts to the #environment in efforts to increase plutonium production for nuclear weapons in New Mexico and South Carolina.

"'South Carolina District Court Judge Mary Geiger Lewis sided with environmental, #AntiNuclear proliferation and community groups last week who sued the National Nuclear Security Administration (#NNSA), which oversees the nuclear weapons stockpile as part of the U.S. Department of Energy [#DOE],' reports Source New Mexico.

"The U.S. is investing billions into restarting the manufacture of #PlutoniumPits, the grapefruit-sized spheres developed for #nuclear weapons. The plutonium is produced from uranium.

"'The federal government halted its manufacturing program at the #RockyFlatsPlant in #Colorado in 1989 after an FBI raid due to safety concerns and #EnvironmentalCrimes,' Source New Mexico reports.

"The U.S. government's #AtomicBombTesting in #Nevada left a trail of cancer and death for #WesternShoshone. The documentary 'Downwind' reveals the truth.

"'This is a very serious issue and that's why I can't let it go. I can't move on. People say, 'oh, why don't you just let it go?' Because it's killing my family. It's killing my land. It's killing my people. And that will not stand. It's being done in secret. And killing Indians in secret will not stand,' said Ian Zabarte, Principal Man of the Western Bands of the #ShoshoneNation of Indians. Zabarte is featured in '#Downwind' about radiation poisoning from U.S. #NuclearTests.

"Currently, foreign companies -- which receive the profits and find it easy to avoid clean up and responsibility for #environmental crimes and deaths from #cancer -- are receiving the mining leases from the U.S. government. The leases are granted by the U.S. Interior's Bureau of Land Management (BLM) and in the case of #UraniumMining in the #GrandCanyon, it is the USDA's Forestry Service. #Biden's attorneys have joined the lawsuit with #RioTinto to devastate #OakFlat.

"Australian and Canadian mining corporations are devastating Native lands and communities, poisoning the water and causing widespread cancer.
Rio Tinto, targeting Apaches #OakFlat, is an Australian company which destroyed 46,000 years of #Aboriginal sacred history in caves in #Australia.

"Another Australian mining company is targeting #Hualapai's sacred site. It is #Hawstone / #ArizonaLithium, in Perth, Australia.

"#EnergyFuels, now uranium mining in the Grand Canyon, and operating the uranium mill at #WhiteMesaUte, is a Canadian company. Another Canadian company is digging into the #Paiute Massacre Site. It is #LithiumAmericas.
#Hopi judge #DianeHumetewa granted a temporary restraining order to halt the lithium mining at #Hualapai's sacred spring."

  23. #ApacheStronghold Asks #SupremeCourt to #SaveOakFlat

    By Becket Law, via #CensoredNews
    Sept. 11, 2024

WASHINGTON – "A coalition of #WesternApaches, other #Native peoples, and non-Native #allies asked the #SupremeCourt today to protect their sacred site at #OakFlat from destruction by a multinational mining giant. In Apache Stronghold v. United States, the Ninth Circuit Court of Appeals refused to stop the federal government from transferring Oak Flat to #ResolutionCopper, a foreign-owned mining company that plans to turn the site into a massive mining crater, ending #Apache religious practices forever (Watch video linked below to learn more).

"The Apaches and their allies hosted a day of prayer outside the Court as they asked the Justices to save the spiritual lifeblood of their people.
Since time immemorial, Western Apaches and other Native peoples have gathered at Oak Flat, outside of present-day Superior, Arizona, for sacred religious ceremonies that cannot take place anywhere else. Known in Apache as Chi’chil Biłdagoteel, Oak Flat is listed in the National Register of Historic Places and has been protected from mining and other harmful practices for decades. These protections were targeted in December 2014 when a last-minute provision was inserted into a must- pass defense bill authorizing the transfer of Oak Flat to the Resolution Copper company. Resolution Copper is a foreign-owned mining company that plans to turn the sacred site into a two-mile-wide and 1,100-foot-deep crater. The majority owner of Resolution Copper, #RioTinto, sparked international outrage when it deliberately destroyed 46,000-year-old #Indigenous rock shelters at one of #Australia’s most significant cultural sites.

