El voto del ministro Alberto Pérez Dayán dio la puntilla a la derecha. Su decisión ha significado su derrota, su fracaso. Desde el triunfo de Andrés Manuel López Obrador y su llegada a la Presidencia de la República, el conservadurismo nacional no soportó haber sido vencida por un personaje que no era de su linaje.
Un pequeño grupo, encabezado Claudio X. González, llevó todo tipo de acciones; practicaron lo que se conoce como «golpe de Estado blando» para tratar de tirar a un gobierno con el que, desde luego, no simpatizaban, sino que también ensayaron cientos de acciones para quitarlo del poder y sabotear el proyecto de la Cuarta Transformación.
No soportaron haber perdido el poder mediante una elección democrática donde la gente decidió que ellos, los del PRI y los del PAN, y los dueños de los dineros en México, no continuaran gobernando. No podían permitir que otros, que no fueran ellos, tomaran decisiones sobre la dirección económica, política y social que debería de seguir este país.
La reforma al poder judicial que envió el expresidente López Obrador fue el principal quiebre del mayor enfrentamiento entre el consevadurismo, la 4T y sectores progresistas y de izquierda.
En la legislatura pasada, la iniciativa de reforma al poder judicial no transitó porque Morena y sus aliados no alcanzaron la mayoría calificada. Fue hasta hasta ahora, con el triunfo de Claudia Sheinbaum que Morena y sus aliados en las cámaras de Diputados y Senadores llevaron el llamó el «Plan C» al texto de la Constitución.
La mayoría de los intengrantes poder judicial vieron en la reforma un «atentado» a sus intereses que por décadas les ha permitido de gozar de privilegios verdaderamente vergozosos, frente a una población históricamente empobrecida por los gobiernos del neoliberalismo.
Los del poder judicial se dicen aliados y defensores de la Constitución. La realidad es totalmente contraria. Reforzaron su alianza con la derecha política y económica, son parte de ésta y, por supuesto, de la llamada «Marea Rosa«. Fueron arropados desde el poder político y económico y, desde luego, desde de los medios de comunicación.
Uno de sus fracasos mayores fue haber seleccionado a Xóchitl Gálvez como su candidata presidencial, una «analfabeta política», una «títere», en verdad, y lo digo sin demagogia, de la «mafia del poder».
Efectivamente, la derecha «perdió el rumbo» y, peor aún, no entiende por qué no fueron convincentes en su oferta electoral a una población a la que siempre han despreciado, producto de su soberbia y clasismo.
La descalifican y desprecian: «disfruta lo votado», pretenden burlarse, y nos llevan al paredón, y como si fueran dueños de vidas ajenas. Han decidido castigar a meseros, franeleros, a personas de la tercera edad, en súper mercados, a los «chairos», por haber osado en dar su voto a Claudia Sheinbaum. La gente, por supuesto, los mandó a la «chingada».
El poeta alemán Bertolt Brecht llegó a decir que «el peor de todos los bandidos es el «político trapacero, granuja, corrupto y servil». Una definición que la queda a muchos políticos de este país, y desde a luego personajes como Claudio X. González, Marko, el gris, Cortés y, desde luego, a Alejandro, Alito, Moreno.
La reforma al poder judicial era necesaria, urgía. Seguramente no será la varita mágica que deseamos. Conoceremos de actos de corrupción, no lo descartemos. No será en el corto plazo que veamos resultados, pero el paso se ha dado y eso es muy bueno.
A la decisión de Alberto Pérez Dayán de votar en contra del proyecto que proponía invalidar parcialmente la reforma al Poder Judicial, porque rechazó que la Corte tuviera facultades para revisar estos cambios a la Carta Magna, le vino un cúmulo de descalificaciones a su persona, a partir de la idea que el ministro debería atender los intereses de la derecha y no los que le marca la propia Constitución.
A Pérez Dayán la reforma al poder judicial no lo convence. Simplemente no convalidó el proyecto del ministro Juan Luis González Alcántara Carrancá, porque efectivamente, él y sus pares no tienen facultades para ello.
La escena más dramática de la derrota del conservadurismo la escenificó la ministra presidente Norma Piña, quien al verse derrotados buscó con una «chicana», una triquiñuela política que, «en vez de ocho votos, se necesitaban seis», para aprobar el proyecto de Alcántara Carrancá; una maniobra sucia, cínica que pinta de cuerpo entero a ese grupo de ministros, pero al mismo tiempo a la derecha que está detrás de estos togados.
Efectivamente como ha señalado Denise Maerker en Tercer Grado: «ese momento cumbre para mí (es) en donde se revela un nivel muy bajo de los ministros».
Ese episodio ha sido el colofón, no cabe duda, de la gran derrota del conservadsurismo, de una derecha que sigue atolandrada, sin brújula, perdida.
Que no le cuenten…
Tan perdidos está la derecha que uno de sus «distinguidos» integrantes, Marko, el gris, Cortés, ha llamado al «flamante» ganador de las elecciones en EU, Donald Trump, para que sea factor de que se tipifique aquí el término «narcoterrorismo» y que intervengan militarmente en México cuando se le de la gana contra grupos del narcotráfico. Marko es tan gris que piensa que la mayoría de los mexicanos respaldamos, aplaudimos su propuesta. Y sí, como dice la presidentA, el panista va del «ridículo» a la «traición a la patria».
