The April 5th "Hands Off" rallies were great but the admin is rapidly dismantling every Constitutional protection we have. Kinda of ironic that a county founded on the principle that you can't lock someone up and throw away the key is doing just that.

    Would love to know if folks are gathering on street corners again as they did on April 5.

The law expands existing provisions related to trespass and property damage to broadly include the property of all companies in the oil and gas industry. Under the law, trespass onto the property of any "company that operates a #gas, #oil, petroleum, refined #petroleum product, renewable fuel, water, or chemical generation, storage, transportation, or delivery system" is a Class H felony, punishable by six years in prison and a fine of $10,000. Accordingly, protests in a range of locations may be covered, whether on land containing a pipeline or the corporate headquarters of an oil company.     Would broadly define "riot" under Wisconsin law and create #vague new felony offenses as well as expansive civil liability that could cover #PeacefulProtest activity. The bill defines a “riot” as a “public disturbance” involving an act of violence or the threat of violence by someone in a gathering of 3 or more people. No actual damage or injury need take place for a gathering to become a “riot,” only a “clear and present danger” of damage or injury. As such, a large street protest where a single participant threatens to push somebody could be deemed a "riot," with no actual violence or property damage being committed by anyone. United States, the Ninth Circuit Court of Appeals refused to stop the federal government from transferring Oak Flat to #ResolutionCopper, a foreign-owned mining company that plans to turn the site into a massive mining crater, ending #Apache religious practices forever (Watch video linked below to learn more).

    "The Apaches and their allies hosted a day of prayer outside the Court as they asked the Justices to save the spiritual lifeblood of their people.
    Since time immemorial, Western Apaches and other Native peoples have gathered at Oak Flat, outside of present-day Superior, Arizona, for sacred religious ceremonies that cannot take place anywhere else. Known in Apache as Chi’chil Biłdagoteel, Oak Flat is listed in the National Register of Historic Places and has been protected from mining and other harmful practices for decades. These protections were targeted in December 2014 when a last-minute provision was inserted into a must- pass defense bill authorizing the transfer of Oak Flat to the Resolution Copper company. Resolution Copper is a foreign-owned mining company that plans to turn the sacred site into a two-mile-wide and 1,100-foot-deep crater. The majority owner of Resolution Copper, #RioTinto, sparked international outrage when it deliberately destroyed 46,000-year-old #Indigenous rock shelters at one of #Australia’s most significant cultural sites.

    “'Oak Flat is our Mt. Sinai—the most sacred place where generations of Apache have come to connect with our Creator, our faith, and our land,' said Dr. Wendsler Nosie Sr. of Apache Stronghold. 'We pray the Justices will protect Oak Flat and ensure that our place of worship is not treated differently simply because it lacks four walls and a steeple.”
    Apache Stronghold—a coalition of Apaches, other Native peoples, and non-Native allies—filed this lawsuit in January 2021 seeking to halt the proposed mine at Oak Flat. The mine is opposed by 21 of 22 federally recognized tribal nations in Arizona and by the National Congress of American Indians. Meanwhile, national polling indicates that 74% of Americans support protecting Oak Flat. The Ninth Circuit ruled earlier this year that the land transfer is not subject to federal laws protecting religious freedom. But five judges dissented, writing that the court 'tragically err[ed]' by refusing to protect Oak Flat. After unsuccessfully asking all 29 judges on the Ninth Circuit to rehear the case, Apache Stronghold has filed their appeal to the Supreme Court.

    "'Blasting the birthplace of Apache religion into oblivion would be an egregious violation of our nation’s promise of religious freedom for people of all faiths,' said Luke Goodrich, vice president and senior counsel at Becket.     Chi'chil Biłdagoteel (#OakFlat) is a sacred site in the Tonto National Forest for the #SanCarlosApache and other Native American Tribes in the region—a place to pray, collect water and medicinal plants, gather acorns, honor the people who are buried there, and perform sacred religious ceremonies. Oak Flat is listed on the National Register of Historic Places as a Traditional Cultural Property and protected from mining since 1955 by President Eisenhower.

