Too Little, Too Late: #Flock Admits Their Technology Needs Reforms
"To be clear, [#EFF] position has long been that police, at a minimum, need to get a warrant, signed by a judge, in order to search for historic #ALPR data regarding specific vehicles. For us, it's common sense: if police want to dip into historic ALPR data like they were going back in time to retroactively follow your comings and goings, they need a #warrant." https://www.eff.org/deeplinks/2026/08/too-little-too-late-flock-admits-their-technology-needs-reforms -

Here's some local reporting, encouraging those in the Poconos to recognize and report Flock cameras wherever they see them.
They mention WaPo's reporting that over 50 police have been charged with using Flock surveillance for stalking personally. In Georgia alone, 18 such arrests have been documented.

The “# 3 guy at DOJ ‘wanted to ping’” Comey’s phone without a traditional #warrant, according to the filing, a request that’s typically used only when an emergency — a dangerous, fleeing suspect, for instance — requires immediate action.

Let's talk about Sam #Tunick. Sam is an #Atlanta activist with Defend the Atlanta Forest, aka Stop Cop City. SCC had great #infosec, and the feds were hoping to bypass need for a #warrant by using border patrol. Most news stories are missing the fact that this was an #FBI action using #ICE as cover.
FBI Joint Terrorism Task Force Officer Burnham and Special Agent Andrea Coble arranged for US CPB to question him and search his phone when he landed.
The unidentified searching officer in the indictment serves on #CBP Tactical Terrorism Response Team, which allegedly gave FBI access to a search power they would not ordinarily possess inside the country.
Sam was refused an attorney and told he couldn't enter the country until "those guys were done with him", or he unlocked his phone...so he gave them an unlock code that wiped the phone. Now they are charging him with "destruction of evidence".

The #FourthCircuit Says #Border Agents Can #Search Your #Phone By Hand, No Suspicion Required
The Fourth Circuit issued a disappointing opinion in U.S. v. Belmonte Cardozo, a case in which @eff filed an amicus brief, alongside the national #ACLU, its #Maryland , #NorthCarolina , #SouthCarolina , and #Virginia affiliates, and the National Association of Criminal Defense Lawyers (#NACDL ).
We argued that electronic device searches at the border should require a #warrant based on probable cause, but at minimum, regardless of whether an officer searches by hand or with #forensic software that plugs into a device and downloads its entire contents for search, the same #FourthAmendment standard should apply to all device searches at the border.

US Police Now Armed With #Israeli #Spy Vans Simulating #MobilePhone Towers
If you thought #Flock was bad check out #Falconet. Falconet from Israeli company #Cognyte serves as a cell tower simulator that intercepts cell phone data from all devices within range. #Police mount these systems in Tahoes so the vehicles can collect information while driving through areas without any direct interaction with targets. This mobile approach generates ongoing records of phone locations and communications for everyone nearby rather than only suspects, which creates comprehensive movement profiles and bypasses traditional #warrant requirements under the #FourthAmendment.

You Opened a #CreditCard. #ICE Now Knows Where You Live
When you open a new credit card, you necessarily give the credit card company your address. You probably expect that information to remain with your bank.
But when you open a new credit card or change your address on file, your address leaves your credit card provider, travels through a web of middlemen companies, and ends up with Immigration and Customs Enforcement (ICE), which can then search, analyze, or pair that data with other pieces of information about your life without a #warrant.

Houston! We still have a 4th Amendment!
The U.S. Supreme Court ruled that “an individual has a reasonable expectation of privacy in his cell-phone location information.”
Simply stated the ruling makes clear - the 4th Amendment, which protects against unreasonable searches and seizures and effectively protects privacy rights, APPLIES to LOCATION DATA collected from from cellphones.
Authorities need to obtain a search warrant when asking tech companies for the location data of their users, including when requesting historical geofence location data.
NOTE: some service providers (Google) store users’ location data locally on their devices prompting investigators to go to the users themselves to access this data. https://techcrunch.com/2026/06/29/in-major-privacy-win-supreme-court-rules-geofence-warrants-are-protected-by-privacy-rights/ #SCOTUS #GeoFencing #GeoFenceData #Mobility #MobilePhones #Privacy #Search&Seizure #Warrant #LocationData #4thAmendment #Constitution #PrivacyRights #DataPrivacy #SearchWarrant #LawEnforcement
