It will be interesting to see the implications of the EU Data Act that came into force 2025-09-12.
"The Data Act enables users of connected products (e.g. connected cars, medical and fitness devices, industrial or agricultural machinery) and related services (i.e. anything that would make a connected product behave in a specific manner, such as an app to adjust the brightness of lights, or to regulate the temperature of a fridge) to access the data that they co-create by using the connected products/ related services."
The means by which the companies make this information available is left to the companies to decide. Either way, it must be made available, somehow.
I'm hoping this doesn't lead to some massive #privacy implications such as web services where you'd "enter your device serial number in order to download your data". Even if only technical data, imagine you being able to learn the serial number of some device used by an individual. If you could then access all data generated by this device, you could indirectly learn a fair amount of information on how the devices are being used. Combining this information with other data could give a very comprehensive timeline of individuals’ patterns and habits.

Europese Data Act van toepassing geworden
Vanaf 12 september 2025 is de Data Act (Dataverordening) van toepassing. Gebruikers van verbonden apparaten, zoals smartwatches en auto’s, krijgen meer controle over gegevens die voortkomen uit het gebruik van deze apparaten.
De Data Act zorgt ook voor een betere toegang tot hoogwaardige data. Het gaat daarbij om regels voor een ruimere beschikbaarheid van gegevens om innovatie, concurrentievermogen en de groei van de digitale economie van Europa te stimuleren. Daarnaast kunnen overheidsinstanties toegang krijgen tot data van derde partijen. Dit kan alleen bij een gerechtvaardigd doeleinde, zoals een noodsituatie.
Clouddiensten
Verder kunnen bedrijven en consumenten makkelijker overstappen naar andere clouddiensten. En diensten van verschillende cloudaanbieders met elkaar verbinden. Ook voor decentrale overheden wordt het makkelijker om gegevens en toepassingen over te brengen van de ene aanbieder naar de andere.
Achtergrond
De Data Act is samen met de Data Governance Act onderdeel van de Europese datastrategie. Het doel van de strategie: de EU wereldleider in datagedreven handelsactiviteiten maken en welvaart en welzijn binnen Europa vergroten.

If you’re driving a car, including an electric one, the #EUDataAct lets you demand the data this car generates from the manufacturer. They have to give you the raw and preprocessed data at no cost.
Same for lots of other consumer devices.
Now, the Act isn’t written very clearly. Enforcement is likely to be even more limp than with the GDPR. From what little info I have, lots of companies may not even have realized that this law exists.

In a little under a month from now, the EU Data Act will become generally applicable.
It states that when you buy a product, you have the right to receive the data that this product generates during operation. This should be a boon to anyone who likes to play with devices.
Has anyone here looked at this stuff from a hacker perspective, by any chance?

EU Data Act belangrijke stap voor data-economie
In de digitale samenleving worden data en het gebruik hiervan steeds belangrijker. Om te zorgen voor een betere verdeling van de waarde van data is internationale regelgeving van belang. De EU Data Act helpt om de data-economie beter te laten werken. Eerder heeft de Raad een voorlopig politiek akkoord bereikt met het Europees Parlement. Op 14 juli hebben ook de lidstaten hun steun uitgesproken.
De Data Act zorgt voor meer grip op je eigen gegevens. Zo komen er regels in de EU over de data uit het gebruik van digitaal verbonden apparaten. Nu hebben fabrikanten en dienstenaanbieders wel toegang tot data uit bijvoorbeeld een auto of huishoudelijke apparaten, maar de consument zelf niet.
Ook kunnen bedrijven en consumenten makkelijker overstappen tussen clouddiensten en diensten van verschillende cloudaanbieders met elkaar verbinden. Voor beide belangrijke onderdelen van de Data Act heeft Nederland zich tijdens de onderhandelingen ingezet.
Delen van data
In de EU Data Act staan ook spelregels voor het delen van data. Zoals een redelijke vergoeding aan bedrijven voor het beschikbaar stellen van data, een goede geschillenbeslechting en de aanpak van eventuele oneerlijke contractvoorwaarden.
Het ministerie van Economische Zaken en Klimaat verbetert de data-economie niet alleen. Zij trekt hierbij samen op met het bedrijfsleven, betrokken organisaties binnen onder andere het Centre of Excellence for Data Sharing and Cloud (CoE-DSC) en de Nederlandse AI Coalitie. Naast wetgeving wordt ook gekeken naar bijvoorbeeld het stimuleren van datadelen in de praktijk.
Geldig vanaf medio 2025
Het EU-akkoord wordt hierna nog voor instemming voorgelegd aan de EU-lidstaten en het Europees Parlement. De EU Data Act zal vanaf medio 2025 gelden.