“'Oak Flat is our Mt. Sinai—the most sacred place where generations of Apache have come to connect with our Creator, our faith, and our land,' said Dr. Wendsler Nosie Sr. of Apache Stronghold. 'We pray the Justices will protect Oak Flat and ensure that our place of worship is not treated differently simply because it lacks four walls and a steeple.”
Apache Stronghold—a coalition of Apaches, other Native peoples, and non-Native allies—filed this lawsuit in January 2021 seeking to halt the proposed mine at Oak Flat. The mine is opposed by 21 of 22 federally recognized tribal nations in Arizona and by the National Congress of American Indians. Meanwhile, national polling indicates that 74% of Americans support protecting Oak Flat. The Ninth Circuit ruled earlier this year that the land transfer is not subject to federal laws protecting religious freedom. But five judges dissented, writing that the court 'tragically err[ed]' by refusing to protect Oak Flat. After unsuccessfully asking all 29 judges on the Ninth Circuit to rehear the case, Apache Stronghold has filed their appeal to the Supreme Court.

"'Blasting the birthplace of Apache religion into oblivion would be an egregious violation of our nation’s promise of religious freedom for people of all faiths,' said Luke Goodrich, vice president and senior counsel at Becket. 'The Court should uphold its strong record of defending #ReligiousFreedom by ensuring that the Apaches can continue worshiping at Oak Flat as they have for centuries.'

"In addition to Becket, Apache Stronghold is represented by Erin Murphy of Clement & Murphy PLLC, Professor Stephanie Barclay of Georgetown Law School, and attorneys Michael V. Nixon and Clifford Levenson.

"Apache Stronghold, San Carlos, Arizona, is a 501(c)3 nonprofit community organization of individuals who come together in unity to battle continued colonization, defend Holy sites and freedom of religion. We are currently in a battle to #SaveOakFlat from destruction by #ResolutionCopper (#BHP & #RioTinto). Chi’chil Biłdagoteel (also known as Oak Flat) is a sacred site for our Apache people and many other #NativeAmericans. This is a place that has special significance— a place where we pray, collect water and medicinal plants for ceremonies, gather acorns and other foods, and honor those that are buried here.

"We received the response from the 9th Circuit Court of Appeals. Our request to be heard by the full 29-judge panel was denied, none of the judges requesting a vote for rehearing. The Court amended its decision to discuss a previous Supreme Court decision that hadn’t been considered, and the 9th Circuit’s decision on the case remained closely divided, 6 to 5, with five dissenting judges and over 240 pages of opinions. We have now completed the 9th Circuit appeal, and the next step is petitioning to be heard by the Supreme Court. I want to thank everyone for your endless support and prayers. I know capitalism had began as far back as when trade began. For over 500 hundred years, we #IndigenousPeople of America, have suffered equally to the rest of the world. What had started in the beginning between good and evil will again face each other. One, to protect the greatest gift god gave the world or the other.,to destroy every human life and the spirit that #MotherEarth gives birth to. The question is, where will you stand in this moment? We will all be judged. Blessings to all.

By Báásé Pike, Photos by Molly Peters, #CensoredNews, August 12, 2024

CONFEDERATED VILLAGES of LISJAN NATION -- "On August 8th, the Apache Stronghold gathered with the Confederated Villages of #Lisjan Nation for prayers. We were welcomed with open arms to the sacred site of the Lisjan people. Corrina Gould, the leader of the Confederated Villages of Lisjan Nation spoke about the history of the site.

"'It was heartbreaking to learn their #SacredSite was one of the oldest village and ancestral burial sites that was taken over for #CorporateGreed. After many years the people took their sacred land back through a legal battle and purchasing.

"'Throughout this journey, we are reminded of the system that only cares for #colonists’ profits first. Their land was taken forcefully and then made them, the #IndigenousPeople people buy the land that was once their home. This is what the fight is about.

