It serves as a powerful mechanism for individuals to hold their governments to account and is often the last resort when prior messages go unheard. However, politicians often perceive this right as a threat, especially when force of numbers demonstrates support for an issue.
"In our recently published Rule of Law report, Liberties’ members reported an increase in restrictions on the right to peaceful protest in all countries - from bans on individual protests to the disproportionate use of force by the police and legislative changes. A widespread trend emerged of restricted #ProPalestine protests and #EnvironmentalDefenders receiving particularly harsh penalties.
Bans on Protests
"Restrictions on various protest movements justified on public safety grounds were documented in many member states. In #Germany, the Berlin Assembly Authorities implemented a temporary blanket ban targeting pro-Palestine demonstrations. Initially, the ban targeted celebrations of the mass murder and pro-Hamas demonstrations but later extended to all pro-Palestinian protests. Similarly, in #Latvia, an unregistered #FreePalestine movement protest was banned after an assessment by the state security service that the event would, among other risks, harm the country’s international interests.
"The #Estonian police banned a protest in support of Palestinians, which was later declared unlawful by the administrative court. In #Hungary, Prime Minister #ViktorOrbán publicly prejudiced support for Palestinians by linking it with #terrorism, equating solidarity with civilians victims to threats to the public order. As the fifteen attempts to organise protests were successively banned, the government and the Prime Minister re-asserted their power by deciding what can be demonstrated for, namely, topics in line with their political interests."

Following the Covid-19 pandemic and the war in Ukraine, the Hungarian government has repeatedly declared and extended the state of danger, allowing for the adoption of emergency decrees restricting, among other rights, the freedom to assemble. Both the Hungarian Supreme Court and Constitutional Court upheld the protest bans on the basis of public safety and security, legalising the practice of police-authorised restrictions in times of conflict.
"Further restrictions, including bans on #slogans and #signs during #demonstrations, sought to criminalise protesters. Several individuals were arrested or fined for displaying signs or slogans related to Palestine. In #Belgium, activists faced administrative sanctions for carrying a #PalestinianFlag or the #keffiyeh. Similarly, in the #Netherlands, attendees of an #ExtinctionRebellion demonstration were prohibited from mentioning the conflict in the Middle East. The enforcement of restrictions went as far as arrests, as Croatian activists were charged with misdemeanor after projecting a message in support of Palestine on a building across from the Israeli Embassy in Zagreb.
"In Hungary, a demonstrator faced criminal charges after wearing a gas mask and removing it after being asked by the police. In a worrying trend of criminalising protest activities, several activists were arrested and charged with sedition before an Extinction Rebellion demonstration in the Netherlands.
Disproportionate use of force by the police
"The criminalisation of environmental and pro-Palestine protesters was worsened by the violent repression of the police through excessive use of force. This was particularly notable in Sweden, where student encampments in support of Palestinians were forcibly displaced and participants were charged with criminal offenses. #PainGrips, water guns and #WaterCannons were used against environmental activists, pro-Palestinian and anti-immigration demonstrators in Germany, the #Netherlands and #Ireland.
"Environmental activists faced similar fates, The NGO ‘#FranceNatureEnvironnement’ reported concerns to the UN Special Rapporteur on Environmental Defenders following the violent repression of protesters during a demonstration against the A69 highway. In #Sweden, a woman was dismissed from her job at the Swedish Energy Agency for participating in an environmental demonstration and a growing number of #EcoActivists were fined for participating in peaceful protests."

#HR1057: Penalties for #protesters on #InterstateHighways
"Would create steep new penalties for #protesters deemed to be 'deliberately delaying traffic,' 'standing or approaching a motor vehicle,' or 'endangering the safe movement of a motor vehicle' on an interstate highway 'with the intent to obstruct the free, convenient, and normal use of the interstate highway.' The new federal offense would be punishable by up to $10,000 and 15 years in prison—a far harsher penalty than is the case under many states' laws, which generally already criminalize walking or standing on the highway. The bill provides an exception for 'any lawful activity' authorized by federal, state, or local law. However, it could still seemingly cover far more than 'blocking' the interstate, including a #PeacefulProtest on the shoulder of an interstate or a convoy-style, driving protest that slowed traffic. The sponsor of the bill made clear that it was in response to protesters. The same bill was introduced as HR 7349 in 2024.

"'For generations and through modern day, Tribal members have used Ha’Kamwe’ (also known as Cofer Hot Spring) for cultural and traditional purposes. It features prominently in tribal songs and stories about their history and connection to their land, including those known as the #SaltSongTrail,' the Hualapai Tribe said in its lawsuit filed against the U.S. Interior.
"Hualapai filed suit against Interior's #DebHalaand. The CEO of the so-called #NavajoTransitionalEnergyCompany, a tribal enterprise based in Farmington, New Mexico, was hired by an Australian company, #Hawkstone, aka #ArizonaLithium, to drill into Hualapai's sacred site for lithium.
"While sipping wine at the Sydney Opera House, #investors heard how much money they can make mining lithium in Arizona. The enthusiastic project manager was excited to tell them that Arizona loves mining, as can be seen with all its #CopperMines.
"'They are a mining friendly state,' says Paul Lloyd, managing director at Arizona Lithium, owned by #HawkstoneEnergy, in Perth, Australia. 'They are very pro-lithium production.'
"Federal judge #DianeHumetewa Hopi, granted a temporary restraining order. Humetewa is the first federal judge in Arizona to halt #Haaland's runaway train of permits for destruction.
"Hualapai's lawsuit said the Interior's #BureauOfLandManagement, BLM, never consulted Hualapai before authorizing #drilling."

