Era quindi essenziale non destabilizzare i tedeschi appena sconfitti
Le stragi e le uccisioni commesse dai nazifascisti nel comune di Massarosa sono rimaste impunite, come del resto la grande maggioranza di quelle avvenute per mano tedesca e italiana nella penisola durante la Seconda guerra mondiale.
La storia delle indagini e dei processi a carico dei colpevoli – in pratica conclusasi nel gennaio del 1960 con il provvedimento di «archiviazione provvisoria» di tutti gli atti processuali relativi alle stragi – è lunga e complessa, ma è doveroso accennarne almeno le parti salienti.
Le indagini iniziarono già prima della fine della guerra, con il punto di partenza che è possibile far risalire alla dichiarazione di Mosca del 31 ottobre – 1° novembre 1943. Con essa gli Alleati stabilirono che coloro accusati di crimini di guerra sarebbero stati giudicati dai tribunali dei paesi nel quale essi avevano commesso i crimini. Pochi giorni prima era stata istituita una United Nations War Crimes Commission, composta dai rappresentanti di 17 nazioni alleate, e avente il compito di raccogliere documentazione sui crimini di guerra. Iniziò i lavori l’11 gennaio 1944 a Londra <669.
Il caso italiano presentava alcuni problemi particolari, in quanto si trattava di una nazione nemica sconfitta che aveva commesso essa stessa crimini di guerra, ma che adesso si trovava sotto la brutale occupazione del vecchio alleato.
Ciononostante con il decreto ministeriale del 26 febbraio 1945 il governo Bonomi nominava una «Commissione Centrale per l’accertamento delle atrocità commesse dai tedeschi e dai fascisti dopo il 25 luglio 1943», presieduta dal liberale Aldobrando Medici-Tornaquinci, sottosegretario di Stato del ministero dell’Italia Occupata. Nel maggio dello stesso anno la commissione entrò in contatto con le autorità alleate per stabilire una linea di condotta e le fu permesso di visionare i risultati delle indagini anglo-americane, anche se non sarebbero state concesse persone in stato di arresto <670. Per il momento evidentemente pesava ancora lo status di nazione sconfitta.
In agosto gli alleati, dopo la stesura del Report on German Reprisials for Partisan Activity in Italy <671, proposero di celebrare due grandi processi. Il primo relativo alla strage delle Fosse Ardeatine e il secondo che avrebbe visto imputati i comandanti d’armata, di corpo e di divisione per aver organizzato la grande rete di rappresaglie dal giugno al settembre del 1944. Entrambi questi procedimenti sarebbero stati condotti da autorità militari britanniche, mentre a quelle italiane veniva concesso di processare i gradi più bassi. La questione, nascosta dalla motivazione che gli italiani non sarebbero stati in grado di portare avanti processi troppo complessi, era in realtà politica. Se si fosse permesso alle autorità italiane di processare gli alti gradi dell’esercito tedesco, si sarebbe legittimata la richiesta di estradizione di militari italiani accusati di crimini di guerra in paesi quali la Jugoslavia e la Grecia. Questo veniva giudicato inaccettabile dagli Alleati perché avrebbe minato il morale e la fiducia delle FF.AA. italiane, ora cooperanti con quelle alleate <672.
Con l’anno successivo gli Alleati modificarono leggermente la loro linea di condotta e decisero di procedere con un processo per la strage delle Fosse Ardeatine e con uno al singolo feldmaresciallo Kesselring. Quest’ultimo, vista la caratura dell’imputato, avrebbe assunto un ruolo simbolico molto importante, ma un procedimento penale a carico di una decina o più di alti ufficiali della Wehrmacht e delle SS avrebbe avuto un ben altro impatto. Questa decisione segnò una svolta nella politica giudiziaria alleata <673. Kesselring venne processato a Venezia tra il febbraio e il maggio del 1947 e condannato a morte. Nello stesso anno altri processi minori videro condannati il generale Edward Crasemann,
comandante della 26. Panzer-Division (condannato a 10 anni di reclusione) e il generale Max Simon, comandante della 16. SS-Panzergrenadier-Division, «Reichsführer-SS» (condannato a morte) <674. È significativo che sia Kesselring che Simon vennero quasi immediatamente graziati.
