Despite explicit calls to "burn Gaza" and "completely destroy" Palestinian cities, Israel's AG won't investigate Finance Minister #Smotrich and MK Vaturi, claiming their statements were "vague" and protected by parliamentary immunity. This decision came just three days before the ICC issued arrest warrants for #Netanyahu and #Gallant.
[…] Attorney Itay Mack, who complained against Vaturi and Smotrich on behalf of human rights organizations to the Attorney General and State Prosecutor, told Haaretz today that "Vaturi called several times to burn Gaza and explained that there are no innocent people there. These are statements that are outside the framework of protected freedom of expression, and the justification for not conducting an investigation against him due to freedom of expression is like 'adding sin to crime'." According to Mack, "The Attorney General and State Prosecutor are giving approval and normalizing inciting statements by Jewish elected officials." He added, "More seriously, they are practicing selective racist enforcement - for Jewish elected officials, incitement is part of freedom of expression, and for the non-Jewish public, a similar statement would lead to investigation and even arrest and indictment."

#GazaGenocide / Israel has submitted an objection to the investigation against it at the Hague and claims that the prosecutor's request for a warrant of arrest is not lawful
[...] Israel argues that the International Criminal Court in The Hague does not have jurisdiction over issues related to the Israeli-Palestinian conflict, including due to the Oslo Accords. In addition, Israel claims that the court should allow it to investigate the allegations raised by the prosecutor itself.
[...] The prosecutor, Karim Khan, has been accused by #Israel of not following the principle of #complementarity. According to Israeli law, if the prosecutor opens a new investigation, he must notify the state being investigated and inform it of what he is investigating. The state has the option to return to the court within a month and show that it is investigating the same issues - then the prosecutor's investigation will be suspended or terminated.

#Israel / Israel's High Court Cannot Hold Back the Legal Avalanche Against the Occupation
For too long, #Israel's legal system distorted international law norms and whitewashed crimes committed by soldiers and settlers against Palestinians through lack of accountability. The emerging "legal avalanche" against Israel from international bodies is a consequence of its judiciary insisting on enabling violations of the laws of occupation for decades.
Rather than a “judicial overhaul” planned and payed for by right-wing American Jews - many of whom support the occupation - what’s needed in Israel is a meaningful legal reform to create accountability and regain credibility in line with international standards. Otherwise, Israel's #complementarity claims will continue ringing hollow to the #ICC, among others.

- Israeli agencies intercepted communications of ICC prosecutors Fatou Bensouda and Karim Khan, providing Netanyahu advance knowledge of their intentions. Bensouda was allegedly personally threatened by then-Mossad chief Yossi Cohen.
- Israel held secret back-channel meetings with the ICC using intelligence to try to undermine the Palestinian territories case, arguing Israel's military investigates itself properly.
- The U.S. under #Trump imposed sanctions on ICC officials over the Afghanistan probe, believed partly aimed at the Palestinian case, working together with Israel against the ICC.
- Despite intense pressure, Khan proceeded with seeking arrest warrants against #Netanyahu and #Gallant over alleged extermination, starvation and deliberately targeting civilians in Gaza.
