I just used my institution's subscription to read this #paywalled article from #Sage.

When the Sage platform recognized that I was an authorized user, it asked me to click my consent to its terms of use before showing me the article text.

First, I've never seen that before.

Second, one of the terms purports to waive my fair-use rights. "Except as expressly permitted by this Agreement or your separate Access Agreement(s) or other agreement(s) (if applicable) or Sage's Article Access Sharing policy, you may not…copy any portion of the Site and/or Services."

BTW, it would take wide consultation and at least a full day for me to figure out whether any "separate Access Agreement(s) or other agreement(s) (if applicable)" create exceptions allowing me to copy short passages "for purposes such as criticism, comment, news reporting, teaching… , scholarship, or research" -- to quote 17 USC §107, the US statute on fair use.

* The author says her team paid for the APC "to comply" with the NIH policy. Untrue. Complying with the NIH policy is free of charge. They paid the APC to publish in Nature Medicine.

* The author says that APCs "pose barriers to making NIH-funded research available to the public." Untrue. NIH makes funded research available to the public through #PubMedCentral (#GreenOA) no matter where the author chooses to publish and no matter whether the author chooses to pay an APC.

Here's a #paywalled article with a truncated #OpenAccess abstract. You can tell from the title that the author has some objections to #OpenData ("a good idea that can be taken too far"). But the free version of the abstract doesn't tell us any of those objections. It starts by listing the benefits of open data and then cuts off.
