“The traditional “pipeline” model of workforce development - whereby an individual follows a fairly linear, predictable, and structured path through K–12, undergraduate, and graduate education into career-length government or academic positions - no longer captures the reality of a modern STEM [education and then] career. Nor does it represent the broad range of interdisciplinary and innovative opportunities that STEM professions now offer across a wide range of industries, nonprofits, and other organizations. The pipeline model has also contributed to the historical exclusion of individuals from minoritized ethnic, racial, sexual and gender identity, disability, and service status...
It is time for us to dismantle the pipeline. Instead, let’s take inspiration from the natural world we study and envision a new model that captures the opportunity, variability, and responsiveness of a modern STEM career; that embraces the diversity and experiences of the people who engage in it; that recognizes the many on-ramps, pathways, and career pivots that real life induces; and that provides a framework in which there is a place in STEM for everyone. HB 3557: New criminal and civil penalties for protests around #CriticalInfrastructure
Creates new criminal sanctions and expansive civil liability for protests near pipelines and other infrastructure facilities, including those under construction. The law provides for four new criminal offenses. One, "impairing or interrupting operation of critical infrastructure facility," is defined as entering or remaining on facility property and intentionally or knowingly "impair[ing] or interrupt[ing] the operation of" the facility. The act is a state jail felony, punishable by up to two years in jail and a $10,000 fine. This provision could target peaceful protests that, e.g., hinder access to #pipelines or #pipeline construction sites. A second offense, "intent to impair or interrupt critical infrastructure," is defined as entering or remaining on facility property "with the intent to impair or interrupt the operation of the facility." The act is a Class A misdemeanor, punishable by a year in jail and a $4,000 fine. This provision could capture peaceful protests that take place near a pipeline or other infrastructure facility, regardless of whether they actually impair or interrupt the facility's operations. The law also creates two new felony offenses for "damage" and "intent to damage" critical infrastructure. Under the law, an association that is found guilty of any of the offenses around critical infrastructure is subject to a $500,000 fine. The law also creates new civil and vicarious liability for individuals and organizations related to the criminal offenses: A defendant who engages in conduct covered by any of the criminal offenses is civilly liable to the property owner, as is an organization that "knowingly compensates" a person for engaging in the conduct. The property owner may sue for and claim actual damages, court costs, and exemplary damages.

SB 2876: Heightened penalties for protesters who conceal their identity
Would increase criminal penalties that could cover peaceful protesters who choose to wear a mask. Under the bill, a protesters charged with “riot” would face more serious penalties if they were wearing a mask or other face covering with intent to conceal their identity, as compared to someone without a mask. The offense would be a Class A misdemeanor, punishable by up to one year in jail and $4,000, instead of a Class B misdemeanor. The crime of “riot” under Texas law is defined broadly and does not require violence or other unlawful conduct: The offense covers a group of seven demonstrators whose conduct “substantially obstructs law enforcement or other governmental function or services,” or whose “physical action deprives any person of a legal right or disturbs any person in the enjoyment of a legal right.” Under the bill, a protester who chose to wear a mask to avoid #retaliation for their political views could face significant jail time if their #NonviolentProtest was deemed a “#riot.”

HB 3061: Heightened penalties for masked protesters
Would increase the penalty for protest-related offenses if committed by someone wearing a mask or other disguise to conceal their identity while “congregating with other individuals who were disguised or masked.” Under the bill, the penalty for trespass, “disorderly conduct,” and “riot” would be one degree more severe if committed by a group in which some individuals wore masks. The bill provides an exemption to the penalty enhancement for masks worn during Halloween, a masquerade ball, or “similar celebration,” but not for avoiding retaliation for political speech. “Disorderly conduct” and “riot” are broadly defined under Texas law. "Many of the protesters were Native American veterans of the United States armed forces. Energy Transfer used attack dogs against peaceful protesters and war heroes. But the jury sided with the out-of-state, unlicensed security with the attack dogs, instead of North Dakota veterans who supported Standing Rock.

OAKLAND, Wis. (AP) — "Roughly 70,000 gallons (264,978 litres) of oil from a pipeline spilled into the ground in Wisconsin, officials said.
"The problem was discovered Nov. 11 in Jefferson County, 60 miles (96.5 kilometers) west of Milwaukee, by an #EnbridgeEnergy technician, the Milwaukee Journal Sentinel reported, citing a federal accident report.
"Enbridge said the spill on the company’s #Line6 was caused by a faulty connection on a pump transfer pipe at the Enbridge Cambridge Station. It was an estimated 1,650 barrels, which is equivalent to about 70,000 gallons.
"'Investigation and remediation began immediately upon discovery and continues. Removal of impacted soils is continuing,' spokesperson Juli Kellner said Saturday, adding that 60% of the spill has been removed through excavation.
"Kellner said the spill was immediately reported to regulators, though the report by a federal pipeline safety agency said the line likely was leaking for an 'extended period of time.'
"'We are working with the Wisconsin Department of Natural Resources as cleanup and restoration proceed,' Kellner said.
"Line 6 is a 465-mile (748.3-kilometer) pipeline carrying crude oil from Superior, Wisconsin, to a terminal near Griffith, Indiana, according to a company map."

