Another expert witness service company tried to add me to their stable this week. I always decline, because their contracts are too restrictive. I wrote in my reply today, “I won’t be signing a contract with [name redacted]. I don’t sign non-compete agreements of any kind. I always reserve the right to market to anyone, anywhere, anytime.”
The expert witness “matchmaking” companies include contract language that prohibits you from contacting the client for additional business. That client is off limits unless you go through their service. Excuse me, but they’re not on the management team at FIFO Networks, and they don’t get to decide who I can and can’t negotiate new contracts with.
So – if you’re a North American telecom carrier, wired or wireless, and you need an expert witness with experience and knowledge in the engineering and buildout of telecommunications infrastructure, I’m here for you. Note that my expertise is in system development, with only tangential knowledge of the regulatory environment. I’m not the legal expert, I’m the system expert.

This company has tried twice now to get me to fill out their application to be available as an expert witness. Both times, the email has included an immediate need by an undisclosed law firm for someone with my knowledge and experience. There is no guarantee of work. By filling out the online application, I’d be added to their pool of talent and presented to the attorney handling the current case, along with any other prospective candidates. It will cost me time and effort, regardless of whether or not I’m selected as the expert witness.
Now look at the screenshot from their website. They boast about having a stable of over 150,000 experts, and having worked on over 5,000 cases. So, let’s do the math: hmmm… that means that only about one in thirty of their applicants has ever received an assignment and been paid. And if some of the expert witnesses are in high demand and handle more than one case, the odds for the other experts goes down even more.
When they contacted me the first time, I told them that because the odds were so bad, I’d require a non-refundable payment in advance, for one hour at my normal rate, to fill out the application. They declined.
These companies are legitimate and perfectly legal. You can genuinely get jobs that you might not otherwise have the opportunity to work on. For me, they’re not worth the effort. I’ve done this a few times with other consulting houses and made a little money, but the annual renewal process is onerous. Every year, you have to take their online training in things like confidentiality, noncompete rules, billing procedures, and so forth.
These consulting houses aren’t for beginners. If you legitimately have the experience and skill to compete with the other people who enroll, feel free to sign up for some of them if you’re interested. I’ll pass.
BTW, my expert witness experience goes all the way back to Y2K litigation. I’ve worked with such diverse topics as semiconductors, computer hardware, operating systems, telephony, wireless systems, and cybersecurity. I've done interviews, depositions, training the legal team, and I have trial experience.
