    Homeland Security Secretary Kristi Noem said the majority of immigrants in federal immigration detention have a criminal history.

    She made the statement during a lengthy and somewhat confusing back-and-forth with CBS News correspondent Margaret Brennan Jan. 18 on “Face the Nation“:

    Brennan: What’s the breakdown of the percentage of those you have in custody who have actually committed a criminal offense versus just the civil infraction?

    Noem: Every single individual has committed a crime, but 70% of them have committed or have charges against them on violent crimes, and crimes that they are charged with or have been convicted of, that have come from other countries that are here illegally, first of all. And then they have committed a criminal act while they’ve been here or in their home countries as well.

    Brennan: It’s not 70%.

    Noem: Yes, it is. It absolutely is, Margaret. You guys keep changing your percentage, you pick and choose what numbers you think work, but that is the facts, is that 70% of the people that we have detained have charges against them or have been convicted of charges.

    Brennan: OK, well, our reporting is that 47% — based on your agency’s own numbers — 47% have criminal convictions against them.

    Noem’s comments could be taken a number of ways. At first, Noem’s wording made it sound like she was referencing people with violent criminal convictions or charges. But she also talked about pending charges. And Brennan asked Noem about people currently in Immigration and Customs Enforcement custody, but Noem’s wording made it sound like she was describing detention more broadly under Trump’s entire first year in office.

    Analysis of government data shows most people the government has detained have not committed violent crimes. And people who are facing criminal charges aren’t necessarily accused of a violent crime, and they could be acquitted.

    While campaigning in 2024, President Donald Trump promised to prioritize deporting violent criminals, and he has since tried to assure Americans that’s what his administration is doing.

    “We’re looking to get the criminals out right now, the criminals,” Trump said at a Jan. 20 press conference marking the one-year anniversary of his second term in office. “We’re focused on the murderers, the drug dealers.”

    Entering the U.S. illegally is generally a misdemeanor and being in the U.S. illegally is generally a civil offense.

    "Clouatre is a Mexican citizen and mother of two young children who is married to a U.S. #MarineCorps #veteran.

    " 'In an email on Tuesday morning, Christy Tate, the constituent services representative in Mr. Kennedy’s office, wrote to Mr. Clouatre to confirm that his wife had been released from ICE custody after her office had made a formal request to the federal agency,' the report said.

    "The email read in part, 'I am so happy for you and your family. We will continue to keep you, your family and others that are experiencing the same issues in our prayers.' [Because of you, Mr. Kennedy!!!]

    "Reporter Pooja Salhotra wrote that Clouatre came to the United States as a teenager 'to seek asylum with her mother and brother.' After her mother failed to show up for a court hearing in California in 2018, a judge issued a deportation order against the teen.

    "Now estranged from her mother, Clouatre said she didn't learn of the deportation order until earlier this year 'when she was already in the process of applying for a #greencard, the report said.

    "She was detained by ICE agents on May 27 shortly after giving birth, and while attending a 'routine appointment in New Orleans related to her application for a green card and #PermanentResident status,' according to the report.

    "During her incarceration, Clouatre's husband brought the couple's 9-week-old baby to the jail so she could breastfeed. [How Christian of them!] She is currently wearing an ankle monitor and awaiting a court date for her immigration proceedings."

    "A new Trump administration memo calls to eliminate bond releases for immigrants who crossed the border without authorization, potentially keeping them in Immigration and Customs Enforcement detention for years while their cases progress through the immigration system, according to advocates who work with detained immigrants.

    "The policy change means immigrants who entered the country without authorization will no longer be eligible for bond releases and must remain in custody until their cases are resolved — a process that can take years.

    " 'We found out this morning that it was happening,' said Andrea Loya, Executive Director of Casa de Paz, an organization that assists people released from ICE custody.

    "The memo represents a significant shift from previous practices where many immigrants could be released on bond while awaiting their immigration hearings. Loya said her organization currently sees people released after stays ranging from just a few weeks to over a year, depending on their case complexity, access to legal representation and financial resources.

    "Under the new policy, those released on bond will no longer be able to 'go back home' to their families and 'establish some sort of normalcy again and keep fighting for their cases,' Loya said.

    "The extended detention periods could stretch for years, according to Loya, who noted that 'some of these people will fight for years because they will not be going back home' due to safety concerns in their countries of origin.

    " 'What I don't think a lot of people understand is that some of these people, going back to their home countries is a literal death sentence,' she said.

    "Loya characterized the policy as a strategy to pressure immigrants to abandon their legal cases.

    " 'So this is definitely a measure to push people to get back and sign a deportation order or push them into just giving up and going back to whatever home country means,' she said.

    "The policy change aligns with broader Trump administration immigration enforcement priorities. The One #BigBeautifulBillAct allocates $45 billion to expand #ICEDetention capacity to 100,000 beds, roughly double the current capacity.

    "Loya described the detention system as 'monetized' and 'privatized,' suggesting the new policy serves multiple purposes for the administration.

    " 'I think it's a push to make people give up in their cases and also, without the understanding that some people can't give up because going back to their home countries is a death sentence,' she said."