Introduction
1. Peaceful demonstrations are a catalyst for the advancement of human rights. Yet around the world governments are criminalizing dissent and suppressing public #protest, often as a means to protect #CorporateInterests. In this context, indigenous peoples increasingly find themselves as the subjects of arrests, criminal prosecution and police violence when defending the lands they rely upon for their existence and survival from #ResourceExtraction by industries who are operating without the free prior and informed consent of the affected communities.
2. This report is submitted to the Inter-American Commission on Human Rights (#IACHR) in conjunction with a thematic hearing held during the 172nd period of sessions. At the hearing,
Commissioners heard directly from those involved in the indigenous-led resistance to the #DakotaAccessPipeline (DAPL) at Standing Rock, North Dakota. This report addresses the criminalization and suppression of protest by indigenous human rights defenders and their allies by United States (U.S.) federal, state and local governments, working hand-in-hand with private security forces [#Blackwater], specifically in relation to the construction and operation of #DAPL by #EnergyTransfer
Partners and Dakota Access, LLC (Dakota Access) and the connected #BayouBridgePipeline (collectively the “#BakkenPipeline”).3. Standing Rock is an emblematic case of #IndigenousResistance to extractive industry that drew attention from around the world as water protectors met on the banks of the #MissouriRiver in peaceful assembly in what was the largest gathering of indigenous peoples in the U.S. in 100 years. Standing Rock is merely one example of how the U.S. government works with industry to approve energy projects carried out without the meaningful participation or consent of
indigenous nations. Indigenous peoples are left with no choice but to peacefully protest and then are criminalized for their efforts to defend their lands and resources.4. Since Standing Rock, there has been an alarming trend by the United States government and state legislatures to criminalize opposition to pipelines and other energy projects. These #AntiProtest and so-called “#CriticalInfrastructure laws” progress towards criminalizing dissent and implicitly condone the use of excessive force towards human rights defenders, often including indigenous peoples and their allies who are at the forefront of resistance to extractive industries. As the international community has acknowledged, these laws are incompatible with domestic and international law. The governments’ use of excessive force and mass arrests to threaten, intimidate, and silence “#WaterProtectors” seeking to defend their lands, resources, and #culture, and the collusion with private security forces, violate fundamental human rights to #FreeSpeech and Aassembly enshrined in international human rights law and the #USConstitution.
5. The information provided here builds on a 2016 request for Precautionary Measures filed by the #StandingRock, #CheyenneRiver and #YanktonSioux tribes, past Commission hearings on similar matters that remain unsettled, and reports on Indigenous Peoples and Extractive Activities, and the Criminalization of #HumanRightsDefenders. In addition, the United Nations has reported on the situation at #StandingRock through the Expert Mechanism on the Rights of of indigenous peoples. Despite condemnation from these international bodies and mechanisms, water protectors continue to suffer impacts from the criminalization of their dissent, while the United States moves forward permitting new #pipeline projects on indigenous territories.

"Wet’suwet’en hereditary leaders have opposed #pipeline construction through their traditional territory since before the #CoastalGasLink pipeline project was first proposed. In December 2018, the B.C. Supreme Court issued an interim injunction to the company, which prohibited anyone from blocking pipeline access roads or work sites. A year later, on Dec. 31, 2019, the court granted a permanent injunction for the duration of the project.

"Last month, Tammen determined there was sufficient evidence to convict three #Indigenous #LandDefenders — Sleydo’ Molly Wickham, Shaylynn Sampson and Corey Jocko. They were arrested the day after Dennis and later charged with criminal #contempt. Hearings have begun into an application by the defence to stay the charges based on police conduct during the arrests.

"When Dsta’hyl was arrested, he had four batteries from heavy machinery in the back of his pickup truck, the judge said.
"'There is little dispute concerning the basic facts,' Tammen said, noting that video evidence documenting the incidents was presented during the trial.
"'Chief Dsta’hyl, acting as an enforcement officer for the Likhts’amisyu Clan, participated in the decommissioning of a piece of heavy equipment owned by a CGL subcontractor on Oct. 17, 2021. That action consisted of removing the battery from the equipment, an excavator, thus rendering it inoperable.'
"Witnesses for the defence included other #Likhtsamisyu Chiefs, who described the Wet’suwet’en traditional clan system and its role in governing the traditional territory. Among the Chiefs’ duties is preservation and protection of the traditional territory, or #yintah, Tammen said.