“'As #IndigenousPeople, we know through our history and culture that there is a spiritual connection to the land but this is what the United States wants us to prove in court. However, this case scares the U.S. because they’ll have to answer the question about spirituality. This case makes the United States confront the wrongdoing of the Indigenous people and all people.'

"So, we ask you to please keep us in your prayers as we continue our prayer journey to the #SupremeCourt to stop the shattering of the human existence and to protect #MotherEarth."

  28. #ApacheStronghold at Peehee Mu'huh Locked Gates for People of Prayer

On the Journey to the Supreme Court

    By Apache Stronghold, #CensoredNews

"Apache Stronghold visited Peehee Mu’huh (#ThackerPass), the second stop on the Prayer Journey to the Supreme Court [#SCOTUS] to Stop the Shattering of Human Existence and Protect #MotherEarth.

"We visited with the People of #RedMountain, who are fighting a #LithiumMine that is destroying their #SacredSite. When we arrived at the entrance to Peehee Mu’huh, we found a chain link wall with a locked gate, blocking everyone except those authorized by the mine.

"Security trucks came to go through the gate, and one of the drivers admitted that they knew the Apache Stronghold would be there with the People of Red Mountain.

"One truck drove off toward the mine, while the other driver re-locked the gate and left, emphasizing that the mining company has access to Peehee Mu’huh, but the Indigenous people who were stewards of the land since time immemorial, and all others who would go there to pray, are locked out.

"Dr. Wendsler Nosie Sr. said, 'It’s a sad reminder that people don’t know the day could come, if #OakFlat is ever transferred to #ResolutionCopper, that the acorns, #MedicinePlants, and water could be locked away behind a gate facing death at the hands of a corporation.

"'People need to come together to stop this desecration happening at Peehee Mu’huh and prevent it from happening everywhere else, before it’s too late.'

"Costanoan Rumsen #CarmelTribe said, 'We are honored to welcome and pray along side the Apache Stronghold and Protect Oak Flat on their Prayer Journey. Please join us in prayer this Saturday from 7 am-12 noon.' Chief Ya'anna Learning Village and Tuatukar Eco-Cultural Center for Indigenous Regeneration, 4500 Via Marisol, #Los AngelesCalifornia 90042.

by Brandi Morin May 17, 2024

"Apache Stronghold has been waging their fight against these giants [#RioTinto and #BHP] in the U.S. Circuit Court of Appeals. In late April, the court rejected an appeal of a lower court’s ruling from 2021 that found the mine wouldn’t threaten the First Amendment religious practice rights of the #Apache. Now, the group is taking their case to the U.S. Supreme Court.

"Chi’chil Bildagoteel was once protected. In 1955, President Dwight D. Eisenhower listed the area on the National Register of Historic Places as a Traditional Cultural Property. That designation stood until 2014, when former U.S. Senator #JohnMcCain slipped a rider onto a must-pass National Defense Authorization Act to allow the sale of Oak Flat to Resolution Copper."

  30. [Film] The #ApacheStronghold defending #sacred #OakFlat land from a #CopperMine

    The Real News Network
    May 21, 2024

"In the heart of the #Arizona high desert lies a battle for the soul of the land. The ancient, sacred grounds of #Apache #Native territory are under threat from a looming giant — a massive copper mine that promises riches for the locals, and a pathway to the so-called green transition. But, as is often the case, it comes at a cost.

"The #SanCarlosApache tribe calls it Chi’chil Bildagoteel; English speakers call it Oak Flat. It sits on a mountainous plateau within a 17.3-kilometer oasis in the #TontoNationalForest. #RioTinto and #BHP, two of the world’s biggest mining companies, have staked their claim here through a joint venture called #ResolutionCopper. For over 10 years they’ve been lobbying governments for the right to build a colossal mine that would cover roughly 7,000 acres of surface area, and extend more than a mile into the ground.

"The only thing that stands in their way is the #resistance of the Apache Stronghold, a nonprofit community organization of #Natives and non-Natives uniting to counter ongoing #colonization, defend holy sites and protect freedom of religion, which was created to protect Chi’chil Bildagoteel.

