I'm not convinced it's primarily a legal issue: to this day, if you're a self-hosted user of #HashiCorp #FreeSoftware, you have no way to throw money at HashiCorp even if you want to.

Same with the #linkerd fiasco (github.com/cncf/toc/issues/126): did Buoyant ever ask help from #CNCF or anyone before cutting off the supposed free-riders?

  5. A quotation from Marcus Aurelius

The gods either have power or they have not. If they have not, why pray to them? If they have, then instead of praying to be granted or spared such-and-such a thing, why not rather pray to be delivered from dreading it, or lusting for it, or grieving over it? Clearly, if they can help a man at all, they can help him in this way.

  14. A quotation from Cicero

Do you think that what I say each day on such a variety of topics could come to me if I did not cultivate my mind with learning, or that my mind could bear such a strain if I did not relax it by this same learning?
Indeed I confess that I have devoted myself to these interests. Let others be ashamed who have so buried themselves in books that they can offer nothing for the common enjoyment and can bring nothing forward into the light and the sight of men; but, gentlemen of the jury, why should I be ashamed, I who have lived so long in such a way that leisurely interests have never lured me nor pleasure called me nor sleep kept me from timely service to anyone?
Who, I ask, can censure me on this account, who can rightfully be angry at me, if I take as much time for the pursuit of these studies as is granted others to attend to their interests, to celebrate the festive days of the games, as much time as they devote to other pleasures and the relaxation of mind and body, as much time as others give to early-opening banquets, or even to throwing dice and playing ball?

  15. Capitolo 55

AGOSTO 2008: dal 28 luglio al 3 agosto.

Film visti per la prima volta: Accadde una notte, Dante 01, Grace is gone, The love guru

Film rivisti: About a boy, Carlito’s way

  16. Good Morning!!

    Celebrating freedom on Juneteenth

Today is Juneteenth, so I’ll begin with some writing about the holiday that celebrates freedom from slavery.

The Los Angeles Times Editorial Board: Editorial: Juneteenth isn’t a holiday just for Black people. Everyone should celebrate freedom.

Juneteenth is no more a holiday just for Black people than the Fourth of July is a holiday just for white people. It recognizes and celebrates a profound milestone in American history — the declaration of freedom for an entire race of American people who had been held in bondage for centuries.

Although the day itself, June 19, 1865, was far less life-changing than it should have been.

Juneteenth commemorates the arrival of Union Army Major Gen. Gordon Granger in Galveston, Texas, with General Order No. 3 telling the people of the westernmost Confederate state that “all slaves are free.” Although the Emancipation Proclamation had taken effect in 1863, it couldn’t be implemented until the Civil War ended and Confederate states surrendered.

Confederate Gen. Robert E. Lee surrendered his troops to Union Gen. Ulysses S. Grant in April 1865 in Virginia, but other Confederate troops further south and west continued fighting, surrendering only in the months afterward. The 13th Amendment abolishing slavery would be ratified in December 1865.

Enslaved people in Texas were the last ones in the Confederacy to find out they were freed. But the news didn’t filter across the state immediately. And some slave owners didn’t obey the order right away, waiting to see who would enforce it.

Texas may have been the last Confederate state to get word of emancipation, but in 1980 it became the first U.S. state to make it an official holiday.

Juneteenth is now a federal holiday. It’s also recognized as a state holiday in more than 25 states and the District of Columbia.

    A bit more:

The 1865 announcement of freedom didn’t end systemic racism and its discriminatory effects in housing, employment and education. It didn’t stop the violence Black people faced day after day, and still do. Black people make up 13% of the U.S. population but account for 37% of the prison and jail population. Similarly, Black people are 37% of the homeless population nationwide….

But there are reasons to celebrate this holiday. Juneteenth is about honoring fortitude, perseverance and, yes, optimism. Those are traits Americans have always had. And they are traits Black Americans have demonstrated in abundance for centuries — otherwise, no Black people would have survived here. And Black communities have held celebrations big and small for Juneteenth since 1866.

Consider Opal Lee. The former teacher is often called “the grandmother of Juneteenth” for her decades of activism to get it designated a federal holiday. When she was a young girl, a mob of white supremacists attacked her Texas home and burned the furniture on Juneteeth in 1939.

In 2016, a month before she turned 90, Lee set off on a four-month walk from her hometown of Fort Worth to Washington, D.C., to publicize her cause. In 2021, Congress with overwhelming bipartisan support passed a bill making Juneteenth a federal holiday, and President Biden signed it into law.

Last month, at 97, Lee stepped across the floor at a White House ceremony to be embraced by Biden as he placed the Medal of Freedom, the nation’s highest civilian honor, around her neck.

The Guardian: As Juneteenth grows in US, southern states cling to Confederate holidays.

Juneteenth has been recognized as a US federal holiday since 2021 and acts as a day to celebrate the end of slavery in the country – but millions of Americans will not have the day off today, 19 June, to mark the occasion.