In 2014, the US government promised the land to foreign copper mining interests to build a copper mine.     "Apache Stronghold visited Peehee Mu’huh (#ThackerPass), the second stop on the Prayer Journey to the Supreme Court [#SCOTUS] to Stop the Shattering of Human Existence and Protect #MotherEarth.

    "We visited with the People of #RedMountain, who are fighting a #LithiumMine that is destroying their #SacredSite. When we arrived at the entrance to Peehee Mu’huh, we found a chain link wall with a locked gate, blocking everyone except those authorized by the mine.

    "Security trucks came to go through the gate, and one of the drivers admitted that they knew the Apache Stronghold would be there with the People of Red Mountain.

    "One truck drove off toward the mine, while the other driver re-locked the gate and left, emphasizing that the mining company has access to Peehee Mu’huh, but the Indigenous people who were stewards of the land since time immemorial, and all others who would go there to pray, are locked out.

    "Dr. Wendsler Nosie Sr. said, 'It’s a sad reminder that people don’t know the day could come, if #OakFlat is ever transferred to #ResolutionCopper, that the acorns, #MedicinePlants, and water could be locked away behind a gate facing death at the hands of a corporation.

    "In #Thailand, an agricultural company files more than a dozen suits against at least 20 #defendants, targeting #workers, #journalists, and #activists who had spoken out against alleged #LaborAbuses at the company’s chicken farm. In #India, an association of #pesticide manufacturers brings a civil defamation suit against #journalists that had reported on the harmful #health and #environmental effects of pesticide use. In the #Philippines, a #mining company files suit against 85 defendants who had conducted a #PeacefulProtest near the company’s mining site, after the company’s own security forces used #lethal violence against the #protesters. In #SouthAfrica, an #Australian mining company files suit against environmental activists who had criticized a company mine during a lecture at a local university.

    What do these suits have in common? They are all “#SLAPPs,” or “Strategic Lawsuits Against Public Participation”: suits filed not to secure relief, but to use the risks and costs of litigation to defuse criticism and opposition and discourage the exercise of fundamental freedoms. SLAPPs have long been prevalent in the #Globa North, but SLAPPs are also being used in the Global South to silence activism.

    "In Protecting Activists from Abusive Litigation: SLAPPs in the Global South and How to Respond, ICNL presents the first cross-regional survey of SLAPPs in the Global South, along with the first rigorous comparative analysis of anti-SLAPP policy responses undertaken in the Global North and the Global South. Our survey shows that SLAPPs pose a serious threat to the exercise of fundamental freedoms in the Global South, particularly for activists, civil society organizations, journalists, and community members who dare to criticize powerful entities.

    "Our survey, which is far from comprehensive, has identified 82 reported SLAPPs filed in Thailand, India, the Philippines, and South Africa – the most fertile fields for Southern SLAPPs – as well as #Indonesia, #Malaysia, #Armenia, #SierraLeone, and #Honduras. Key features of SLAPPs in our sample include:

    - Half of the cases in our sample (41 cases) involved criminal proceedings.
    - The most frequent SLAPP targets in our sample were activists and civil society organizations (CSOs) (38 cases, or 46%); journalists and publishers (17 cases, or 21%); and leaders and members of local communities (15 cases, or 18%).
    - Nearly all of the cases in our sample – 75 cases, or 91% – were brought by private companies or company officials, with 34 of these cases (41%) brought by mining companies and 28 cases (34%) brought by companies associated with agricultural operations.

    "Where the cause of action or charge was reported, the suit was based at least in part on a defamation charge, either civil or criminal, in 66 of 75 cases (88%).

    "Of the 33 suits in our sample brought as civil actions, claims in 17 cases (52%) exceeded 1 million USD, with the average claim exceeding 10 million USD."