Questi furono gli ultimi processi ad alti ufficiali tedeschi portati avanti da corti militari britanniche. Il clima politico era infatti cambiato e la guerra fredda era alle porte. In questo contesto la Germania occidentale assumeva un ruolo molto importante nel nuovo assetto europeo, trovandosi in prima linea di fronte alla nuova minaccia sovietica. Era quindi essenziale non destabilizzare i tedeschi appena sconfitti, sottoponendoli a lunghi e laceranti processi che avrebbero riaperto le ferite di una guerra persa <675.
La palla adesso passava alle autorità italiane, le quali aprirono una stagione di processi durata una quindicina d’anni, ma che vide solamente 13 sentenze. I procedimenti più importanti riguardarono Herbert Keppler e cinque tra ufficiali e sottufficiali per la strage delle Fosse Ardeatine; Jospeph Strauch, responsabile della strage del Padule di Fucecchio, e Walter Reder, imputato per una notevole serie di crimini <676. Questa stagione di processi si concluse in pratica con la sentenza a carico di Reder, pronunziata il 31 ottobre 1951. Fino agli anni ’90 verranno infatti portati avanti soltanto altri due procedimenti – uno del 1952 e uno nel 1962 -, per di più contro imputati latitanti <677.
La parola fine ai processi venne definitivamente pronunciata dal Procuratore Generale Militare Enrico Santacroce con la sua «archiviazione provvisoria» del 14 gennaio 1960. Con questo provvedimento, assolutamente privo di significato giuridico, Santacroce di fatto obliterò quasi 700 fascicoli inerenti a crimini di guerra commessi in Italia. Le motivazioni che portarono il Procuratore Generale a questa decisione furono in buona parte additabili alla «ragion di stato», cioè alla necessità di evitare alla Germania, che in quel periodo di grave tensione internazionale con il blocco orientale stava ricostruendo il suo esercito. Accanto ad essa c’era l’imbarazzo, da parte del governo italiano, di dover da una parte richiedere l’estradizione di cittadini tedeschi, mentre al contempo negare quelle di presunti criminali di guerra italiani avanzate da paesi stranieri quali la Jugoslavia e la Grecia <678. Ulteriori motivazioni possono essere ricondotte al coinvolgimento con il ventennio fascista che avevano avuto vari esponenti di punta nella gestione dell’archiviazione – quali Santacroce stesso -, al reclutamento da parte dei servizi segreti occidentali di alcuni dei vecchi criminali di guerra nazisti e, in ultimo, dalla volontà di non incrinare i rapporti con la Repubblica Federale Tedesca, che si stava dimostrando un ottimo partner commerciale per l’industria italiana in piena ripresa <679.

When asked as a child what do you want to be when you grow up, no one has ever said I want to live in a tent in a big scary city and spend my days and nights cold, hungry and terrified whilst begging for small change. The majority of people sleeping rough have serious mental health issues including obviously addiction. They're ill. They might make the place look a bit untidy but they also deserve our help and with one flick of a witch's tit Braverman just washed her hands of any responsibility. Vicious, ignorant nonsense. It's nothing to do with social care being decimated in the last decade, no, it's lefty woke charities handing out tents, blankets and soup that are throwing the country to the dogs. It's got nothing to do with a self-inflicted housing crisis born of unbridled greed and apathy, it's foreigners, again, causing all the poverty. I mean, who is this for? Which voter? Which voter who's maybe thinking about voting Tory, Sorry, you're, you're stopping Charities giving tents to the homeless, where do I sign? Surely most people, even if they do read the daily fucking Express, surely most people think Suella Braverman is just a bit fucking gross. She's fucking gross, full of hate and bile and lies, just lies and filth, utter filth, that comes out of that monster's mouth. She claims child grooming gangs are almost all British Pakistani men when her own Home Office says that's just simply not true. Why make that up? Why make that up, why brand planned peaceful protests as hate marches? Hate marches, I mean they're calling for a ceasefire. You might not agree with them, but, but why pretend they're planning to take a dump on the Cenotaph when you know full well the protest goes, it goes nowhere near the Cenotaph? Why are you making that up? Why use hate and fear as a weapon? She's not just one of these populists that dog whistles to the extremists. She is an extremist. She doesn't just embolden the far right with her spicy rhetoric, she is the far right, as far right as any of the far right European leaders that the BBC routinely calls far right. She is a nasty divisive lying far right extremist provocateur at the heart of our government and it's about time the BBC started saying so. One of the most dangerous frontline politicians in my lifetime. A disgusting human being, and she runs the fucking Home Office, and she could very well be the next leader of the conservative party, and therefore a potential future leader of the country, and if that happens, well, bang goes my knighthood.
