That said, this bit is intriguing. Corporation tax: you don't pay til after appeals are exhausted, so you don't need a stay. VAT: you pay up-front, and don't normally get a stay. Does this help us guess what's going on??? #taxtwitter

It seems like the pandemic is finally completely over as of a few weeks ago. Then I realized that is when I deleted Twitter.
Not sure if I’m better off now or then.
In any case, I think I’m going to start restricting my follows here as well.
It’s too bad that the #TaxTwitter crowd mostly isn’t here, though. That was an aspect of Twitter that was (mostly) a good thing.

@marcoarment I’ve seen some CPAs on #taxtwitter apply it to making some automated tools for writing responses to tax questions based on training from the IRS database but mostly it has seemed pretty silly.

For those from #TaxTwitter just coming over to Mastodon a few hints. First, be sure to boost posts from others posting tax content. Boosting is like retweeting, but here it's important because that's the easiest way for your followers to find and be able to follow those you have found.
Favoriting a post only tells the person that posted you like the post--it won't otherwise show up or make the poster visible to your followers.

There is so much happening on the bird app of late that folks from #TaxTwitter have been looking for a way to connect on other platforms.

IRS has announced they will put challenged listed transactions back onto the list using a notice and comment period for proposed regulations, beginning with the syndicated conservation easement transaction found in Notice 2017-10.

The IRS in Announcement 2022-28 announced that they are issuing the guidance in Notice 2017-10 as proposed regulations.
The Tax Court in Green Valley Investors v. Comm., 159 TC No. 5 (2022) ruled that the using of the Notice to add the conservation easement transaction as a listed transaction was in violation of the Administrative Procedures Act.

The revised Form 1120-S Schedules K-2 and K-3 instructions came out yesterday with the same changes we saw on the Form 1065 version. This one is dated December 5.
So, if you meet the "no/limited foreign activity" test, you can send out the notification that no Schedule K-3 will be provided unless requested as an attachment to the Schedule K-1.

If you were waiting on some quasi-official word from the Arizona Department of Revenue on how to compute the Arizona elective passthrough entity tax, the forms are online for 2022.

Wrote up the revised instructions for K-2 and K-3 that came out on Friday. The changes appear to make the domestic filing exception more workable (but still not one that all will use automatically).

Second draft of Schedules K-2 and K-3 for Form 1065 was issued on Friday. Major changes made to original draft of Schedule K-2 and K-3.
1. Gets rid of the January 15 notice date. Now the notice is provided no later than WHEN THE PARTNERSHIP FURNISHES THE K-1 TO THE PARTNER. and can be an attachment to the K-1 and
2. The "1-month" date moves to August 15 (not February 15).Continues in the thread.

This week's video/audio tax update looks at the IRS's first guidance on an IRA 2022 issue and a case where the taxpayer made a large number of all too common mistakes dealing with a partnership interest and real estate activities.

@PCMag This one is bad, especially if the Department lacks the logs or other technical means to really know if this one had been exploited. I think anyone with information in that database should assume it has been exploited, not just those whose accounts the security researcher showed he could access.

This is one of those cases where the Tax Court just keeps piling on reasons why the entire loss claimed is going to be disallowed:
No required documentation for automotive expenses and the car wasn't owned by the partnership.
No evidence of basis in the partnership interests
No evidence of any amount at risk
2 of the rentals weren't owned by the partnership
Taxpayers weren't real estate pros
Taxpayers couldn't show material participation -
The IRS has issued the first bit of guidance on IRA 2022 provisions, this one on the prevailing wages and apprenticeship requirements that generally gains a more favorable tax result if they are met for various provisions.
There's a lot more the IRS has to get out for various provisions from IRA 2022, so get ready to go through a lot more guidance.

You've got to wait six months before filing suit after sending in the claim for refund to the IRS. Amusingly, in this case, the taxpayer has her suit dismissed (without prejudice) on the exact day that the six month period expires--so she could immediately (and properly) file again to go back to court. #Taxodon #TaxTwitter
