Deutschland will vier ausländische Einwohner wegen pro-palästinensischer Aktivitäten ausweisen

Die vier zur Ausweisung vorgesehenen Personen wurden nicht wegen eines Verbrechens verurteilt, sollen aber an Protesten gegen den israelischen Angriff auf Gaza teilgenommen haben.

Die Berliner #Ausländerbehörde will vier junge ausländische Einwohner abschieben, denen vorgeworfen wird, an Protesten gegen den #Krieg Israels gegen #Gaza teilgenommen zu haben. Dieser beispiellose Schritt gibt Anlass zu ernsthaften Bedenken hinsichtlich der #Bürgerrechte in #Deutschland.

Die nach deutschem #Migrationsrecht erlassenen #Abschiebungsanordnungen wurden unter politischem Druck und trotz interner Einwände des Leiters der Ausländerbehörde des Landes Berlin erlassen. Der interne Streit entstand, weil drei der von der Abschiebung betroffenen Personen Bürger von EU-Mitgliedstaaten sind, die normalerweise #Freizügigkeit zwischen EU-Ländern genießen.

Die Anordnungen – ausgestellt vom Land #Berlin, dessen #Senatsverwaltung die #Einwanderungsbehörde beaufsichtigt – sollen in weniger als einem Monat in Kraft treten. Keiner der vier wurde wegen eines Verbrechens verurteilt. Die Fälle werden mit dem Einsatz von Abschiebungsanordnungen zur Unterdrückung sozialer Bewegungen in den Vereinigten Staaten verglichen.

„Was wir hier sehen, ist direkt aus dem Handbuch der extremen Rechten entnommen“, sagte Alexander Gorski, ein Anwalt, der zwei der Demonstranten vertritt. „Man sieht es in den USA und auch in Deutschland: Politische Meinungsverschiedenheiten werden zum Schweigen gebracht, indem man den Migrationsstatus der Demonstranten ins Visier nimmt.“

„Aus rechtlicher Sicht waren wir über die Argumentation beunruhigt, die uns an den Fall von Mahmoud Khalil erinnerte“, fuhr Gorski fort und bezog sich dabei auf den palästinensischen Absolventen der #Columbia University und ständigen Einwohner der #USA, der aufgrund von Vorwürfen im Zusammenhang mit pro-palästinensischen Aktivitäten auf dem Campus aus seinem Wohnhaus geholt wurde.

Die vier Personen, die abgeschoben werden sollen – Cooper #Longbottom, Kasia #Wlaszczyk, Shane #O'Brien und Roberta #Murray – sind Staatsbürger der Vereinigten Staaten, #Polens bzw. in den beiden letztgenannten Fällen #Irlands. Nach deutschem #Migrationsrecht benötigen die Behörden keine strafrechtliche Verurteilung, um eine #Abschiebungsanordnung zu erlassen, erklärte Thomas Oberhäuser, Rechtsanwalt und Vorsitzender des Geschäftsführenden Ausschusses für Migrationsrecht beim Deutschen Anwaltverein. Die angeführten Gründe müssen jedoch in einem angemessenen Verhältnis zur Schwere der Abschiebung stehen, d. h. es spielen auch Faktoren eine Rolle, wie z. B. ob jemand von seiner Familie getrennt wird oder sein Geschäft verliert.

„Die entscheidende Frage ist: Wie schwerwiegend ist die Bedrohung und wie verhältnismäßig ist die Reaktion?„, so Oberhäuser, der nicht in den Fall involviert ist. ‚Wenn jemand nur wegen seiner politischen Überzeugungen ausgewiesen wird, ist das eine massive Überreaktion.“

"Vage und unbegründete Anschuldigungen"

Das einzige Ereignis, das die vier Fälle miteinander verband, war der Vorwurf, die Protestierenden hätten an der Besetzung der Universität teilgenommen, was Sachbeschädigung und angebliche Behinderung einer Verhaftung beinhaltete – eine sogenannte De-Arrest, die darauf abzielte, die Inhaftierung eines Mitprotestierenden zu verhindern. Keiner der Demonstranten wird wegen bestimmter Vandalismusakte oder der De-Arrest an der Universität angeklagt. Stattdessen wird in der Abschiebungsanordnung der Verdacht geäußert, dass sie an einer koordinierten Gruppenaktion teilgenommen haben. (Die Freie Universität teilte The Intercept mit, dass sie keine Kenntnis von den Abschiebungsanordnungen hatte.)