At least 30 states – including most recently Rhode Island and Kentucky – and the District of Columbia recognize Juneteenth as an official public holiday, according to the Pew Research Center.

Portrait of Opal Lee by Sedrick Huckaby

Yet as the number of states to legally declare Juneteenth a holiday rises, other states continue to cling to holidays that honor the Confederacy.

Ten states – all in the American south – have at least one day commemorating the Confederacy, according to Axios, and six former Confederate states do not officially recognize Juneteenth: Florida, Mississippi, Alabama, Arkansas, South Carolina and North Carolina.

Mississippi and Alabama each celebrate three Confederate holidays – paid holidays for state employees: Confederate Memorial Day; the birthday of Jefferson Davis, the leader of the Confederacy; and Robert E Lee Day, to commemorate the leader of the Confederate army. In both states, Robert E Lee Day is also used to celebrate Martin Luther King Jr Day.

In Alabama, the Republican governor, Kay Ivey, has authorized this year’s Juneteenth as a state holiday for a fourth year, amid faltering legislative efforts to make it a permanent holiday.

A bill proposed earlier this year would have added Juneteenth as a permanent holiday in the state, but state employees would have been allowed to choose between taking that day or Jefferson Davis’s birthday off from work. The Alabama house of representatives approved the bill, but it did not get a vote in the state senate.

    Read more at The Guardian.

At MSNBC, Hayes Brown has a think piece about why the Juneteenth holiday is just another sop to Black Americans instead of the government working to advance real equality: The vibes are very off this Juneteenth.

It’s Juneteenth 2022 and I am uncomfortable on a New York City beach. It’s not that the sun is too hot, which it isn’t, or that the water is too cold, though it is. The discomfort I feel comes from looking around the crowded sands and realizing how few faces look like mine on what’s meant to be a day celebrating us.

When President Joe Biden signed a bill declaring Juneteenth a federal holiday in 2021, it was one of the few tangible changes that was put into place after a wave of protests for racial justice that had rocked the country the previous year. In theory, the holiday recognized a turning point in America’s history as the last slaves learned of their freedom. But as I sat on that beach, I couldn’t help but wonder: “Who is this really for?”

    Juneteenth, by Kalunda Janae Hilton

Texas first made Juneteenth an official holiday in 1980. After decades as a more regional celebration, the holiday quickly gained awareness nationally over the last decade, especially after it was featured on the ABC sitcom “black-ish” in 2017. But it was the civil rights protests of 2020 that truly propelled it into the mainstream, as millions took to the streets to demand an end to police brutality against Black Americans following the death of George Floyd in Minnesota and Breonna Taylor in Kentucky. Lawmakers seized on boosting Juneteenth as a way to show that those millions of voices weren’t being totally ignored….

But it’s seeming more and more like this was a gilded token. Hopes of federal police reform were dashed when Republicans realized they could hammer Democrats for being in favor of “defunding the police.” Support for Black Lives Matter has plummeted since 2020, with only a narrow majority backing the movement compared to the two-thirds support that was once there.

And when you look at who is getting to enjoy the newly established holiday, it’s clear that the benefit is not evenly distributed. Consulting firm Mercer found that the share of private employers that made Juneteenth a paid holiday surged from 9% in 2021 to 39% in 2023.

We then must consider that roughly a quarter of Black households in America are earning less than $25,000 per year, according to U.S. Census Bureau data. That puts then in the bottom 10% of earners, according to the Bureau of Labor Statistics. A Center for American Progress analysis of BLS data shows that among the lowest 10% of earners, 47% have no access to any form of paid time off, a number that falls to 38% when looking at part-time workers. Taken together, that means there’s a major chunk of the Black population that’s likely getting no benefit at all from Juneteenth.

Read the rest at the MSNBC link above.

Judge Aileen Cannon is back in the news, as she prepares to hear arguments on why the Trump stolen documents case should be dismissed. On of those arguments is that Special Counsel Jack Smith was illegally appointed. Yes, that’s a ridiculous notion that has already been adjudicated and rejected.

ABC News: Judge in Trump classified documents case to hear validity of special counsel’s appointment, gag order request.

The judge overseeing former President Donald Trump’s classified documents case will kick off a series of hearings this week on motions to dismiss the case. One of the hearings is expected to focus on a legal theory pushed by conservative legal critics of special counsel Jack Smith that seeks to invalidate his appointment.

Judge Aileen Cannon’s court calendar related to this case has become increasingly logjammed in recent months – as she has scheduled hearings on legal maneuvers by Trump and his co-defendants that other judges would not typically entertain.

Legal experts have raised questions over whether her decisions are simply a product of inexperience or in some instances show outright favoritism towards Trump — who appointed Cannon to the bench in 2020.

Judge Cannon, for example, has set aside all of Friday for a hearing on Trump’s motion arguing that Smith’s appointment was unlawful – an issue other courts have largely rejected.