Sept. 11, 2024WASHINGTON – "A coalition of #WesternApaches, other #Native peoples, and non-Native #allies asked the #SupremeCourt today to protect their sacred site at #OakFlat from destruction by a multinational mining giant. In Apache Stronghold v. United States, the Ninth Circuit Court of Appeals refused to stop the federal government from transferring Oak Flat to #ResolutionCopper, a foreign-owned mining company that plans to turn the site into a massive mining crater, ending #Apache religious practices forever (Watch video linked below to learn more).
"The Apaches and their allies hosted a day of prayer outside the Court as they asked the Justices to save the spiritual lifeblood of their people.
Since time immemorial, Western Apaches and other Native peoples have gathered at Oak Flat, outside of present-day Superior, Arizona, for sacred religious ceremonies that cannot take place anywhere else. Known in Apache as Chi’chil Biłdagoteel, Oak Flat is listed in the National Register of Historic Places and has been protected from mining and other harmful practices for decades. These protections were targeted in December 2014 when a last-minute provision was inserted into a must- pass defense bill authorizing the transfer of Oak Flat to the Resolution Copper company. Resolution Copper is a foreign-owned mining company that plans to turn the sacred site into a two-mile-wide and 1,100-foot-deep crater. The majority owner of Resolution Copper, #RioTinto, sparked international outrage when it deliberately destroyed 46,000-year-old #Indigenous rock shelters at one of #Australia’s most significant cultural sites.“'Oak Flat is our Mt. Sinai—the most sacred place where generations of Apache have come to connect with our Creator, our faith, and our land,' said Dr. Wendsler Nosie Sr. of Apache Stronghold. 'We pray the Justices will protect Oak Flat and ensure that our place of worship is not treated differently simply because it lacks four walls and a steeple.”
Apache Stronghold—a coalition of Apaches, other Native peoples, and non-Native allies—filed this lawsuit in January 2021 seeking to halt the proposed mine at Oak Flat. The mine is opposed by 21 of 22 federally recognized tribal nations in Arizona and by the National Congress of American Indians. Meanwhile, national polling indicates that 74% of Americans support protecting Oak Flat. The Ninth Circuit ruled earlier this year that the land transfer is not subject to federal laws protecting religious freedom. But five judges dissented, writing that the court 'tragically err[ed]' by refusing to protect Oak Flat. After unsuccessfully asking all 29 judges on the Ninth Circuit to rehear the case, Apache Stronghold has filed their appeal to the Supreme Court."'Blasting the birthplace of Apache religion into oblivion would be an egregious violation of our nation’s promise of religious freedom for people of all faiths,' said Luke Goodrich, vice president and senior counsel at Becket. 'The Court should uphold its strong record of defending #ReligiousFreedom by ensuring that the Apaches can continue worshiping at Oak Flat as they have for centuries.'

"We received the response from the 9th Circuit Court of Appeals. Our request to be heard by the full 29-judge panel was denied, none of the judges requesting a vote for rehearing. The Court amended its decision to discuss a previous Supreme Court decision that hadn’t been considered, and the 9th Circuit’s decision on the case remained closely divided, 6 to 5, with five dissenting judges and over 240 pages of opinions. We have now completed the 9th Circuit appeal, and the next step is petitioning to be heard by the Supreme Court. I want to thank everyone for your endless support and prayers. I know capitalism had began as far back as when trade began. For over 500 hundred years, we #IndigenousPeople of America, have suffered equally to the rest of the world. What had started in the beginning between good and evil will again face each other. One, to protect the greatest gift god gave the world or the other.,to destroy every human life and the spirit that #MotherEarth gives birth to. The question is, where will you stand in this moment? Chi'chil Biłdagoteel (#OakFlat) is a sacred site in the Tonto National Forest for the #SanCarlosApache and other Native American Tribes in the region—a place to pray, collect water and medicinal plants, gather acorns, honor the people who are buried there, and perform sacred religious ceremonies. Oak Flat is listed on the National Register of Historic Places as a Traditional Cultural Property and protected from mining since 1955 by President Eisenhower."#Resolution’s underground mine would cause Oak Flat to collapse into a mile-wide, 1,000-foot-deep crater. In 2014, the US government promised the land to foreign copper mining interests to build a copper mine. The #ResolutionCopper Project would create one of the largest copper mines in the US destroying this sacred site.
