THACKER PASS, #Nevada -- "While descendants of the survivors of the massacre of #Paiutes at Peehee Mu'huh struggled to protect the sacred remains from the digging of a #LithiumMine, owned by Lithium Americas on Canada -- law enforcement had a spider web of surveillance.

"The law enforcement surveillance of defenders of Peehee Mu'huh, Thacker Pass, began before #MyronDewey was killed, and continued afterwards.

"ProPublica and Nevada Independent expose the spy trail of law enforcement and private security of Lithium Americas. The surveillance web of 10 agencies included the #BIA, and a #CounterTerrorism task force.

"During a meeting in April of 2021, the sheriff met with a spinmaster who linked the resistance to #StandingRock. This was six months before Myron Dewey was killed when a truck driven by a mining
engineer hit Myron head on.

"Myron was well known for his #reporting and #drone coverage at Standing Rock 2016--2017. Myron was livestreaming the day before he was killed near his home in #YombaNevada, Sept. 26, 2021. Myron was fighting the U.S. military's expansion of the bombing range on his #Paiute homeland. The Nevada legislators were pushing hard for the expansion, which Biden signed into law. Myron had also been delivering supplies to Thacker Pass in the months before he was killed."

"Nevada is home to the only existing lithium mine in the US. Another is currently under construction near the Oregon line 220 miles (354km) north of Reno. That #LithiumAmericas mine at #ThackerPass, which was approved in the final days of Donald #Trump’s administration, survived numerous legal challenges from #environmentalists and #NativeAmerican tribes who said it would destroy lands they considered sacred where their ancestors were massacred by US troops in 1865."

"'Water is life!' Hualapai said as they marched to protect their sacred ceremonial place, Ha'Kamwe' from a lithium mine.

"'For generations and through modern day, Tribal members have used Ha’Kamwe’ (also known as Cofer Hot Spring) for cultural and traditional purposes. It features prominently in tribal songs and stories about their history and connection to their land, including those known as the #SaltSongTrail,' the Hualapai Tribe said in its lawsuit filed against the U.S. Interior.

"Hualapai filed suit against Interior's #DebHalaand. The CEO of the so-called #NavajoTransitionalEnergyCompany, a tribal enterprise based in Farmington, New Mexico, was hired by an Australian company, #Hawkstone, aka #ArizonaLithium, to drill into Hualapai's sacred site for lithium.

"While sipping wine at the Sydney Opera House, #investors heard how much money they can make mining lithium in Arizona. The enthusiastic project manager was excited to tell them that Arizona loves mining, as can be seen with all its #CopperMines.

"'They are a mining friendly state,' says Paul Lloyd, managing director at Arizona Lithium, owned by #HawkstoneEnergy, in Perth, Australia. 'They are very pro-lithium production.'

"Federal judge #DianeHumetewa Hopi, granted a temporary restraining order. Humetewa is the first federal judge in Arizona to halt #Haaland's runaway train of permits for destruction.

"Hualapai's lawsuit said the Interior's #BureauOfLandManagement, BLM, never consulted Hualapai before authorizing #drilling."

[#Maine] State Lawmakers consider new mining rules that could open door to #LithiumMining

"Some #environmental groups say the rules that would allow for open pit mineral mining provide ample safeguards, but others demand more preliminary testing, smaller pit size limits, stronger reclamation standards and #DarkSkies protections.

"But Eliza Townsend, the [the Appalachian Mountain Club's] conservation policy director, argued that an open pit mine is never going to be anything more than a glorified 'hole in the ground.' Allowing a pit to grow in size would tarnish the unspoiled natural beauty that draws hikers to Maine, especially when the pit is dug into a mountaintop.

"Environmental critics asked lawmakers to require an open-pit mining applicant to use so-called dark sky lighting to minimize the impact on wildlife, neighbors and hikers camping near the #Newry lithium site, including those that use the #GraftonNotch loop trail.

"Some Republicans wanted the committee to approve the rules Monday, arguing the state Legislature had already voted for a mineral mining exemption last year when it voted to amend the mining law and order the drafting of new rules.

