Democracy defenders and advocates for the rule of law were elated when the indictment of former president Donald Trump was unsealed, revealing a damning array of evidence that should finally vindicate the principle that the law applies to presidents and ex-presidents just as it does to all other Americans. Elation was tempered, however, when Judge Aileen M. Cannon’s name appeared on court documents. She infamously botched a civil case brought by Trump to recover the very same documents now at issue in the criminal case, a decision so lacking in logic and precedent that the U.S. Court of Appeals for the 11th Circuit swiftly repudiated her ruling and sent Trump packing.
The 11th Circuit’s ruling was particularly dismissive in reversing Cannon: “The law is clear. We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so.” Specifically, the panel held she didn’t have jurisdiction and should not have ruled on the case.
To make matters worse, in the civil case, Cannon posited that Trump deserved special treatment because he is a former president (“[a]s a function of Plaintiff’s former position as President of the United States, the stigma associated with the subject seizure is in a league of its own”). A judge who begins with the unconstitutional premise that Trump is not subject to the law like any other defendant would have a hard time sustaining public faith in the process. Any rulings for Trump would be regarded as evidence of bias; rulings against would be seen as efforts to restore her shattered reputation.
Because Cannon seemed to be leaning over backward and/or operating untethered to basic criminal procedure, some lawyers have questioned if she should recuse herself under the U.S. code that requires a judge to “disqualify himself in any proceeding in which his impartiality might reasonably be questioned.” Legal scholars have pointed to precedent for recusal “if facts connected to the judge’s actions in the case would cause an objective observer to doubt the fairness of the proceedings," as Norman L. Eisen, Richard W. Painter and Fred Wertheimer wrote in Slate.
Constitutional scholar Laurence H. Tribe told Newsweek: “Judge Cannon’s rulings in favor of Donald Trump’s motion to suspend the criminal investigation … including her appointment of a special master to undertake a review that had no basis in law, certainly fits that test by establishing a strong basis for questioning her impartiality, entirely apart from the aggravating factor that she was appointed to her lifetime position on the federal bench by defendant Donald Trump.”
Other legal scholars agree. (As Stephen Gillers put it, “Now, the fact that a judge’s impartiality might reasonably be questioned doesn’t mean that the judge is partial. The public may simply not trust the impartiality of the judge. Because public trust in the work of the court is a value as important as the work itself, the rule says that the judge should not sit when we can’t fairly ask the public to trust what the judge does.”)

A trial judge has immense discretion on everything from pretrial rulings excluding evidence to empaneling a juror to dragging out the proceedings. In the case of delay, Cannon could deny the American people a verdict in advance of the 2024 election. Some erroneous decisions might be reversed on appeal, but others (e.g. seating a juror who practices jury nullification) could be hard to correct on review. Moreover, the need for consistent intervention by the 11th Circuit could turn the case into a multiyear affair. None of this benefits the federal bench (specifically the 11th Circuit), the rule of law or the American people.

But the risk that a wildly misguided and slipshod judge could have reformed is far too great to entrust her with the most important criminal case in our lifetimes. She and the 11th Circuit owe both Trump and the American people an expertly run trial free from the appearance of bias." -

Poetry and music from the film ‘Wings of Desire’ (Der Himmel uber Berlin)
One of my favourite films of all time is the Wim Wenders film The Wings of Desire known in German as Der Himmel uber Berlin. It won the Best Film at Cannes in 1987.
Some of the magic of this film comes from the music (Nick Cave, U2), the acting (Bruno Ganz, Solveig Dommartin) and also from the poetry (Peter Handke) which is scattered throughout the film. The German poet Peter Handke is responsible for some of this evocative poetry, which is haunting and stays with you, lulling you into a dreamy state between sleep and waking.
I have never found German to be particularly pleasing to the ear, but this film made me hear the beauty in the language. Here are some of Peter Handke’s poems from the film along with excerpts from the film. I hope you enjoy them and are inspired to watch the entire film, Wings of Desire is a masterpiece.

Bruno Ganz plays a lonely angel who roams the streets of Berlin and provides comfort to mortals in need. In this scene, he materialises on the street to attend a motorcycle accident and remind a dying man of the eternal memories in his psyche, and perhaps of collective memories. These are beautiful moments, sublime voices and images.

Wings of Desire – Music by U2 and Nick Cave
Wim Wenders, the film’s director, is known for using evocative music in film as well. He famously used Nick Cave the Bad Seeds in a scene of the film (the band were living in Berlin at the time). U2 also recorded one of their most underrated songs ‘Faraway (So Close) for the film as well. For the band themselves, this song has still remained a solid favourite and a classic and yet is still one of the lesser known U2 songs of the 80’s.

Generally speaking, any equivalence relation induces a partition of the underlying set of elements, known as the “domain” or “space” of the relation, into a family of equivalence classes. In the case of a SER the equivalence classes are called “semiotic equivalence classes” (SECs) and the partition is called a “semiotic partition” (SEP).
The sign relations L_A and L_B have many interesting properties over and above those possessed by sign relations in general. Some of those properties have to do with the relation between signs and their interpretant signs, as reflected in the projections of L_A and L_B on the SI‑plane, notated as proj_{SI} L_A and proj_{SI} L_B, respectively. The dyadic relations on S×I induced by those projections are also referred to as the “connotative components” of the corresponding sign relations, notated as Con(L_A) and Con(L_B), respectively. In the pragmatic theory of sign relations, connotative references fall within the projection of the sign relation on the plane spanned by its sign domain and its interpretant domain.
In the full theory of sign relations the connotative aspect of meaning includes the links a sign has to affects, concepts, ideas, impressions, intentions, and the whole realm of an interpretive agent's mental states and allied activities, broadly encompassing intellectual associations, emotional impressions, motivational impulses, and real conduct.
Taken at the full, in the natural setting of semiotic phenomena, this complex system of references is unlikely ever to find itself mapped in much detail, much less completely formalized, but the tangible warp of its accumulated mass is commonly alluded to as the connotative import of language.

• The dyadic relation resulting from the projection of L on the OS‑plane O×S is written briefly as L₁₂ or written more fully as proj₁₂(L) and is defined as the set of all ordered pairs (o, s) in the cartesian product O×S for which there exists an ordered triple (o, s, i) in L for some element i in the set I.
In the case where L is a sign relation, which it becomes by satisfying one of the definitions of a sign relation, some of the dyadic aspects of L can be recognized as formalizing aspects of sign meaning which have received their share of attention from students of signs over the centuries, and thus they can be associated with traditional concepts and terminology.
Of course, traditions vary with respect to the precise formation and usage of such concepts and terms. Other aspects of meaning have not received their fair share of attention and thus remain innominate in current anatomies of sign relations.

In his picturesque illustration of a sign relation, along with his tracing of a corresponding sign process, or “semiosis”, Peirce uses the technical term “representamen” for his concept of a sign, but the shorter word is precise enough, so long as one recognizes its meaning in a particular theory of signs is given by a specific definition of what it means to be a sign.
