  1. #Germany seeks to #deport #protesters

Submitted by webadmin on 9 April, 2025

"The German state has issued deportation orders for three #EUCitizens and one #American who have attended #ProPalestinian protests.

"Berlin immigration authorities issued the orders on 31 March, demanding that the four individuals leave Germany within one month or else face deportation. Their orders cite a protest in October 2024 in which masked individuals caused 'significant property damage, including #graffiti', as well as resisting arrest and calling a #police officer a '#fascist'.

"Unusually, three of the four orders also invoke the German principle of #Staatsräson, (“#StateReason”). This term originates from a speech #AngelaMerkel gave to the #IsraeliKnesset in 2008, asserting that #Israeli security was fundamental to the purpose of the German state.

"Staatsräson is not an officially defined term or codified anywhere in the German constitution or by German courts. At least two of the protestors are appealing the decision, with their lawyer telling Al-Monitor that it is a 'political concept, not a legal concept, and therefore unlawful'.

"In any case, the #deportation of #activists for #protesting should be opposed.

    #Khalil

"The activists’ lawyer has drawn parallels to the case of #MahmoudKhalil in the US. 'I see similarities… It is weaponization of #ImmigrationLaw as a tool to silence #PoliticalDissent'. Khalil’s case may also lead to a debate on interpretations of the US constitution’s #FirstAmendment.

"Back in February, #Berlin police broke up a protest, citing a ban on '#ArabicChanting', the playing of #ArabicMusic, or giving a speech in #Arabic. In October 2024, police raided the homes of five men, four of whom were being investigated over 'authorship of #antisemitic social media posts'.

    Clapping

"And after the joint Israeli-Palestinian documentary #NoOtherLand won an Academy Award, German culture minister Claudia Roth insisted that she was only clapping for Israeli director Yuval Abraham, not Palestinian director #BaselAdra. Several politicians, including the mayor of Berlin, called for her resignation. A torrent of public criticism was aimed at #YuvalAbraham for his acceptance speech, to which he responded: 'To stand on German soil as the son of Holocaust survivors and call for a ceasefire — and to then be labelled as antisemitic is not only outrageous, it is also literally putting Jewish lives in danger.'

"Israeli politicians cited German politicians when attacking the filmmakers themselves, and only weeks later, co-director #HamdanBallal was attacked by #IsraeliSettlers in the #WestBank, and removed from an ambulance by #IDF soldiers.

"German Staatsräson is less about assuring Israel’s right to exist, and more about giving a free hand to the #repressive policies of the Israeli right."

  2. A federal judge Thursday decried what he said were
    “breathtaking” constitutional violations
    by senior Trump administration officials

    and called the president
an “authoritarian” who expects everyone in the executive branch to
    “toe the line absolutely.”

In remarks laced with outrage and disbelief,
U.S. District Judge #William #Young said Donald Trump and top officials have a
    “fearful approach”
to freedom of speech that would seek to
“exclude from participation everyone who doesn’t agree with them.”

Young, who was appointed to the federal bench by President Ronald Reagan,
leveled the searing critique during a hearing in Boston to determine the appropriate remedies for the administration’s ⚠️detentions of
    pro-Palestinian students last year.

The judge had ruled in September that senior administration officials engaged in an 👉 illegal effort to arrest and deport noncitizen students based on their activism.

On Thursday, he again denounced the administration’s conduct in unusually stark terms.

    “Talking straight here,” he said.

“The big problem in this case is that the cabinet secretaries
    and ostensibly,
the president of the United States,
are not honoring the First Amendment.”

Homeland Security Secretary Kristi L. Noem
and Secretary of State Marco Rubio
    engaged in an
    “unconstitutional conspiracy”
to deprive people of their rights,
    Young said.

“The secretary of state,” he noted,
    his voice full of incredulity,
“the senior cabinet officer in our history involved in this.”

Spokespersons for the White House,
Noem and Rubio did not immediately respond to requests for comment.

Tricia McLaughlin, assistant secretary for public affairs at the Department of Homeland Security, last year called Young a “craven” judge who was “smearing and demonizing federal law enforcement.”

The government actions at the core of the case date to early March,
when the Trump administration launched a campaign to detain and deport noncitizen students at U.S. universities
who had been active in opposing Israel’s war in Gaza.

Though not accused of any crime,
those arrested spent weeks confined in Immigration and Customs Enforcement detention facilities,
at times hundreds of miles from where they lived,
    before being released on bail.

The plaintiffs in the case are the American Association of University Professors
and the Middle East Studies Association.

The groups of scholars accused the administration of having an unconstitutional policy of deporting people based on their political views,
a policy intended to chill the free-speech rights of their members.

The trial last summer focused on the targeting of five noncitizen students and scholars: #Mahmoud #Khalil, #Yunseo #Chung and #Mohsen #Mahdawi, who were students at Columbia University;

    #Rumeysa #Ozturk,
    a graduate student at Tufts University;

and #Badar #Khan #Suri, a postdoctoral scholar at Georgetown University.

All were arrested except Chung,
who obtained a restraining order before ICE could find her.

The other four were released on the orders of federal judges,
but the Trump administration is still trying to deport them.

⭐️On Thursday, an appellate court in Philadelphia overturned a
Ruling lower-court ruling in Khalil’s case on jurisdictional grounds,
⛔️raising the possibility that he could be rearrested.

The president and other officials hailed last year’s detentions as part of a fight against "antisemitism", alleging without presenting evidence that the targeted students promoted violence or were pro-Hamas.

