    #Carroll v. #Trump (20-cv-07311) District Court, S.D. New York courtlistener.com/docket/18418

Trump appealed and lost. Carroll v. Trump (20-cv-07311) District Court, S.D. New York courtlistener.com/docket/68985

    2025/06/15 Doc 124 / Doc 130

    > we conclude that the motion [to substitute the #DOJ for Trump in the appeal *after* it was fully briefed] is statutorily barred by the text of the Westfall Act, that both Trump and the government waived any right to now move for substitution by failing to timely petition the District Court, and that, in any event, principles of equity warrant denying the belated motion.

    2025/09/05 Doc 134

    > neither Trump nor the Department of Justice advanced any argument related to the Westfall Act until after [the District] trial concluded.

    > Trump filed his answer to Carroll's complaint in New York state court in February 2020. He did not assert absolute presidential immunity in his answer -- a fact that Trump's counsel later "conceded at oral argument" in the interlocutory appeal.

So he asked the Supreme Court to overturn both of these decisions:

    26-141

① hoping that magical Presidential immunity can't be accidentally mislaid like all affirmative defenses

② hoping that every word out of his lying mouth is an official act — which not even the pope claims for himself.

③ hoping that a time machine would make it so it was the United State spreading lies about Carroll instead of Trump.

    26-142

④ hoping the court of appeals was wrong when it denied the Pam Bondi's DOJ a time machine. #LinearTime

“Labor right” simply means full on #NeoLiberalism , an insult to the Party’s workers roots. I’ve also seen #Carroll described as a “Centrist”, whatever that means anymore…

  7. Aside from drawing a line in the sand on the #Corruption issue (a good thing), the new #Labor premier of Victoria has made the same lazy declarations that are made by #Clueless govts all over Australia:

“Carroll is also pledging to be more pro-business and tougher on crime.”

Business support and Tough on Crime, we’ve only been spared the BS on Immigration… and this is supposed to be a #Labor govt? So the rot has spread from #AlboPM ‘s federal #NeoLiberalism to #Victoria (It’s been ensconced in #NSW for years; alive and blundering along in #QLD).

Goodness me folks, are we going to re-elect these dimwits to govt? Or are we really going to take the fight up to the major parties by voting anyone else but #labor and #LNP ? Nor, if I need to mention it, #PHON — we’re not THAT desperate.

  9. @BrianJopek While I agree that this appears to be $5.6+ million¹ of Trump’s cash, you phrased it like a volitional act when he is pleading with the Supreme Court and a separate appellate court to overturn the jury verdict and the district judge’s order to disburse the cash the court was holding in lieu of a bond for the multi-year appeal.

    ————

¹ $5,625,005.48 via electronic funds transfer on 2026/07/13 as per earlier court order from funds held by the court and originally deposited by #Trump when he sought to appeal the jury verdict in lieu of a bond. This seems to be Trump’s very own cash being paid. So, a date for the history books.

  15. #Carroll v. #Trump (22-cv-10016) District Court, S.D. New York is commonly referred to as Carroll II, as it is the second #defamation case filed by Carol filed against Trump, even as it was the first decided on 2023/05/11 (Doc 178).

    courtlistener.com/docket/65895

Trump appealed. He asked for a new trial. He went to the Supreme Court. Denied.

2026/07/08 Doc 243, the court orders the almost $6 million held by the court during the appeal. Trump agreed to this, but appealed saying there is still a chance Supreme Court justices will change their minds on the basis on no new facts. The administrative stay was denied.

Carroll v. Trump (20-cv-07311) District Court, S.D. New York
    courtlistener.com/docket/18418

This was decided on 2024/02/08 (Doc 285) and with interest almost $100 million is due pending exhaustion of appeals.

Why the difference? Perhaps the jury didn't care for Trump's attitude at trial. Perhaps they thought since the face of the assault was decided, he should have taken steps to reduce his culpability. Maybe they though they had evidence that a lesser penalty wouldn't dissuade him.

  21. An overview of today's supreme court rulings

The supreme court ruled that Donald Trump’s firing of #Federal #Reserve governor
    Lisa Cook was unconstitutional,
in a landmark ruling that limits a president’s authority over the central bank.
In its opinion, the court said that Trump does not have the constitutional authority to fire a Fed governor without cause.
The ruling is a major win for the central bank, which has spent the last year under attack from the White House.

But, in a separate case, the justices ruled that Trump can #fire leaders of #independent #agencies or commissions,
ending 90 years of court precedent that curbs executive power.
That case centered on Rebecca Slaughter, whom Trump fired as Federal Trade Commission member in March last year over email,
telling her that keeping her as a commissioner would be “inconsistent with [the] administration’s priorities”.

The court handed Trump another loss, refusing to hear his bid to overturn a $5m verdict in favor of E Jean #Carroll
in a case in which a jury found him liable for #sexually #abusing the former magazine columnist and then #defaming her.
The 2023 jury verdict and a $5m civil judgment remain in place.

The high court declined to take up the case in a brief, unexplained order.
    There were no noted dissents.

The supreme court sided against national Republicans and the Trump administration to allow #mail-in #ballots that arrive after election day to be counted, upholding the law in more than a dozen states.
The Republican National Committee had challenged a Mississippi state law allowing mailed ballots to be counted if they arrive within five business days of election day, so long as they were postmarked by election day.
The court’s liberal justices pointed to federal laws that allow for grace periods, while noting that a ruling here could also implicate early voting, another common practice.

The court also refused to revive a $300m #defamation lawsuit filed against #CNN over its coverage of a prominent attorney’s remarks made while defending Trump during his 2020 impeachment.
Alan Dershowitz said CNN aired only a portion of the comment made during his defense of the president,
distorting his meaning to make him look like he’d “lost his mind”.
The network said that multiple outlets had interpreted his remarks in a similar way, and Dershowitz couldn’t show CNN was trying to mischaracterize what he said.
The court’s majority declined to take up the case in a brief, unexplained order.

And finally, the supreme court threw out a judicial decision involving a Virginia man’s challenge to a #geofence #warrant used by police to access cellphone location data near a crime scene leading to his conviction for armed robbery.
The justices threw out a lower court’s ruling against defendant Okello Chatrie, who had argued he was subjected to an illegal search
and that evidence in his case should be excluded.
The court agreed that a search had occurred, but sent the case back to a lower court to conduct further analysis.
