3/4 ⚠️ If the interim derogation is voted through, voluntary mass scanning by Big Tech platforms becomes legal - with no need for a warrant, little to no oversight, and with no legal basis, on millions of conversations.
⚠️ The outcome of the vote on "#ChatControl 1.0" will either strengthen or undermine the Parliament's position on the #CSARegulation - which has so-far protected encryption and rejected mandatory mass surveillance of private.

2/3 On #AgeVerification, the position of EU member states is to have rules which would force most or all private message services to check people's ID documents before being able to use them.
🚫 This would not keep anyone safe, but could have serious negative consequences on everyone's free expression and right to private communications.
The Parliament needs to prioritise making sure that the final text on the #CSARegulation safeguards uses of age verification and doesn't make them mandatory.

1/6📍#ChatControl: Yesterday, EU lawmakers entered the final stage of negotiations ('trilogues') on the controversial #CSARegulation, aka Chat Control.
📣 EDRi has been advocating for years to make sure that this law tackles the severe crime of child sexual abuse material (CSAM) online without resorting to #MassSurveillance, breaking #encryption or compelling people to undergo intrusive age checks, all of which would have harmful consequences for people and communities.

Today, following a lot of public pressure, representatives of the EU member states have finally agreed on their position to remove arguably the most controversial part of the #CSARegulation: the requirement for message and email services to scan users' private communications.No worry, the messages will be scanned anyway by 5 eyes friends... The suggestions will also come back, very quietly in the hopes nobody will notice.
Regulators can not be trusted at all.

2/3 🇩🇰 Now, Denmark seems to be having a go at breaking the Council deadlock, making the #CSARegulation a top priotity for their presidency.
In reality, the Danish proposal makes no actual efforts to tackle concerns about #surveillance and the #encryption-breaking measures.
Is Denmark's attempt just a PR exercise or do they actually think recycling previously rejected proposals will somehow work this time? 🤔

Totalna inwigilacja w Twoim telefonie? Kontrowersyjne prawo UE wchodzi w decydującą fazę
Pod pretekstem walki z przestępczością, unijni politycy przygotowują prawo, które może oznaczać koniec prawdziwie prywatnej komunikacji w internecie.
Rozporządzenie, znane jako „Chat Control”, zakłada masowe i automatyczne skanowanie wszystkich naszych cyfrowych wiadomości – w tym tych wysyłanych przez szyfrowane komunikatory jak Signal czy WhatsApp. Projekt, który od lat budził olbrzymie kontrowersje, właśnie wchodzi w kluczowe tygodnie negocjacji.
Skanowanie, zanim zaszyfrujesz
Najbardziej niebezpiecznym elementem proponowanych przepisów jest mechanizm tzw. skanowania po stronie klienta (client-side scanning). W praktyce oznacza to, że każda wiadomość, zdjęcie czy plik, który wysyłasz, byłby analizowany na Twoim urządzeniu, zanim jeszcze zostanie zaszyfrowany i wysłany do odbiorcy.
To całkowite zaprzeczenie idei szyfrowania end-to-end, które do tej pory gwarantowało, że nikt poza nadawcą i odbiorcą nie ma dostępu do treści rozmowy. Eksperci ds. cyberbezpieczeństwa alarmują, że taki system tworzy permanentną furtkę (backdoor), którą mogą wykorzystać nie tylko służby, ale także hakerzy czy obce państwa, uzyskując bezprecedensowy dostęp do naszych danych.
Niewinni pod stałą kontrolą
Proponowane prawo nie będzie działać wybiórczo. System masowej kontroli ma objąć wszystkich obywateli, niezależnie od tego, czy są o cokolwiek podejrzewani. Skanowanie ma odbywać się w sposób ciągły i masowy, co zdaniem krytyków narusza fundamentalne prawo do prywatności, zapisane m.in. w Karcie Praw Podstawowych UE.
Co więcej, dotychczasowe analizy, w tym te zlecone przez Parlament Europejski, wskazują na wysoką zawodność technologii skanujących, które generują ogromną liczbę fałszywych alarmów. Niewinne zdjęcie z wakacji czy prywatny żart może zostać błędnie zinterpretowany przez automat jako materiał nielegalny, uruchamiając poważną w skutkach procedurę.
Zegar tyka. Kluczowe tygodnie dla naszej prywatności
Po latach impasu w negocjacjach, obecna prezydencja duńska przyspieszyła prace i według doniesień, zdobyła poparcie 19 z 27 państw członkowskich dla kontrowersyjnego projektu. Czasu na reakcję jest bardzo mało. Państwa członkowskie mają sfinalizować swoje stanowisko do 12 września 2025 roku, a pierwsze głosowanie w Radzie UE może odbyć się już 14 października 2025 roku. Organizacje broniące praw cyfrowych, takie jak te zrzeszone w ramach inicjatywy FightChatControl.eu, apelują o masowe kontaktowanie się z przedstawicielami rządów i wyrażanie sprzeciwu wobec planów masowej inwigilacji.
