    Un jurado federal de Florida declaró culpable a un empresario de Oklahoma por un esquema que intentó defraudar a Medicare, TRICARE y CHAMPVA con reclamaciones falsas de equipos médicos por más de 30 millones de dólares.

    Un jurado federal del Distrito Medio de Florida declaró culpable al empresario y quiropráctico Mark Loftis, originario de Oklahoma, por participar en un esquema que intentó defraudar a los programas federales Medicare, TRICARE y el Programa Civil de Salud y Medicina del Departamento de Asuntos de Veteranos (CHAMPVA) por más de 30 millones de dólares mediante la emisión de órdenes médicas falsas para equipos que los pacientes no necesitaban.

    De acuerdo con el Departamento de Justicia de Estados Unidos (DOJ), el acusado utilizó información médica y personal de personas mayores y con discapacidad para generar órdenes fraudulentas de aparatos ortopédicos y monitores continuos de glucosa, con las que posteriormente se presentaban reclamaciones a programas federales de salud.

    El caso forma parte de la estrategia del gobierno estadounidense para combatir el fraude en los programas públicos de atención médica y proteger recursos destinados a adultos mayores, militares y veteranos.

    Esquema operó durante tres años

    Según la investigación presentada durante el juicio, Mark Loftis, de 39 años y residente de Cushing, Oklahoma, pagó más de un millón de dólares a empresas de mercadotecnia vinculadas con centros de llamadas para obtener información personal y datos de seguros médicos de miles de personas.

    Las víctimas eran convencidas de proporcionar sus datos, los cuales posteriormente eran utilizados para obtener órdenes médicas firmadas por médicos y enfermeros que prestaban servicios de telemedicina, pero que en la mayoría de los casos nunca examinaron ni hablaron con los pacientes.

    Con esos documentos se gestionaban reclamaciones por equipos médicos que los beneficiarios no habían solicitado ni requerían.

    Las autoridades señalaron que Loftis también ocultó la participación de uno de sus principales colaboradores dentro de su empresa y utilizó reclamaciones vinculadas con proveedores médicos que no tenían relación con la compañía.

    Obtuvo más de ocho millones de dólares

    La investigación federal determinó que el empresario obtuvo más de ocho millones de dólares mediante reclamaciones falsas dirigidas a programas federales de atención médica.

    Durante el juicio también se expuso que el esquema continuó operando durante aproximadamente tres años, pese a las constantes quejas presentadas por beneficiarios y familiares que informaban que algunos pacientes padecían demencia o enfermedad de Alzheimer, condiciones que los convertían en personas especialmente vulnerables.

    Enfrenta hasta 20 años de prisión

    El jurado declaró culpable a Mark Loftis por los delitos de conspiración para cometer fraude contra el sistema de salud y fraude electrónico.

    La audiencia para dictar sentencia fue programada para el 7 de octubre de 2026. De acuerdo con la legislación estadounidense, el acusado enfrenta una pena máxima de 20 años de prisión, cuya duración será determinada por un juez federal conforme a las Directrices de Sentencia de Estados Unidos y otros criterios legales.

    Investigación reunió a varias agencias federales

    El caso fue investigado por la Oficina del Inspector General del Departamento de Salud y Servicios Humanos (HHS-OIG), el Buró Federal de Investigaciones (FBI), el Servicio de Investigación Criminal del Departamento de Defensa (DCIS) y la Oficina del Inspector General del Departamento de Asuntos de Veteranos (VA-OIG).

    La acusación fue presentada por la fiscal adjunta interina Catherine Wagner y el abogado litigante Raymond Beckering III, de la Sección de Fraude de la División Penal del Departamento de Justicia.

    El Departamento de Justicia informó que este proceso forma parte de las acciones emprendidas por su nueva División contra el Fraude, creada en abril de este año para investigar y perseguir delitos que afectan programas federales.

    Además, recordó que el Programa de Grupos de Trabajo contra el Fraude en la Atención Médica ha presentado cargos contra más de 6 mil 200 personas desde 2007, en casos que involucran reclamaciones por más de 45 mil millones de dólares a programas federales de salud y aseguradoras privadas. –sn–

    "Last Friday, federal immigration agents swept through the garment district of Los Angeles, setting off protests that have rattled sections of downtown L.A. and have spread to a number of cities across the country.

    "For #farmworkers — about 42 percent of whom are undocumented, according to the Agriculture Department — the escalation in arrests has created widespread fear.

    " 'Children are terrified,' Ms. Romero said. 'They don’t want to go to school because they don’t know if their parents will be home when they come back.'

    "Local leaders have rebuked the escalation, which could bring hardship to one of California’s agricultural corridors.     "The raids this week represent the first organized immigration enforcement from the new Trump administration to hit California’s agricultural region, which covers about 40 percent of the state, Ms. Romero said. A handful of federal operations have been conducted in other rural communities in recent weeks. Last month, federal agents pulled over a bus in #AlbionN., and detained 14 immigrants who worked at a nearby farm. In April, three children and their mother were detained at an upstate New York dairy.

    "Rural migrants are particularly vulnerable to immigration enforcement because they stand out in towns that are often racially homogenous, said Will Lambek of Migrant Justice, an advocacy organization for farmworkers in #Vermont, where eight dairy workers were detained in April.

    "In California, Ms. Davalos said the agents could have made more arrests had the community been less prepared. Once a volunteer spotted officers in the area, an alert was sent through a network of support.

    "Federal agents were denied entry to at least nine farms in the Central Coast, Ms. Davalos said. Some growers parked their vehicles in front of their gates. Employees also obscured their cars.
    'We demonstrated the power of brave, nonviolent #resistance to #ICE’s tactics of #terror,' Ms. Davalos said, lamenting what she described as politically driven attempts to reach a deportation quota. 'At the end of the day, they’re seizing our family, friends, neighbors and co-workers.'

  34. CW: Medical politics - having to pay for useless appointments

    The #GrattanInstitute in #Australia has recently released a report recommending #Medicare be updated as it no longer serves patients or medical professionals. This probably surprises no-one, particularly people with #ChronicIllness and in my opinion is well overdue.

    Something that I think needs a lot of thought however is the current situation where patients are still expected to pay for services that provide zero value or in some cases cause harm. Too often I have had absolutely useless appointments with #Doctors who are ill informed on my disease (#MyalgicEncephalomyelitis) and can provide no benefit or recommendation for my illness yet I am still expected to attend these appointments/referrals and pay for them.

    The current system is stacked against patients struggling not only with chronic disease but also financially, adding further to their costs and providing no incentive for doctors to update their knowledge since they'll get paid anyway. Surely the system should do the opposite and encourage doctors to keep up to date and adopt and/or develop best practice if they expect to be reimbursed for their knowledge.