Einige der Vorwürfe sind geringfügig. Zwei werden beispielsweise beschuldigt, einen Polizeibeamten als „Faschist“ bezeichnet zu haben – eine #Beleidigung eines Beamten, die eine Straftat darstellt. Drei werden beschuldigt, mit Gruppen demonstriert zu haben, die Slogans wie „Vom Fluss bis zum Meer wird Palästina frei sein“ – was in Deutschland im vergangenen Jahr verboten wurde – und „freies Palästina“ skandierten. Die Behörden behaupten auch, dass alle vier antisemitische oder antiisraelische Parolen gerufen haben, ohne dass diese jedoch näher spezifiziert werden.

Zwei von ihnen werden beschuldigt, einem Beamten oder einem anderen Demonstranten in den Arm gegriffen zu haben, um Verhaftungen bei der #Sitzblockade am Bahnhof zu verhindern. O'Brien, einer der irischen Staatsbürger, ist der einzige der vier, dessen Ausweisungsanordnung eine Anklage enthielt – die Anschuldigung, er habe einen Polizeibeamten als „#Faschisten“ bezeichnet –, die vor ein Strafgericht in Berlin gebracht wurde, wo er freigesprochen wurde. Allen vier wird ohne Beweise vorgeworfen, die Hamas zu unterstützen, eine Gruppe, die Deutschland als terroristische Organisation eingestuft hat.

In drei der vier Ausweisungsbescheide wird ausdrücklich auf angebliche Bedrohungen der öffentlichen Sicherheit und die Unterstützung der #Hamas verwiesen, um zu argumentieren, dass die Demonstranten in Ausweisungsverfahren keinen Anspruch auf ihre verfassungsmäßigen Rechte auf freie #Meinungsäußerung und #Versammlungsfreiheit haben. „Was wir hier sehen, sind die härtesten verfügbaren Maßnahmen, die auf äußerst vagen und teilweise völlig unbegründeten Anschuldigungen basieren“, sagte Gorski, der Anwalt von zwei der Demonstranten.

In einem beispiellosen Schritt, so Gorski, wird in drei der vier Ausweisungsbescheide das nationale Versprechen Deutschlands zur Verteidigung Israels – die #Staatsräson des Landes, auf Deutsch ‚Grund der Staatsräson‘ – als Rechtfertigung angeführt. Oberhäuser vom Einwanderungsausschuss der Anwaltskammer sagte, Staatsräson sei eher ein Prinzip als eine sinnvolle Rechtskategorie. Und ein parlamentarisches Gremium argumentierte kürzlich, dass die Bestimmung keine rechtsverbindlichen Auswirkungen habe. Diese Unterscheidung, so Oberhäuser, mache die Verwendung von Staatsräson in Abschiebeverfahren rechtlich zweifelhaft: „Das ist verfassungsrechtlich unzulässig.“

Interne Einwände

Nachdem die Innenbehörde des Berliner Senats einen unterschriebenen Abschiebebescheid angefordert hatte, erhob Silke Buhlmann, Leiterin der Abteilung für #Kriminalprävention und Rückführung bei der Ausländerbehörde, Einwände. In einer E-Mail teilte Buhlmann mit, dass ihre Bedenken vom obersten Beamten der Ausländerbehörde, Engelhard #Mazanke, geteilt würden. #Buhlmann warnte ausdrücklich davor, dass die Rechtsgrundlage für den Entzug der Freizügigkeit der drei EU-Bürger unzureichend sei – und dass ihre #Abschiebung rechtswidrig wäre.

„In Abstimmung mit Herrn Mazanke teile ich Ihnen mit, dass ich Ihrer Anordnung vom 20. Dezember 2024 – Anhörungen für die unter a) bis c) aufgeführten Personen durchzuführen und anschließend den Verlust der Freizügigkeit festzustellen – aus rechtlichen Gründen nicht nachkommen kann“, schrieb Buhlmann und bezeichnete die drei Bürger aus EU-Staaten als Fälle A bis C. Buhlmann schrieb, dass die Polizeiberichte zwar „auf eine potenzielle Bedrohung der öffentlichen Ordnung durch die betroffenen Personen hindeuten, es aber keine rechtskräftigen strafrechtlichen Verurteilungen gibt, die eine hinreichend schwere und tatsächliche Bedrohung belegen würden“.

Der interne Einspruch, der als Remonstration bezeichnet wird, wurde von Christian #Oestmann, einem Beamten der Berliner Senatsverwaltung, schnell abgewiesen. Er wies die Bedenken zurück und ordnete an, die Ausweisungsanordnungen trotzdem zu vollstrecken. „Für diese Personen kann eine fortgesetzte Bewegungsfreiheit aus Gründen der öffentlichen Ordnung und Sicherheit nicht gerechtfertigt werden, unabhängig von etwaigen strafrechtlichen Verurteilungen“, schrieb er. „Ich bitte daher darum, die Anhörungen sofort wie angeordnet durchzuführen.“

In einer Stellungnahme gegenüber The Intercept erklärte ein Sprecher der Senatsverwaltung, dass das #Innenministerium die Aufsicht über die Einwanderungsbehörde habe. „Die Senatsverwaltung für Inneres und Sport übt die technische und administrative Aufsicht über die staatliche Einwanderungsbehörde aus“, sagte der Sprecher. „Im Rahmen dieser Aufgabe ist sie befugt, Weisungen zu erteilen.“ Der Senat lehnte es unter Berufung auf den Datenschutz ab, sich zu den Einzelheiten der Fälle zu äußern. Die Einwanderungsbehörde reagierte nicht auf die Bitte von The Intercept um eine Stellungnahme.