  3. A far-right group that claimed credit for the arrest of a Palestinian activist and permanent US resident who the Trump administration is seeking to deport-- claims it has submitted “thousands of names” for similar treatment.

"Betar US" is one of a number of rightwing, so called "pro-Israel" groups
that are supporting the administration’s efforts to deport international students involved in university pro-Palestinian protests,
an effort that escalated this week with the arrest of #Mahmoud #Khalil, an activist who recently completed his graduate studies at Columbia University.

This week, Donald Trump said Khalil’s arrest was
just “the first of many to come”.
#BetarUS quickly claimed credit on social media for providing Khalil’s name to the government.

Betar, 💥which has been labelled an extremist group by the Anti-Defamation League (ADL), a Jewish advocacy group,
said on Monday that it had
“been working on deportations and will continue to do so”,
and warned that the effort would extend beyond immigrants.
❌“Expect naturalized citizens to start being picked up within the month,” the group’s post on X read.
(It is very difficult to revoke US citizenship, though Trump has indicated an intention to try.)

👉Deporting speakers over supposed ‘propaganda’ is a stock authoritarian move

The group has compiled a so-called “deportation list”
naming individuals it believes are in the US on visas and have participated in pro-Palestinian protests, claiming these individuals “terrorize America”.
A Betar spokesperson, #Daniel #Levy, said in a statement to the Guardian that Betar submitted 🆘“thousands of names” of students and faculty they believe to be on visas from institutions like Columbia, the University of Pennsylvania, UCLA, Syracuse University and others to representatives of the Trump administration.

The group claims to have “documentation, including tapes, social media and more” to support their actions.
It claims to be sharing names with several high-ranking officials, including the secretary of state, Marco #Rubio; the White House homeland security adviser, Stephen #Miller; and the attorney general, Pam #Bondi, among others.

The White House and state department did not respond to questions about whether they are working with Betar or other groups to identify students for deportation.

  4. Is #Trump planning to declare #MartialLaw on April 20? The frightening claim, explored

Story by Charlotte Simmons, March 14, 2025

"First, the essentials. Martial law is the term for when civilian government and legal processes (such as mayoral jurisdiction and police officers, respectively) are overtaken by state military, so as to make demands on behalf of the nation’s leader, and then enforce those demands with their wealth of resources. Typically, martial law is invoked in dangerous situations, such as natural disasters or major #CivilUnrest.

"This is different from the United States’ #InsurrectionAct, wherein those civilian enterprises are not replaced by military personnel and resources, but supplemented by them. More importantly, the official nature of the Insurrection Act allows the #POTUS to deploy the military domestically during emergencies, as the #PosseComitatus Act of 1878 prohibits the use of the military against American civilians. In short, the Insurrection Act can waive the rules of the Posse Comitatus Act to create a sort of #MiniMartialLaw. Remember this.

"Recently, fears have been rising over whether or not the United States could enter martial law on April 20 under Donald Trump. But why then? What is it about April 20 that holds significance? When Trump first took office back on January 20, he signed an executive order declaring a state of emergency at the United States’ southern border, requiring the secretaries of Defense and Homeland Security to submit a report about what the 'situation' is at said border, together with recommended actions for 'resolving' said 'situation.' This report needed to be submitted within 90 days.

"When this order was signed, Trump also declared that 'A #NationalEmergency exists at the southern border of the United States…I hereby declare that this national emergency requires use of the Armed Forces…' This, directly references the potential execution of the Insurrection Act.

"The Secretary of Defense? #PeteHegseth. The Secretary of #HomelandSecurity? #KristiNoem. Two of Donald Trump’s most prominent yes-men. And guess how many days January 20 and April 20 are apart? Ninety.

"So, essentially, on April 20, there’s a not-insignificant chance that those two aforementioned Trump yes-men are going to tell Trump whether or not he should deploy the military in the southern United States so as to crack down on immigration. Except, as we saw with the case of #MahmoudKhalil — a recent #ColumbiaUniversity graduate who played a major role in that student body’s recent #ProPalestinain campus occupations — it doesn’t matter if you have a green card or if you haven’t committed any crimes; under this presidency, #ICE will illegally detain you if they think you’re troublesome to the vision of #TrumpsAmerica. They’re trying to deport Khalil for speaking out against #genocide as we speak. This is a direct, wholly #unconstitutional attack on #FreeSpeech.

"And here’s why that distinction between the Insurrection Act and martial law was so important earlier. On April 20, Trump will constitutionally — through the Insurrection Act — be allowed to deploy the military against #AmericanCivilians, and his government has already demonstrated that legal American civilians who have not committed any crimes are at risk for detention and deportation. It’s not technically martial law, but this #Trumpian cocktail is just as bad, if not worse.

"#Khalil’s detention — again, occurring in response to his speaking out against the #genocide of #Palestinian people — was made on the grounds of Trump’s executive order prohibiting #AntiSemitism. How long before more executive orders (none of them made in good faith, let’s be clear on that) just so happen to limit more ways of speaking, acting, and thinking? A scary thought, and a horrifyingly pertinent one."

"As Jewish students, we grew up learning about the rise of #fascism, learning about how important it is to stand up when you see #injustice in the world," said one #protester.

by Julia Conley, Apr 02, 2025

"'We are here in protest of that to demand that the university tell us which trustees, which members of the university administration, are responsible for this so we can demand immediate consequences for them and hold them accountable for what they've done to our peer,' said the undergraduate student.

"Shea added that Jewish students were leading the protest because 'the attacks on our international students, on students of color, have been so fierce, so dangerous, so disproportionate that we are the only students who can be here right now taking this risk.'"