On Monday, Cannon will kick off her court schedule with another hearing related to Smith’s appointment – a motion brought by Trump challenging the funding of the special counsel’s office. The same day, Cannon will hear arguments over Smith’s request for a gag order limiting Trump’s rhetoric about law enforcement involved in the search of Mar-a-Lago in August 2022.

Next Tuesday, she is scheduled to consider Trump’s request to throw out evidence gathered during that search as well as testimony provided by Evan Corcoran, his former lead attorney who Smith has alleged Trump misled as part of his efforts to obstruct the government’s investigation.

Ellie Quinlan Houghtaling at The New Republic, via Yahoo News: Judge Aileen Cannon Confusingly Does Jack Smith a Massive Favor.

Judge Aileen Cannon appears to be sick and tired of nonparties attempting to intervene in Donald Trump’s classified documents trial—even though she’s the one who allowed them to do so in the first place.

    Aileen Cannon and Jack Smith

The Trump-appointed judge issued a paperless order Monday, rejecting without explanation a couple dozen Republican attorneys general and their proposed brief opposing special counsel Jack Smith’s pending gag order on the former president, which they decried as “presumptively unconstitutional.”

Attorneys general representing the states of Alabama, Alaska, Arkansas, Florida, Idaho, Iowa, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, and Wyoming had all signed on to the amicus curiae. In it, they argued that the tabled gag was an affront to the First Amendment rights of everyday Americans, who have a right to hear Trump push back against legal prosecutors.

The fierce opposition arose after Smith argued for a change in Trump’s bond conditions, claiming that the presumptive Republican presidential nominee’s Truth Social posts were “grossly misleading” and “inflammatory.” Smith argued Trump’s posts put law enforcement and potential trial witnesses in legitimate danger.

“Those statements create a grossly misleading impression about the intentions and conduct of federal law enforcement agents—falsely suggesting that they were complicit in a plot to assassinate him—and expose those agents, some of whom will be witnesses at trial, to the risk of threats, violence, and harassment,” Smith said in May.

As noted above, she will still hear arguments from outsiders, just not from a bunch of right wing attorney generals.

At The Washington Post, Ruth Marcus has and opinion piece about Judge Cannon: Judge Aileen Cannon: What will she think of next?

From the start of the investigation into Donald Trump’s mishandling of classified documents, U.S. District Judge Aileen M. Cannon has seemed inclined to act in favor of the president who appointed her. Now, Cannon might be poised to issue her most audacious ruling yet, on Trump’s far-fetched bid to have the indictment dismissed on the grounds that special counsel Jack Smith’s appointment is constitutionally invalid.

This is the kind of Hail Mary motion that should have been dispatched quickly after Trump’s lawyers filed it in February. But that’s not the Cannon way. Instead — four months later, and more than a year after Trump was indicted — she is holding a day and a half of oral argument on the issue. She will be hearing not only from Trump and prosecutors but, unusually, also from outside parties contending for and against the legitimacy of the special counsel.

Perhaps, in the end, Cannon won’t take the plunge and kill the case. (Such a ruling shouldn’t jeopardize the election interference case pending in Washington.) But at this point, after months of vacillating between slow-walking the case and issuing rulings favorable to Trump, Cannon can’t be underestimated.

The essence of Trump’s claim — backed by, among others, former attorneys general Edwin Meese III and Michael Mukasey — is that Smith’s naming as special counsel violates the Constitution’s appointments clause. That provision requires that “Officers of the United States” be nominated by the president and confirmed by the Senate. But the appointments clause allows Congress to give the “Heads of Departments” — in this case the attorney general — authority to appoint “inferior officers.”

“The Appointments Clause does not permit the Attorney General to appoint, without Senate confirmation, a private citizen and like-minded political ally to wield the prosecutorial power of the United States,” they write. “As such, Jack Smith lacks the authority to prosecute this action.”

Smith “wields extraordinary power, yet effectively answers to no one,” says the brief filed on behalf of Meese and Mukasey. “He has no more authority to represent the United States in this Court than Tom Brady, Lionel Messi, or Kanye West.”

It’s true that the Supreme Court has bolstered the reach of the appointments clause in recent years. Still, the problem with the anti-Smith argument is threefold: text, history and precedent.

First, the law empowers the attorney general to make such appointments. For example, 28 U.S.C. §533 authorizes the attorney general to “appoint officials … to detect and prosecute crimes against the United States.” Likewise, 28 U.S.C. §515 provides that “any attorney specially appointed by the Attorney General under law, may, when specifically directed by the Attorney General, conduct any kind of legal proceeding, civil or criminal … which United States attorneys are authorized by law to conduct.”

And by the way, under the special-counsel regulations, Smith is bound to follow Justice Department rules and is subject to being overruled, or even removed for cause, by the attorney general.

Yesterday, Vladimir Putin traveled to North Korea to meet with Kim Jong Un. The two dictators agreed to help each other militarily. The New York Times: Putin and Kim Sign Pact Pledging Mutual Support Against ‘Aggression.’

