Strictly speaking, the one does not contradict the other, as each chiefly addresses different topics: the unhoused in public spaces on the one hand, public drug use on the other.

Yet a difference in attitude is certainly present here, as well as a difference in the understanding of freedom as a value.

I don't have a pat answer about the "correctness" of either approach. I do know that progressives should be thinking hard about these matters
and be ready for challenging discussion about public space, inclusion, and the justifiability or otherwise of paternalism with regard to housing, drug use, and mental illness.

"How the often selfish needs of individuals or a city can be reconciled with those of the general public in terms of planning – that is the real question. Video artist Jan Kamensky provocatively sums it up."

  9. We OPPOSE the surface parking lot proposal at 3116 Park Ave in the Peterboro-Charlotte Historic District. As @detroitparking, we advocate for people-first downtowns.

Surface lots degrade historic character, compromise pedestrian safety and waste land that could be housing or community amenities.

We urge the Commission to DENY this proposal and prioritize solutions that enhance our neighborhoods' historic fabric and vitality.

  10. A Sunlit Afternoon on the Wall

This is me standing on the old walls of Cork where I took this photo in Bishop Lucey Park yesterday afternoon. The sun had already started to head to the horizon and it wasn’t even 3pm, but it did light up the mural on the wall and placed the ground in front of me in shadow.

For many in Ireland, November is firmly in the winter months of the year. It seems to be a traditional Irish/Celtic thing because Met Éireann uses meteorological seasons which classify September, October and November as autumn.

  11. Bishop Lucey’s Pigeon

If there’s one thing that was a constant in the old Bishop Lucey Park in Cork it was the pigeons. They swarmed over the old city wall where humans were denied because of a fence around it. Sometimes the wall was thick with them, waiting for a child to come along and scream and laugh at them as they flew into the air in panic.

  16. This Is Amazing Art By David Zinn! (11 Photos)

David Zinn is an old favorite on Street Art Utopia! He is an American artist known for his street art and illustrations, often featuring fantastical creatures and characters. Here in this blog post, we have collected some of his latest works. His primary tool is chalk, which is easily washed away by rain. David Zinn’s work can be found on sidewalks, walls, and other surfaces in cities around the world, and he has also created illustrations for books and other publications. He is based in […]

  17. @DecaturNature The shopping mall angle led to some legal decisions ~1980s, possibly before. I don't know if there's been any subsequent online equivalent. I can't point at anything specific (though I may be able to turn something up on request). But that's where I'd start looking.

Pruneyard v. Robbins is the canonical case: en.wikipedia.org/wiki/Pruneyar (SCOTUS, 1980), finding for the plaintiffs that a free-speech right did exist.

This is probably the remit of the EFF / ACLU / EPIC and similar organisations.

For the record I've long had an issue with the notion that free speech rights are only a matter of direct government action. There are a few reasons for this:

    • The right to exclude speech from private property ultimately relies on government sanction for that exclusion.
    • Spatial monopolies, whether of commercial, educational, recreational, or even residential spaces, trade private control (and powers and limitations) for public ones, whether or not those private concerns are for-profit or not-for-profit. E.g., what are the free-speech rights on a private school or university, or a religious institution, or a park, or a residential complex?
    • Common carrier provisions were enacted in transportation, and later communications systems, specifically because those systems, though privately held, exercised so much power over commerce, travel, and communication. The idea that free speech is absolutely limited to government interactions in that context strikes me as ludicrous.

  18. Back in 2011 I co-directed an #architecture studio with a good friend. We experimented with new ways to engage people and activate community life in our city. One example is the render in this post: an urban intervention designed to promote book sharing and reimagine #PublicSpace through a bit of #PlaceMaking.
Those experiments left me a with a lasting lesson: Build, stay curious, and follow creativity wherever it leads. That mix of curiosity and experimentation has shaped my not-so-linear career, and continues to guide me today.

I wrote a bit more about it in the latest issue of the newsletter: luisnatera.photo/006-why-side-
