Bitwa o patenty 4G. Apple walczy z „trollem patentowym” o przyszłość opłat licencyjnych

Apple jest zaangażowane w batalię prawną w Wielkiej Brytanii i USA dotyczącą patentów 4G. Stawką w brytyjskiej sprawie jest pozornie niewielka kwota – różnica 12 centów od każdego sprzedanego iPhone’a.

Firma twierdzi jednak, że w rzeczywistości gra toczy się o znacznie więcej, a wyrok może stworzyć niebezpieczny, globalny precedens.

Spór toczy się z firmą Optis Wireless Technology, która jest własnością nowojorskiego funduszu hedgingowego i określana jest mianem „trolla patentowego”, zresztą wspominaliśmy już o niej we wcześniej opisywanych na naszych łamach „wojnach patentowych” Apple. Tego typu podmioty skupują patenty, a następnie żądają wysokich opłat licencyjnych. W 2022 roku brytyjski sąd ustalił „uczciwą i rozsądną” stawkę za patenty Optis na 2 centy od iPhone’a. Jednak po apelacji do Sądu Najwyższego kwota ta została podniesiona do 14 centów. Apple nie obawia się samej różnicy w kwocie, lecz faktu, że jeśli podobną podwyżkę zastosowano by do wszystkich patentów niezbędnych do budowy modemu 4G, jego koszt licencyjny wzrósłby z obecnych 5-6 dolarów do około 40 dolarów.

Szczególny niepokój Apple budzi fakt, że brytyjski Sąd Najwyższy uznał, iż ma prawo do ustalania stawek licencyjnych, które obowiązywałyby globalnie, a nie tylko na terenie Wielkiej Brytanii. Właśnie dlatego firma stara się o zgodę na dalszą apelację w tej sprawie. Patenty, o które toczy się spór, należą do kategorii SEP (Standards-Essential Patents), czyli są niezbędne do stworzenia urządzenia zgodnego ze standardem, np. 4G. Z tego powodu muszą być licencjonowane na warunkach FRAND (Fair, Reasonable, And Non-Discriminatory), co oznacza, że opłaty powinny być uczciwe, rozsądne i niedyskryminujące.

Równolegle toczy się sprawa w Stanach Zjednoczonych, gdzie sąd pierwotnie przyznał Optis 506 milionów dolarów odszkodowania, by później zmniejszyć tę kwotę do 300 milionów. Po apelacjach obu stron sędzia zdecydował o konieczności przeprowadzenia nowego procesu w celu ustalenia wysokości odszkodowania od początku. Apple twierdzi, że walczy nie tylko w swoim imieniu, ale także w obronie mniejszych firm, które nie miałyby środków na obronę przed roszczeniami trolli patentowych.