President Vladimir V. Putin of Russia and North Korea’s leader, Kim Jong-un, revived a Cold War-era mutual defense pledge between their nations on Wednesday, signing a new agreement that calls for them to assist each other in the event of “aggression” against either country.

The Russian president, in a briefing after the two leaders signed the document, did not clarify whether such assistance would require immediate and full-fledged military intervention in the event of an attack, as the now-defunct 1961 treaty specified. But he said that Russia “does not exclude the development of military-technical cooperation” with North Korea in accordance with the new agreement.

The pact was one of the most visible rewards Mr. Kim has extracted from Moscow in return for the dozens of ballistic missiles and over 11,000 shipping containers of munitions that Washington has said North Korea has provided in recent months to help support Mr. Putin’s war in Ukraine.

It also represented the farthest the Kremlin has gone in throwing its weight behind North Korea, after years of cooperating with the United States at the United Nations in curbing Pyongyang’s nuclear and missile program — a change that accelerated after Russia’s invasion of Ukraine.

“This is a truly breakthrough document, reflecting the desire of the two countries not to rest on their laurels, but to raise our relations to a new qualitative level,” Mr. Putin added. Neither North Korea nor Russia immediately released the text of the new agreement.

Mr. Putin denounced the United States for expanding military infrastructure in the region and holding drills with South Korea and Japan. He rejected what he called attempts to blame the deteriorating security situation on North Korea, which has carried out six nuclear test explosions since 2006 and tested intercontinental ballistic missiles that could reach the United States.

“Pyongyang has the right to take reasonable measures to strengthen its own defense capability, ensure national security and protect sovereignty,” Mr. Putin said.

Mr. Kim called the pact a “most powerful agreement” and praised the “outstanding foresight” of Mr. Putin, “the dearest friend of the Korean people,” the state-owned Russian news agency RIA Novosti said.

I wonder if they also discussed ways to help put Trump back in the White House, where he would certainly withdraw the U.S. from NATO.

CNN: Putin says Russia and North Korea will help each other if attacked, taking ties to a ‘new level.’

Vladimir Putin said Russia and North Korea have ramped up ties to a “new level,” pledging to help each other if either nation is attacked in a “breakthrough” new partnership announced during the Russian president’s rare visit to the reclusive state.

Thousands of North Koreans chanting “welcome Putin” lined the city’s wide boulevards brandishing Russian and North Korean flags and bouquets of flowers, as Putin kicked off his first visit to North Korea in 24 years with a finely choreographed display of influence in the dictatorship.

The pair then signed the new strategic partnership to replace previous deals signed in 1961, 2000 and 2001, according to Russian state news agency TASS. “The comprehensive partnership agreement signed today includes, among other things, the provision of mutual assistance in the event of aggression against one of the parties to this agreement,” Putin said after the meeting.

He said the deal encompasses the “political, trade, investment, cultural spheres, and the security sphere as well,” calling the pact “truly a breakthrough document.”

Putin said joint drills involving the United States, South Korea and Japan were “hostile” toward North Korea,” characterizing the US policy as “confrontational.” Kim, meanwhile, called the new “alliance” a “watershed moment in the development of the bilateral relations.”

But the deal between the two autocrats raised many questions, too – including whether Russia’s nuclear deterrent now extends to North Korea, and vice versa, or whether the two nations will now hold joint military drills….

Putin was met with exuberant celebrations at a welcome ceremony with his counterpart at Kim Il Sung Square in the heart of the North Korean capital, where mounted soldiers, military personnel and children holding balloons cheered against the backdrop of large portraits of the each leader.

The two leaders presented their respective officials and stood together as the Russian national anthem played before riding off standing shoulder to shoulder in an open-top limousine as they smiled and waved to the crowds.

I am seeking employment as an #administrative #professional (#administrativeAssistant, #executiveAssistant, basically, #administrativeSupport). I was on a #contract with a #BigTech company, and the program I was supporting is sundowning, so about two-thirds of us were let go at the end of the fiscal year.

I’ve been applying to many places, some of which turned out to be #scams (any company with the word “travel”, “adventure”, or “vacation” in their name, and who claims to be looking for administrative anything is a scam. Ten times out of ten).

I also managed to apply to an insurance … organization. They are agents selling policies from a specific #BigInsurance, only through “agencies” (and sub-agencies - they unfortunately invited prospects (including me) to join their "huddles" on Zoom and I'm observant) and they are looking for prospects in specific regions of the #USA and #Canada.

I paid for the training on 04 Nov, paid for the test on 12 Nov (scheduled for 26 Nov), did the fingerprinting on 16 Nov. Also on 12 Nov, I tried to initiate the #accommodations process with the testing company, (the above-mentioned monopoly) Pearson VUE.

To apply for accommodations, the test-taker is asked to create an additional account on the accommodations portal. The final step of this process is to follow the steps in a “verification email” that may take up to fifteen minutes to be sent.

I /never/ received this email. Thus, I was never able to verify my account, or move forward in the process. After several telephone calls, I was provided an email address for the accessibility team.