    "CBS News Chicago reported that the annual Cinco de Mayo parade in the Little Village neighborhood of #Chicago will not take place this year.

    "Organizers blamed the Trump administration.

    "The Cermak Road Chamber of Commerce said the Mexican community in Chicago is worried about potential U.S. Immigration and Customs Enforcement raids on the event.

    " 'Our community is very frightened because of the raids and the threat that ICE has imposed on the families that work tirelessly to provide a better future for their kids,' chamber President Hector Escobar said in a statement. 'Our community has faced bullying and prosecution and are not indulging in community activities, therefore we feel that there is nothing to celebrate.'

    "Organizers said they plan to return to the event in 2026.

    "According to a contract document reviewed by The Intercept, federal contractor #UniversalStrategicAdvisors will provide services pertaining to #ICE’s 'non-detained docket,' a master list of millions of #noncitizens believed to be removable from the United States but not yet in the agency’s custody.

    "The contract cites President Donald #Trump’s declaration of a #NationalEmergency on the #USMexicoBorder, an overwhelming glut of potential #deportees, and a shortage of officers to process them all as justification for hiring a private vendor to assist with the collection of biometric data, coordinating removals, and monitoring #immigrant populations.

    "The document says that with a fleet of new outsourced employees, ICE can reassign hundreds of officers to tasks that better align with Trump’s recent executive orders aimed at maximizing the agency’s detention and deportation operations. With the contractors onboard, the document says at least 675 ICE officers 'will be able to take all appropriate actions to comply with the EO’s by prioritizing conducting at-large arrests, removals, and detention related activities.'

    "A former ICE official, who spoke to The Intercept on the condition of anonymity, said they were concerned by this plan to further privatize the agency’s operations at the same time as the Trump administration has dramatically slashed its workforce and gutted important oversight bodies like the Office for #CivilRights and #CivilLiberties, as well as the Office of the Immigration Detention Ombudsman. 'I certainly take issue with them firing career feds and demolishing whole offices, just to hire contractors to do the same work, many of them who are former ICE employees now retired,' the official said."

    "Trump said last weekend he would 'love' to send American criminals there — and would even be 'honored' to, depending on 'what the law says.' White House Press Secretary Karoline Leavitt confirmed this week that the president has discussed this idea privately, too, adding he would only do this 'if it’s legal.'

    "El Salvador’s president, #Nayi Bukele, has for months been offering to hold U.S. citizens in his country’s prison system, which he has turned into 'a judicial black hole' rife with 'systematic #torture,' as one #HumanRights advocate recently told Rolling Stone.

    "Legal experts agree that sending American citizens to prison in El Salvador would be flagrantly illegal under both U.S. and international law — and that the idea itself is shockingly #authoritarian, with few parallels in our nation’s history.

    "The Trump administration is indeed discussing this idea behind the scenes, two sources familiar with the matter confirmed to Rolling Stone. In their most serious form, these conversations have revolved around attempting to denaturalize American citizens and deport them to other countries, including El Salvador.

    " 'You can’t deport U.S. citizens. There’s no emergency exception, there’s no special wartime authority, there’s no secret clause. You just can’t deport citizens,' says Steve Vladeck, a legal commentator and law professor at Georgetown.

    " 'Whatever grounds they try to come up with for denaturalization or #expatriation, the one thing that is absolutely undeniable is that people are entitled to individualized processes, before that process can be effectuated.'

    "In the United States, the grounds to strip a naturalized individual of their citizenship encompass serious material offenses.     "The Supreme Court handed President Donald Trump a massive win on Monday, voting 5-4 to allow his administration to continue rapidly deporting alleged gang members using the Alien Enemies Act.
    The law, passed in 1798, gives presidents the authority to remove foreign nationals over the age of 14 from countries where the United States is either engaged in a declared war or subject to “invasion or predatory incursion” by their country of origin. The act has been invoked three times in U.S. history, each time during wartime, and is meant to counter the actions of foreign governments and regimes, not alleged criminals, gangs, or non-state actors. The law was also used to justify Japanese internment during WWII, and now, the Trump administration is using it to justify its deportations.
    In an unsigned opinion, the Supreme Court tossed a district court decision that had temporarily blocked President Trump’s attempt to continue using the 227-year-old law after he sent almost 300 Venezuelan migrants to a notorious prison in #ElSalvador, known for human rights abuses.

    "All nine justices agreed, however, that anyone the administration is seeking to deport under the Alien Enemies Act must receive notice of deportation and be given the opportunity to challenge the removal through '#habeas petitions' — meaning that migrants have the right to have their detention or deportation reviewed by the federal court, but only for themselves and in the area where they are being detained.

    "The court’s three liberal justices dissented from the ruling, while Justice #AmyConeyBarrett, who was appointed by Trump, partially dissented. Barrett joined Justice #SoniaSotomayor’s dissent calling the majority’s legal conclusion 'suspect' and questioning if habeas claims should be the only way to contest deportations under the act.

    "'The Court’s legal conclusion is suspect,' wrote #Sotomayor. 'The Court intervenes anyway, granting the Government extraordinary relief and vacating the District Court’s order on that basis alone.'"
