#ClarenceThomas asked #Katyal if his argument wouldn’t also apply to #embargoes. Katyal said it did not, since #tariffs are ways of regulating revenue.
“Embargoes stop the shipment, tariffs start the tax bill. ...Tariffs are constitutionally special because our founders feared revenue raising, unlike embargoes,” Katyal said. “You know, there was no ‘Boston Embargo Party,’ but there was certainly a Boston Tea Party.”#SCOTUS #law #PartisanCourt #ActivistCourt #AbuseOfPower #Trump #economy

New study: "Open access publishing: is urology ready? A survey of authors, readers, and editorial board’s knowledge, impressions and satisfaction."
https://link.springer.com/article/10.1007/s00345-025-05928-3
(#paywalled)Not a good way to run a survey or report the results.
* The results are paywalled.
* The article does not include the survey questions.
* The survey defines #GoldOA, #GreenOA, #DiamondOA, and #HybridOA. But the article only reports the attitudes toward APC-based gold OA. No surprise, they're negative. Yet disdain for #APCs only strengthens the reason to ask about green and diamond OA. If the survey did ask, then what are the answers? If it didn't ask, then why not?
* The survey gives a false definition of green OA, saying that it's always embargoed. That's especially odd since under current US federal agency policies, it's never embargoed. -

The American Chemical Society (#ACS) is proud of a new business model for #hybrid #journals. Payor institutions get "full reading access" & their authors get the right make their ACS articles #GreenOA without #embargoes.
https://www.acs.org/pressroom/newsreleases/2024/june/acs-publications-and-french-consortium-together-support-open-access-publishing.htmlPS: This is not a good deal. It asks universities to pay for the right to ensure unembargoed green OA. But rights-retaining #authors & #universities already have this right. Another argument for #RightsRetention.

Update. Kudos to the Association of Health Care Journalists (#AHCJ) for its campaign against the #NEJM embargo against news outlets serving physicians. #NEJM just dropped the embargo.

"The New England Journal of Medicine (#NEJM) is cutting off certain publications from advanced access to its embargoed journal articles. News outlets that report for physician readers will no longer meet criteria for embargoed access."
https://www.medpagetoday.com/special-reports/exclusives/109756PS: In other words, the readers who most need unembargoed access (for patient care and clinical application) will be denied unembargoed access.

New study: "Within 3-5 years from their publication, two-thirds of #ClinicalTrials published in the top medical journals lifted the #embargoes for #data sharing that they had stated in their original data sharing statements. This shift toward greater openness is a positive development."

Dropping #embargoes accelerates research. It helps authors and their new work reach readers faster. It helps readers find and read new work faster, and that includes readers who happen to be journalists. Once research is ready to share, artificial delays in sharing it are an artificial brake on applying and building on that research. Dropping embargoes is esp important for time-sensitive research, such as developing tests and vaccines during a pandemic. -
Update. The #EuropeanCouncil just adopted the #OpenScience proposal anticipated earlier this month (this thread, above). No #embargoes. No #APCs. #Nonprofit publishing. #OpenLicenses. #OpenInfrastructure. https://www.consilium.europa.eu/en/press/press-releases/2023/05/23/council-calls-for-transparent-equitable-and-open-access-to-scholarly-publications/
While this is not yet policy, it's a weighty recommendation to the Commission and member states.

This is big. No #embargoes. No #APCs.
"The #EU is ready to agree that immediate #OpenAccess to papers reporting publicly funded research should become the norm, w/o authors having to pay fees & that the bloc should support #nonprofit scholarly publishing models.
In a move that could send shockwaves through commercial scholarly #publishing, the positions are due to be adopted by the Council of the EU member state governments later this month."

3/ They also support repository-based (#green) #openaccess for authors, whether or not their research was funded and whether or not the funder had an OA policy. The permission for green OA can come from authors, not publishers, and can disregard publisher attempts to require #embargoes.
They help universities get all articles by affiliates into their OA repositories, not just those subject to funder policies.

There is an important discussion developing around the question of whether the authors of observing proposals for space missions should be allowed exclusive access to the data for a proprietary period. The latest NASA policy document, under paragraph VI C would seem to say no.

NASA just released an important update to its open science policies.