On 21 Nov, I emailed the Pearson Accessibility team with a detailed, step-by-step, description of what I was doing, what I was seeing, and the fact that their system never provided me that verification email. Of course, since I’d already created the account, I was attempting to use the “Resend verification email” link (it runs a script). I included ten marked-up screenshots, and asked for a Read #Receipt.

I actually got a reply. However, the reply was “you actually sent this to the wrong place.” It also stated that Pearson VUE did /not/ manage accommodations requests, that was done by the entity who owned the test.

I replied to that email, copy-pasted the email with the steps, attached the screenshots, and asked for another Read Receipt. In that email, I said, “This should be a simple process. I have invested hours of my time in documenting the behavior I am seeing because no one at Pearson VUE accepts my word that I'm following the procedure and it is not working. This will also cost me money to extend my access to training materials until I'm able to test.”

This got a reply where I was informed my account had been locked due to “too many attempts.” On 22 November, I was able to actually log into the portal and get the information I needed to request the appropriate document from my #VocRehab counselor. I sent an email to both my counselor and her assistant, including the #IDC codes corresponding to my current situation (I’ve been an administrative pro long enough to know that the easier the request, the quicker it’s completed).

I received a request on 02 December to complete a DocuSign granting permission for my counselor to share the info with Pearson. Pearson’s website says the process can take “up to ten days,” so I scheduled my test for Friday, 20 Dec, figuring that would work.

On 13 Dec, Pearson notified my counselor that my request had been accepted, and the email included specific instructions for scheduling. The only option is to call a specific phone number. And they aren’t open on the weekend.

On Monday, 16 Dec, when I called, I was on hold “for the next available…” for 40 minutes. When I was finally able to speak to someone, they asked me to verify absolutely every bit of personal data they have on me. Then, I was told I would have to schedule the test at a Pearson Testing Center (there are several local ones). The first center, the one closest to me, did not have any openings until February. The next-closest had an availability for noon on January 17. I was put on hold while the agent tried to request that time. The call dropped.

Another 45 minutes waiting for an agent, and, again, I had to verify all the data. This time, after three “brief” holds of 5+ minutes, I was told the request was pending, and that I would receive a call.

I did receive a call on Thursday, 19 Dec, but my caller ID said it was from “State of California.” Which is /not/ Pearson, so I sent it to voicemail. The voicemail said I had to confirm that I wanted that time “within two business days” and I called back. After another long wait time, the agent said they needed to reach out to “that department” and after even more hold times, I was told that “Marcus” would call me back /that day/.

Of course he did not. I called back Friday morning, and, again, long hold times, and give the agent all the information. And “Marcus” wasn’t going to be in for twenty minutes (it was 9:40 CST, so, aha! he’s on PST). I called back at about 3:00 pm PST (5:00 pm my time). I used to support folks in all five time zones in the contiguous 48, so this is second nature). After another 45 minutes and stuff, the agent said that time was no longer available.

I followed all their steps and procedures. Apparently, the accommodations department at Pearson VUE is dependent on one person, Marcus. I should have been able to take this test by now. Nowhere on the website does it say that test takers requesting accommodations should NOT schedule online. I even deliberately scheduled to test at a local college because I /know/ they have the capability to provide the accommodations I need.

The really stupid part of this is all that time on hold and all that time documenting the misbehavior of their system.

I was promised a call on Monday, 23 Dec. Of course, I'm calling them.

    Magnum (Wonder Man)

Criação: Destin Daniel Cretton, Andrew Guest
    Estúdio
: Marvel Studios (Television), Family Owned, Onyx Collective, Disney
    Estreia:

Matthew Chauncey, roteirista da primeira série animada da Marvel Studios, “What If…?”

    Supergirl

    Direção: Craig Gillespie
    Estúdio
: DC Studios, Warner Bros. Pictures
    Estreia:

    VisionQuest

    Criação: Terry Matalas
    Estúdio
    : Marvel Studios (Television), Disney
    Estreia:

    Lanternas

Criação: Chris Mundy, Damon Lindelof, Tom King
    Estúdio
: DC Studios, Warner Bros. Television, HBO
    Estreia:

    : Marvel Studios (Animation), Disney
    Estreia:

  20. This is a story of a #monopoly. It is also a story of #government #licensing, and #accessibility. There’s a bit of #MLM, but not the usual kind.

This costs money, as this is a profession where you need a #license. The investment was reasonable, $49 for #training, another $49 for the #test, and another $50 for the license application, plus $45ish for #fingerprinting. Even if I choose not to work for the people who recruited me, credentials tend to be useful in some way.

  21. This is a story of a #monopoly. It is also a story of #government #licensing, and #accessibility. There’s a bit of #MLM, but not the usual kind.

  22. This is a story of a #monopoly. It is also a story of #government #licensing, and #accessibility. There’s a bit of #MLM, but not the usual kind.