  32. #ApacheStronghold: Rare Request Gives Federal Court One More Chance to Protect #SacredSite

By Becket Law, Apache Stronghold, #CensoredNews, April 15, 2024

WASHINGTON - "A coalition of Western Apaches and allies today asked all 29 judges on the Ninth Circuit Court of Appeals to protect their sacred site at #OakFlat from destruction by a mining project. In Apache Stronghold v. United States, a special 'en banc' panel of eleven judges split 6-5 earlier this year, refusing to stop the federal government from transferring Oak Flat to #ResolutionCopper, a foreign-owned #mining company that plans to turn Oak Flat into a massive mining crater, ending #Apache religious practices forever.

"Today’s appeal gives the full court one more chance to protect the spiritual lifeblood of the Apache people before the case goes to the Supreme Court.

"Since time immemorial, #WesternApaches and other Native peoples have gathered at Oak Flat for sacred religious ceremonies that cannot take place anywhere else. Known in Apache as Chi’chil Biłdagoteel, Oak Flat is listed in the National Register of Historic Places and has been protected from mining and other harmful practices for decades. These protections were eliminated in December 2014 when a last-minute provision was inserted into a must-pass defense bill authorizing the transfer of Oak Flat to the Resolution Copper company. Resolution Copper is a foreign-owned mining company that plans to turn the sacred site into a two-mile-wide and 1,100-foot-deep crater. The majority owner of Resolution Copper, #RioTinto, sparked international outrage when it deliberately destroyed 46,000-year-old #Indigenous rock shelters at one of #Australia’s most significant cultural sites."

  33. The massive #CopperMine that could test the limits of religious freedom

    Story by Taylar Dawn Stagner

"Earlier this month, the Ninth Circuit Court of Appeals declined to stop the construction of a copper mine in #Arizona on land sacred to the #SanCarlosApache Tribe as well as other Indigenous nations. Chí’chil Biłdagoteel, also known as #OakFlat, sits atop the third largest copper deposit on the planet and is essential to green energy projects. The operation, which will be run by #ResolutionCopper, a subsidiary of mining companies #RioTinto and #BHP, will leave a crater nearly 1,000 feet deep and 2 miles wide.

"'Oak Flat is like #MountSinai to us — our most sacred site where we connect with our Creator, our faith, our families and our land,' said Wendsler Noise of #ApacheStronghold, a nonprofit fighting to protect the area. 'We vow to appeal to the Supreme Court.'

"Over the years, Oak Flat has developed a storied history. In 2014, Oak Flat was a part of a #MilitarySpending bill that would allow the government to 'swap' the area with other land in Arizona. In 2016, it was added to the National Register of Historic Places in an attempt to protect it, and in 2021 the Apache Stronghold sued the government, arguing that the land was reserved for the #WesternApaches in an 1852 treaty. Then, in 2023, #Apache Stronghold made the case that the land transfer would keep them from exercising their religion. The court disagreed.

"The issue before the court illustrates a battle between religion, #IndigenousRights, and potential solutions to the climate crisis. For tribal nations like the San Carlos Apache who practice what are known as 'land-based religions' — #ceremonial practices that are inextricably tied to areas Indigenous peoples have relationships with — preserving those lands with religious significance is paramount to the survival, and transmission, of both culture and values to the next generation.

"But for developers, the proposed mine would support a few thousand jobs for the surrounding community, inject $61 billion into the local economy, and provide a critical supply of copper for everything from electric vehicles to energy storage systems. By 2031, the world will need almost 37 million metric tons of copper to continue the process of green-energy electrification. Resolution Copper said that Oak Flat could provide a quarter of U.S. copper production.

"At the heart of Apache Stronghold’s legal case is something called 'substantial burden' — there must be proof that the government has interfered with an individual’s right to practice their religious beliefs. Substantial burden protects U.S. citizens from government interference, unless the government has a really good reason. That means Apache Stronghold’s claim needs to be justified with a high level of scrutiny. "
