Judge Beryl Howell with the U.S. District Court for the District of Columbia struck down yet another attempt by Trump’s administration to reshape the federal government on Monday,
issuing an order ruling that the administration’s DOGE-led “unilateral actions” were
a “gross usurpation of power” that properly belonged to Congress.The U.S. Institute of Peace ( #USIP ) was established by Congress as an “independent nonprofit corporation” in a 1984 bill signed by President Ronald Reagan
that explicitly spelled out the intention for USIP to operate independently and enacted statutory prerequisites for a president to remove any of USIP’s board members.Over the past four decades, Congress has continued to fund USIP “through appropriations bills signed by seven different Presidents from both major political parties, including the current President during his first term in office,” wrote Howell in her 102-page opinion.
But then in “a drastic and abrupt change of course,” Trump signed an executive order in which he “unilaterally decided” that USIP is “unnecessary,” Howell continued.
This entailed “rushed” actions that were undertaken with “blunt force,
backed up by law enforcement,” including removing board members, having DOGE staff “forcibly take over USIP headquarters in mid-March” and replacing the board members,
“hand[ing] off USIP’s property for no consideration” to the General Services Administration (GSA),
and “abruptly terminat[ing] nearly all of its staff and activities around the world.”The Trump administration took these actions
“without asking Congress to cease or reprogram appropriations or by recommending that Congress enact a new law to dissolve or reduce the Institute or transfer its tasks to another entity,”a violation of the president’s constitutional duties under Article II, Section 3 of the Constitution

Acc/to a transcript of the call provided by #Vera, Cavanaugh referenced the US Institute of Peace as an example of #DOGE assigning a team to an independent nonprofit. Last month DOGE took over & shut down #USIP, a 40-yr-old institution founded & funded by Congress that employs ~600 people in DC & abroad. USIP operates differently than Vera & other #nonprofits, which were NOT established by Congress & receive their funding from grants & #private donors.

#USIP’s building is privately owned by the institute & paid for through the institute’s endowment, 2 employees said, unlike its overseas programs & staff salaries, which are paid through federal funds appropriated by #Congress. “So to me this seems like the most egregious violation of the #law,” said one employee.
[Prior to this] A federal judge had condemned the process through which the #Trump admin seized control of USIP but declined a motion for a #TRO.

The termination emails were riddled w/mistakes — w/employees’ names, the month of April & even the institute’s title misspelled in places — a telling sign of the rushed & haphazard nature of the operation….

In the latest action, employees were instructed to sign a 4-pg letter ordering them to return all #USIP property while agreeing to forgo all future claims against the institute. It ordered them not to disclose any terms of the agreement in exchange for 1 month of #HealthInsurance & a monthly stipend paid for an unspecified period. Those who refuse to sign, the letter said, will lose all #benefits as of Monday.

The suit claims the #ExecutiveBranch had no authority to dismiss the leadership & staff of the institute because it was created by the #LegislativeBranch [#Congress], nor could it take over USIP’s privately owned HQ building. Briefs in the case are scheduled during April, with a hearing near the end of the month.

The #USIP has a total staff of about 600 people in offices worldwide. It is actively involved in negotiating #peace deals & helping #war-torn countries & regions to implement peace settlements & rebuild, including in the #Philippines, sub-Saharan #Africa & #Ukraine.
“We put mediators in place to help stitch these communities back together,” said one employee. “So it does have a dramatic effect on #violence on the ground immediately by just pulling these assets out.” -