This costs money, as this is a profession where you need a #license. The investment was reasonable, $49 for #training, another $49 for the #test, and another $50 for the license application, plus $45ish for #fingerprinting. Even if I choose not to work for the people who recruited me, credentials tend to be useful in some way.

26. 2015 European Year for Development

EU members, Candidates, and other European states. (Photo credit: Wikipedia)

On 9 January, the European Year for Development was launched officially at a special event in Riga in conjunction with the opening of Latvia’s presidency of the Council of the EU.
Two days earlier the European Union was attacked on its values. Therefore may citicenzs and politicians came onto the streets to show others they may  never forget that the European Union is based on values.

The European Economic and Social Committee (EESC) representing the various economic and social components of organised civil society, with its president Mr Malosse has called for a reform of European development policy and asks never commercial interests to be our guiding principle, the foundation of all our work, especially in the EU’s action beyond our borders. Nothing must detract from our values.

This does not mean imposing our values, or becoming another superpower, but rather adhering to them ourselves and taking a firm stance in dialogue.

Henri Malosse, EESC President with Ruslana Lyzhychko and José Manuel Barroso, European Commission President, at the 01/2014 EESC Plenary in Brussels.

at the Riga, opening speech the president said.

In this respect, we must build up a dialogue of equals with our partners and return to the principles that prevailed when the Lomé Convention was signed: to negotiate, not grant favours. Let’s stop giving aid and instead work together for shared development!

For the EESC it is clear that

the European model of regional integration, cultural dialogue and true partnership must be at the forefront of this process, as one of the best ways of bringing about development.

Though we must not forget and be careful not to overlook another important task to ensure that it is ordinary people who benefit from the support – not the local middle-men, oligarchs or corrupt officials.

“We have to seize the occasion of the European Year for Development to make our policy more effective in resolving the huge problem of poverty. First of all, we should make the policy for development a Community policy.”
“It is also vital to redesign procedures, by reducing the bureaucracy involved, and to concentrate our funding efforts on populations’ concrete needs”.

The EESC, which had to hear that there are not enough human resources to implement multiple, complex projects, has played an influential role in establishing 2015 as the official European Year for Development (EYD2015). In 2013, the EESC adopted a special opinion on the European Year of Development with rapporteur Andris Gobiņš, which provided firm support for the first ever European Year with a strong global and rights-based dimension. The idea was consistently promoted by the EESC, together with other civil society organisations, the most prominent of which was CONCORD – the European confederation for relief and development – until EYD2015 received official approval from the EU institutions in the spring of 2014.

“It is the first year which explicitly looks beyond the EU’s geographic territory and seeks to be more than just about informing people or campaigning. It aims to increase engagement and discussion, and puts civil society at the core of the process. It presents a great chance to go beyond the traditional players by involving more stakeholders, including those from the private sector, trade unions, consumers, environmentalists, NGOs“,

said EESC member Andris Gobiņš. The EESC has worked to put civil society at the core of EYD2015 and supported the establishment of a broad alliance of civil society organisations, coordinated by CONCORD, to play a key role in designing a wide civil society action programme.

The EESC is willing to look for and to find solutions, relying more for example on the social partners and civil society organisations, especially in countries where civil society is strong and active, as is the case in Ukraine, for instance. They are familiar with the field and can provide effective leverage for the EU.

To do this, we must go beyond mere consultation (and even that does not always happen, or is just a formality) and devise innovative tools for implementation other than traditional projects or budgetary support.

    Malosse said. He pleaded further:

Ladies and gentlemen, my plea is that this year, the European Year for Development, should be a real opportunity to reform this policy. It has become bogged down in technical detail, red tape and procedures over the last 20 years, but today we can once again make it one of the EU’s flagship missions.

  28. Giving others the chance our ancestors had

Lots of American citizens seem to have forgotten where they originally came from. They consider themselves true Americans, but are they so true ‘virgin’ Americans?

Engraving of Spaniards enslaving Native Americans by Theodor de Bry (1528–1598), published in America. part 6. Frankfurt, 1596. (Photo credit: Wikipedia)

Today the United States like many West-European countries is facing an immigration problem. They have to do a lot with economical refugees. But they may not forget that there are also several people who want to come and live in the ‘New World‘ for the same reason as the ancestors of those contemporary ‘Americans’.

In the United States of America as well as in the European Union a wide range of issues are currently under critical discussion: the extent to which our high-tech industries will be able to recruit high-skill workers, the ways in which agricultural labour flows will be stabilized and those workers protected, the degree to which family reunification remains a guiding principle for decisions about who to let into the country and how.  Also how people should be able to go work and live form one state into the other and under which conditions.

With the many people thinking the grass is greener over here than in their country and because of the big problematic human trafficking the issues most important for our states is insuring a clear and rapid road map to citizenship for the unauthorized or “undocumented” migrant population.

The American president wants to start a national debate. Across the country, the ‘Americans’ have a serious discussion about how they can build a fair and effective immigration system that lives up to their heritage as a nation of laws and a nation of immigrants.