Letztendlich beugte sich Mazanke, der oberste Beamte der Einwanderungsbehörde, der Anordnung und unterzeichnete den Beschluss.

"Sie werden als Versuchskaninchen benutzt"

Die schwerwiegendsten Konsequenzen hätte Longbottom, ein 27-jähriger amerikanischer Student aus #Seattle, #Washington, zu tragen, dem nach dem Verlassen Deutschlands für zwei Jahre die Einreise in eines der 29 Länder des Schengen-Raums untersagt wäre. Longbottom, der jeglichen #Antisemitismus bestritt, sagte gegenüber The Intercept, dass ihm nur noch sechs Monate blieben, um seinen Master-Abschluss in Menschenrechtsarbeit an der Berliner Alice-Salomon-Universität zu machen.

„Werde ich meinen Master hier abschließen können? Wo werde ich leben?“, fragte Longbottom. “All diese Fragen sind sehr unklar.“ Longbottom, der transsexuell ist, lebt mit seinem Partner, einem italienischen Staatsbürger, in Berlin. Die Aussicht, getrennt zu werden, lastet schwer auf ihnen. „Ich habe nichts, womit ich neu anfangen könnte“, sagte er. „Als Transperson ist der Gedanke, jetzt in die USA zurückzukehren, wirklich beängstigend.“

Kasia Wlaszczyk, 35, Kulturarbeiterin und polnische Staatsbürgerin, sagte, sie hätte nie gedacht, dass dies passieren könnte. Er betonte, dass Vorwürfe des Antisemitismus in Deutschland in erster Linie eine rassistische Taktik gegen #Palästinenser, #Araber und #Muslime seien und die Abschiebungsanordnungen eine Zunahme der Verwendung dieser Vorwürfe gegen alle, die sich mit ihnen solidarisieren, widerspiegelten. „Deutschland setzt diese Anschuldigungen als Waffe ein“, sagte er.

Wlaszczyk, der ebenfalls trans ist, lebt seit seinem zehnten Lebensjahr nicht mehr in Polen. „Wenn das durchkommt, würde es mich aus der Gemeinschaft reißen, die ich mir hier aufgebaut habe“, sagte er.

Das Gefühl eines drohenden Verlusts der Gemeinschaft war unter den Demonstranten weit verbreitet. „Meine Illusion von Berlin wurde durch die mangelnde Reaktion auf den #Völkermord zunichte gemacht“, sagte Shane O'#Brien, 29, ein irischer Staatsbürger. Die gewaltsame Unterdrückung arabischer Gemeinden in Berlin habe ihn erschüttert.

Nach drei Jahren in Berlin fühlt sich die drohende Abschiebung für Roberta Murray, 31, die ebenfalls Irin ist, wie ein Bruch an. „Mein Leben ist hier“, sagte sie. „Ich mache keine Pläne für Irland. Ich glaube, dass wir gewinnen werden – und dass wir bleiben werden. Ich glaube nicht, dass dies vor Gericht Bestand haben wird.“

Gorski und andere Anwälte reichten nun einen Eilantrag auf einstweilige Anordnung sowie eine formelle #Berufung ein, in der sie die #Rechtmäßigkeit der Abschiebungsanordnungen anfechten. Er wies darauf hin, dass er bereits an ähnlichen Fällen gearbeitet habe, in denen das Migrationsrecht dazu benutzt wurde, pro-palästinensische Aktivisten wegen ihrer Reden ins Visier zu nehmen. Was die aktuellen vier Fälle jedoch auszeichne, sei die Offenheit, mit der die sogenannte Staatsräson Deutschlands zur Rechtfertigung von Ausweisungen herangezogen werde.

„Diese Menschen haben keine Vorstrafen“, sagte Gorski. Dennoch scheint die Berliner Regierung ein #Narrativ der ‚unmittelbaren Gefahr‘ zu konstruieren, um ein ordnungsgemäßes Verfahren zu umgehen.

Gorski warnte, dass die Fälle ein Testlauf für eine umfassendere Unterdrückung von #Einwanderern und #Aktivisten in Deutschland seien und nicht nur um vier Demonstranten gehe. „Sie werden als Versuchskaninchen benutzt.“