"Democrats, however, appeared stung by criticism from environmental advocates who said the committee was considering rules that would open the door to #OpenPit #mining at the same time the legislative calendar had said it would be working on another bill to strengthen the state’s mining law."

#Nevada rancher cites ‘shroud of #secrecy’ at #LithiumMine

RENO — “A Nevada rancher suing to block construction of the largest lithium mine in the U.S. says the government’s #environmental assessment of the project relies on a baseline set by a consultant for the #mining company with a conflict of interest that trivializes potential harm to water resources and #wildlife near the #Oregon line.

“Bartell Ranch LLC wants a U.S. judge to order the Bureau of Land Management to provide documents, contracts and internal communications with all third-party consultants the agency used to reach its conclusion that #LithiumNevada Corp.’s mine won’t affect threatened species or significant scientific, cultural or historic resources.

“The ranch filed a lawsuit in February challenging plans for the #ThackerPass mine it says would rob the ranch of its precious water rights.

“The case has been consolidated with lawsuits subsequently filed in U.S. District Court in Reno by conservation groups and tribes alleging the mine would destroy critical #SageGrouse habitat and damage sacred tribal lands that were the site of a massacre in the 1860s.

“The bureau hired its own independent consultant, ICF International Inc., to prepare the scientific foundation for a 2,700-page environmental impact statement required under the National Environmental Policy Act.

“‘But it includes 1,300 pages of studies on groundwater pumping that established the models and baseline created by Tyler Cluff, a hydrogeologist in Reno for Canada-based Piteau Associates, according to the motion the ranch’s lawyers filed last week.

“They say Cluff currently is serving as an expert for Lithium Nevada in a separate water right protest proceeding in which he’s relying on much of the same data and work he did for the mine’s final environmental impact statement.

“’This unusual relationship between a third-party contractor for the NEPA analysis, Piteau, and LNC suggests that Piteau was not working for BLM on the FEIS in a neutral and independent capacity, but rather, was working directly for #LNC,' the motion states.

“Piteau didn’t respond to emails and phone messages seeking comment.

“The ranch’s lawyers say they’re seeking an order to obtain the documents because the bureau and Piteau have refused their requests to collect data at Piteau’s test wells and monitoring locations or turn over field data. They say it’s created a 'shroud of secrecy' over the basis for the mine’s approval.

“'The entirety of the water resources analysis appears to have been entrusted to Piteau Associates, who appears to have worked mostly, if not exclusively, at the direction of LNC,' the motion said. It said the bureau didn’t verify Piteau’s field work and 'simply assumed it was reliable.'

“Bartell’s own hydrogeologist strongly disputes the baseline water quantity and quality, and forage conditions.

“'Piteau could have inputted faulty data into the models to generate a particular baseline and model outcomes to benefit their employer LNC,' it said. 'BLM’s decision to trust the NEPA process to parties like Piteau who may have a financial stake in the approval of the (mine) raises the specter of bad faith.'

“The new filing seeks to add the field studies and samples to the court’s administrative record, which currently contains Piteau’s final reports and analysis 'but excludes nearly all drafts and communications from Piteau.'

“'The environmental baseline is so insufficient that actual baseline conditions are hidden.'

“The bureau has until Nov. 5 to respond to the latest filing.

“A Justice Department lawyer representing the agency said in an email to the ranch’s lawyer last month the bureau wasn’t provided any field reports and 'relied on those contractors’ baseline reports, which are included in the EIS.'

“'BLM has the expectation that contractors with appropriately credentialed staff will provide accurate data and conclusions in a professional manner,' Leilani Doktor wrote in the email attached as an exhibit to the ranch’s motion.

“Lithium Nevada said in its latest filing last week that 'BLM fully analyzed and ensured compliance with water quality standards and appropriately adopted adaptive management.' It said earlier that the bureau conducted a comprehensive review based on its 'experience and expertise,' public comment and 'extensive data collected ... over years in coordination with state and federal environmental agencies.'

“Doktor said the bureau considers the documents sought by the ranch 'internal and deliberative' material exempt from the administrative record. Third-party contracts are exempt because they 'are not materials considered during the decision-making process.'