And they need the help of many voices from al over, to make sure that genuine, personal perspectives are part of the conversation. The truth is, that if those ‘Americans’ go back far enough, nearly every American story begins somewhere else — so often with ancestors setting out in search of a different life, carving out a future for their children in that place that all of them now call home.

America’s immigration system is broken. Too many employers game the system by hiring undocumented workers and there are 11 million people living in the shadows. Neither is good for the economy or the country.

The President’s plan is to create an Immigration System for the 21st century, building a smart, effective immigration system that continues efforts to secure their borders and cracks down on employers who hire undocumented immigrants.
It’s a plan that requires anyone who’s undocumented to get right with the law by paying their taxes and a penalty, learning English, and undergoing background checks before they can be eligible to earn citizenship. It requires every business and every worker to play by the same set of rules. And that is also what they should do in Europe to stop unwanted scum and profiteers who do not want to contribute to the glory of the country but just want to fill their pocket by being the spongers of society. We should avoid any leeches.

We may not take away the right of people to dream to make a better live for themselves. We never can deny the freedom and the glorious experiment some our ancestors got to build the live we can enjoy today. Together we should and can build a fair, effective and common sense immigration system that lives up to our heritage as a nation of laws and a nation of immigrants.

Cecilia Muñoz, Director of White House Intergovernmental Affairs. (Photo credit: Wikipedia)

Cecilia Muñoz, Director, Domestic Policy Council of The White Housewrites to the American  people:

We want to make sure that idea isn’t far from the minds of policymakers here in Washington as we work to reach an agreement to reform immigration.

To kick things off, one of the President’s senior advisors sat down to share his story with you.

Watch David Simas tell his American story, then tell us yours.

When Americans from all over the country — each with different backgrounds, each from different circumstances — all speak out with the same voice, it’s powerful in a way that’s hard to ignore. We’ve seen it again and again, in debate after debate.

And this is the kind of issue where putting a face on the push for reform takes an abstract concept and makes it real. So share your American stories with us, and we’ll put them to use.

We’ll publish them on the White House website. We’ll share them on Facebook and Twitter. We’ll do everything we can to make sure they’re part of the debate around immigration reform.

Legal immigration should be simple and efficient but not excluded from some important rules making that the person wanting to come into the country shows genuine reasons to come and live in a society he respects and is willing to consider as one of his own thoughts.

Undocumented immigrants should be provided with a legal way to earn citizenship so they can come out of the shadows. It should hold them accountable by requiring they pass background checks, pay taxes and a penalty, go to the back of the line, and learn the language of the region they want to live in (For the U.S.A. I would consider English and Spanish. For Belgium I would say they should learn Dutch and French or be fluent enough in German). It requires everyone to play by the same rules.

The government should be stronger in checking the companies if they are using the right workforce at the right price and should penalise any firm which has workers who have to work under the normal prize. It is high time that the governments in the industrialised countries stop businesses from exploiting the system by knowingly hiring undocumented workers or providing grounds to have slaves and human traffickers finding grounds for existence. It should hold these companies accountable, and give employers who want to play by the rules a reliable way to verify that their employees are here in our economical world legally.

Communities should be made safer from crime, enhancing the infrastructure and technology, and strengthening the ability to remove criminals, sending them back to where they came from, and apprehend and prosecute threats to our national security.

On January 29, 2013 president Obama said:

“If we’re truly committed to strengthening our middle class and providing more ladders of opportunity to those who are willing to work hard to make it into the middle class, we’ve got to fix the system. We have to make sure that every business and every worker in America is playing by the same set of rules. We have to bring this shadow economy into the light so that everybody is held accountable — businesses for who they hire, and immigrants for getting on the right side of the law. That’s common sense. And that’s why we need comprehensive immigration reform.”

This counts for every self-respecting country and we should go by those lines and give other people who have less than us the opportunity to grow like we would like to grow in prosperity.

Undocumented immigrants in Vermont won the right to drive on Tuesday, after a charged House vote ended a vigorous political push by migrant farmers and their advocates which lasted two years.

The House voted 105-39 to create a new and visibly different “driving privilege” card, which will allow about 1,500 undocumented dairy farmers, mostly from Mexico and Guatemala, to drive in the state legally.

The Senate approved the same legislation earlier this month, in a 27-2 vote.  The bill heads for the desk of Gov. Peter Shumlin, who came out to support the bill back in November.

