  4. @EdwinG @jfmezei Québec *claims* to have unilaterally inscribed into that article into the Constitution. It baffles me that the feds would include article 128Q.1 on the web version of the Constitution. (Same for sections 90Q.1 and 90S.1.)

    The oath of allegiance is, de facto, an oath to uphold the laws of Canada and to function within our constitutional system. Parliament in the UK has a similar requirement for MPs.

  5. @virtuous_sloth When the first PQ MNAs were elected in 1970, they refused to take the oath, and the National Assembly refused to let them sit. #RenéLévesque told them to take the oath, and there was no question about their legitimacy thereafter.

    This time is different because when the new PQ MNAs refused the oath, the National Assembly accepted them anyway. Later the National Assembly passed a law purporting to abolish the requirement of the Constitution for their members.

  6. @virtuous_sloth It's even possible that *none* of the MNAs will swear the oath of allegiance after the next election. [0] If they had previously sworn it, are they still valid?

    In the 19th Century, there was a Canadian MP who participated in Parliament without having taken the oath. When that was discovered, Parliament went back and subtracted his vote from past decisions — it changed nothing.

    [0] Standing up for constitutional norms and tradition doesn't win many votes in Québec.

  7. There is, to be clear, a real possibility that the National Assembly *does* have the legal power to ignore the Constitution and set its own rules for who may sit as a deputy; parliamentary supremacy is an important principle in a government founded on the British constitutional model.

    But we don't want to discover in 2028 that none of the laws passed by Québec since this Fall's election are valid.

    Put aside the issue of the Canadian monarchy — the real question here is whether the National Assembly can unilaterally ignore (or modify) the Constitution of Canada. If they can't, then the acts of the next government in #Québec may be illegitimate. We need the courts to decide, and quickly.
