'#Aotearoa is facing its sharpest constitutional crisis in modern history, as the government professes adherence to Te Tiriti abroad while dismantling it at home, writes international legal practitioner Nicola #Hoobin.'

'In signing the landmark New Zealand-#India Free #Trade Agreement in April this year, the current #coalition #government exported the #Treaty yet again, embedding a dedicated “Cultural, Traditional Knowledge and Economic Cooperation Chapter” that requires all actions to be executed in a “manner consistent with the Treaty of #Waitangi”.
'.....the contradiction it presents to domestic strategy creates a fatal blind spot.
'In New Zealand public law, courts frequently look to international treaties signed by the executive as extrinsic evidence to interpret the scope of the Crown’s fiduciary obligations.
'So, for example, if #iwi launch #judicial #reviews against the rollbacks of the 19 targeted #statutes — which cover critical resource management, #biosecurity, and primary #industries — the #FTA texts become powerful legal levers.
'The Crown cannot easily look a High Court judge in the eye and argue that statutory Treaty obligations are vague, unworkable, or a threat to democratic certainty when the executive branch has formally executed international documents telling the UK and EU the exact opposite.
'The explicit acknowledgments in the EU and UK agreements effectively block the Crown from downplaying the constitutional status of Te Tiriti in a domestic courtroom.
'This inescapable double standard shifts the ultimate burden of accountability from global panels directly onto our domestic judiciary.
'Will the New Zealand courts now hold the Crown strictly accountable for its own #international admissions, enforcing the principle that a sovereign government can’t legally define Te Tiriti as a cornerstone of our constitution to the rest of the world while treating it as entirely disposable at home?...'

Even during the dying days of the 2009 Turnbull era, #Coalition #ClimatePolicy extended as far as tepid support for the deeply flawed Carbon Pollution Reduction Scheme introduced by #KevinRudd and his #ALP government.

Rudd's #CPRS had a 2050 emissions target of a measly 60% reduction from 2005 levels, had no mechanism for increasing ambition, grandfathered in a generous gift of pollution certificates to the worst polluters, and did nothing about Australia's massive and rapidly growing #DirtyEnergy exports (Australia's worst climate crime, dwarfing domestic emissions—a grand atrocity yet to be addressed in earnest by either side of the duopoly).

But the CPRS was nonetheless a climate policy with mechanisms that might have actually reduced Australia's domestic emissions over time, something the Coalition have never embraced in the almost-sixteen years since then.

Dropping the #NetZero2050 fig leaf is on brand.

(NB Once Abbott rolled Turnbull, PM Rudd could have easily passed his signature legislation if he had been at all willing to negotiate with the Greens under #BobBrown, who would have voted for the CPRS as literally better-than-nothing, with just one or two small tweaks—tweaks later conceded by #JuliaGillard in minority government. But Rudd wouldn't even talk to Brown.)

    About Murder by Decree

Murder by Decree is an #uncensored #record of the planned #extermination of #IndigenousChildren in #Canada’s murderous Indian #ResidentialSchools. It is issued as a corrective #CounterReport to the miscarriage of #justice by Church and State known as the “Truth and Reconciliation Commission” #TRC. Based on eyewitness #testimonies and #archival #documentation deliberately suppressed or ignored by the TRC, Murder by Decree proves that the #genocide of #IndigenousPeople began as a religion-led campaign and continues to be a deliberate governmental policy in Canada. This Counter Report reveals these startling facts: – Over half of Indian residential school children began dying the very first year these church-run facilities were opened – This huge mortality rate continued unabated for over a half century because of deliberate practices of germ warfare according to a prescribed monthly “death quota” – Evidence of these crimes and their intentional nature has been continually destroyed by the RCMP and the #Catholic, #Anglican and #UnitedChurch since at least 1960 – The same genocide continues today, is aimed at indigenous women and children, and is driven by foreign corporate interests hungry for #NativeLands and resources Murder by Decree is issued by The International Tribunal for the Disappeared of Canada (ITDC), an international #coalition of #jurists and #HumanRights groups. The ITDC was formed in December, 2015 to investigate the disappearance of people in Canada, prosecute those responsible and prevent a further #whitewash by Canada of its #CrimesAgainstHumanity. This report is an answer to these #crimes and an urgent summons to the world and to all #Canadians to live no longer under #genocidal #regimes.