    • Viewpoints: Why immigration overhaul matters to state (sacbee.com)
With the U.S. Senate finally poised to discuss immigration reform, it is important that those of us in California stay focused on what this might mean in the state and what is needed in a bill – and after – to help the state prosper.
      +
Many settled in California long ago; almost half – 49 percent – of the state’s undocumented immigrants have lived here for more than 10 years. They are not just Latinos. Asians constitute 12 percent of the unauthorized population. And whatever the national origin, they are deeply connected to the state’s citizenry. Of the 6 percent of households headed by undocumented immigrants, nearly three-fourths have at least one citizen living there as well. The potential legalization and eventual naturalization of these immigrants would most likely economically benefit the state. Focusing specifically on the undocumented population, the Center for American Progress recently suggested that a road map to citizenship could generate a 25 percent boost in immigrant income, whereas a more conservative estimate for the state generated last year by USC’s Center for the Study of Immigrant Integration suggests a more modest gain of more than 14 percent. Either means a boost in state GDP, multiplied over several years and many sectors.
      +
California has had a long and convoluted relationship with its undocumented population (just think of Proposition 187), but the state now seems to be moving past punitive policies toward embracing its entire immigrant population.

    • Immigration Hearts Could Be Shattered By Washington Breaking Their Dreams – Analysis (albanytribune.com)
On April 10, thousands of immigration reform supporters gathered together in front of the Capitol building in Washington, D.C. to rally for the inclusion of a reliable path to citizenship for the more than 11 million undocumented residents presently living in the United States. The multicultural crowd present that day included immigrant workers from a wide backgrounds of occupations, leaders of civic organizations and their members voicing the opposition against current immigration laws. Overall, President Barack Obama was called upon to fulfill his campaign promise to reform the government’s outdated and hostile immigration policy.

There is a national consensus that the current immigration system is broken and that some decisions have to be made regarding the status of the undocumented population. The root of the problem goes back to the Immigration Reform and Control Act (IRCA), enacted in 1986. U.S. Citizen and Immigration Services describe IRCA as “a bill that was passed in order to control and deter illegal immigration to the United States. Its basic purpose was to stipulate legalization of undocumented aliens who had been continuously unlawfully present since 1982, legalization of certain agricultural workers, and sanctions for employers who knowingly hire undocumented workers, and increased enforcement at U.S. borders.”
    • Heritage vs. Heritage: Major Immigration Report Released Today Directly Contradicts Its 2006 Study (humboldtdems.wordpress.com)
On Monday, the Heritage Foundation published a widely panned study arguing that comprehensive immigration reform that allows undocumented immigrants to earn citizenship would cost taxpayers $6.3 trillion, as the population will take advantage of an array of government programs, including, Social Security, Medicare, unemployment benefits, Medicaid, public education, and population-based services like police and parks. But the study, which comes out under the leadership of conservative former Sen. Jim DeMint (R-SC), is a sharp departure from a “Backgrounder” the Foundation published in 2006. Then, Heritage noted that “worker migration is a net plus economically” and warned lawmakers against succumbing to “a lopsided, ideological approach that focuses exclusively on border security while ignore migrant workers (or vice versa) is bound to fail.”

A new survey published this morning by the Brookings Institution and the Pubic Religion Research Institute reveals that more than 6 in 10 Americans think undocumented immigrants should be granted a path to citizenship. The survey found that 63 percent of respondents back citizenship for those without documentation, while 21 percent favor deportation
    • The economic case for immigration reform (globalpublicsquare.blogs.cnn.com)
The latest numbers show slow growth in the United States. That’s bad for jobs, income – it’s even bad for those worried about the deficit because it means lower tax revenues. And it has prompted a revival of the partisan debate about what to do about it.

Well, there’s one idea out there that could have support from both parties. A study out last week suggests there is one very simple way to increase tax revenue, expand GDP, and create jobs – all at the same time. What’s more, Congress is already weighing it: it’s called immigration reform.

How and why? Well, a new paper from the left-leaning Center for American Progress actually calculates the economic impact of immigration reform.
      +
The study’s authors make the case that legalizing undocumented workers brings them into the formal economy. Now they have to pay income taxes, social security, and health care taxes and all those other things you see on your wage stubs. It also gives them access to many more jobs, and at higher wages. These gains then go on to have ripple effects across the economy, boosting GDP growth.

Critics often point out that if illegal immigrants become citizens, they become a burden on the system, impacting Social Security, Medicare, and Medicaid. But these arguments ignore basic economics. Immigrants with legal papers are transformed into contributing members of society. And access to society’s services also makes them safer, healthier, and more productive.

Some of those involved in the ongoing immigration debate on Capitol Hill are yanking the reins insisting that the bombing casts a new light on the issue that must be considered.

Sen. Charles E. Grassley (R-Iowa), for example, urged lawmakers not to rush ahead without giving due consideration to the issues raised by the Boston bombings. He made the remarks during a hearing before the Senate Judiciary Committee.

Later, Sen. Lindsey O. Graham (R-S.C.), one of the so-called gang-of-eight who have unveiled a sweeping immigration reform proposal, said he believes the bombing should make immigration reform even more critical.

“What happened in Boston…I think should urge us to act quickly, not slower, when it comes to getting the 11 million [illegal immigrants living in the U.S.] identified,” Graham said on CNN’s “State of the Union.”

Sen. Charles E. Schumer (D-N.Y), another backer of reform, agreed: “We are not going to let them use what happened in Boston as an excuse, because our law toughens things up,” Schumer said on the same show.