The project is over budget and behind schedule, with a lot of hard work left to do. Its opponents hope that makes #FossilFuel companies think twice about building the next one.

Published Jan 16, 2024"As day broke over the small mountain town of #EllistonVirginia, one Monday in October, masked figures in thick coats emerged from the woods surrounding a construction site. Three of them approached three excavators and, one by one, locked themselves to the machines, bringing the day’s work to a halt. As they did so, several dozen of their fellow protesters gathered around them, unfurling banners and chanting amid the groaning and beeping of construction equipment.
"They made their way across the field, over patches of bare earth, around sections of rusty pipe meant for burial beneath the mountain. Eventually the metal tubes will form yet another section of the Mountain Valley Pipeline, which will soon carry 2 billion cubic feet of #fracked #methane from the #ShaleFields of #WestVirginia to #NorthCarolina each day. Their breath billowed in the crisp air. Beyond them stretched a bright blue sky, and mountains tinged with yellow. The past night’s rain pooled on the muddy and compacted soil beneath their feet.
"Workers in highlighter-yellow vests and hard hats milled around, some looking amused, others frustrated. One or two engaged with the #protesters, only to be told off by an irate site manager. A few miles away at the West Virginia state line, another three dozen or so activists did much the same atop #PetersMountain. One even managed to crawl under an excavator and lock herself in place, despite the cold. The others rallied around, enclosing her in a tight, protective circle.
Some might wonder why they bothered. After all, the project is, by the Mountain Valley Pipeline company’s estimate, 94 percent complete and will be wrapped up before summer. It stalled for several years amid legal fights over various permits, but Senator #JoeManchin, a moderate Democrat from West Virginia, almost single-handedly revived it in 2022 in exchange for his support of key Democratic priorities. Since then, the Biden administration and the Supreme Court have all but assured its completion. With the approximately 303-mile pipeline approaching the final stretch after almost a decade’s work, it might seem hardly worth fighting at this point.
"A large contingent of steadfast opposition begs to differ — and will enthusiastically explain why. The pipeline is six years behind schedule, about half a billion dollars over budget, and, despite promises that it would be done by the end of last year, delayed once again. The remaining construction is over rugged terrain, with hundreds of water crossings left to bridge. The company recently postponed, shortened, and rerouted its planned extension into North Carolina, a proposal long stymied by permitting problems with the main line. And, just last month, #Equitrans, which owns the #pipeline and many others across the country, was said to be considering selling itself. The road to the pipeline’s completion remains rocky, its opponents argue, with many opportunities to make finishing it as difficult as possible.
"'We cannot let them destroy our land and water,' said a young woman named Ericka. Like many interviewed for this story, she gave only her first name out of fear of reprisal from #MountainValleyPipelineLLC, which has begun suing #protesters in a bid to silence them. She had brought her three children to occupy the land that day. 'What are we going to drink? Where are we going to live? People have to come here and stop this.'"

"To TigerSwan, the emergence of #Indigenous-led social movements to keep oil and gas in the ground represented a business opportunity. Reese anticipated new demand from the #FossilFuel industry for strategies to undermine the network of #activists his company had so carefully gathered information on. In the records, TigerSwan expressed its ambitions to repurpose these detailed records to position themselves as experts in managing pipeline protests. The company created marketing materials pitching work to at least two other energy companies building controversial oil and gas infrastructure, the records show. TigerSwan, which was staffed heavily with former members of military special operations units, branded its tactics as a 'counterinsurgency approach,' drawing directly from its leaders’ experiences fighting the so-called War on Terror abroad.
"TigerSwan did not just work in #NorthDakota. Energy Transfer hired the company to provide security to its #RoverPipeline in #Ohio and #WestVirginia, the documents confirm. By spring 2017, TigerSwan was also assembling intelligence reports on opponents of Energy Transfer and #Sunoco’s #MarinerEast2 Pipeline in #Pennsylvania.
"The documents from the North Dakota security board paint a detailed picture of counterinsurgency-style strategies for defeating opponents of oil and gas development, a War-on-Terror security firm’s aspirations to replicate its deceptive tactics far beyond the Northern Great Plains, and the cozy relationship between businesses linked to the fossil fuel industry and one of the largest law enforcement trade associations in the U.S. The impetus for spying was not simply to keep people safe, but to drum up profits from energy clients and to allow fossil fuels to continue flowing, at the expense of the communities fighting for clean water and a healthy climate.
"'For them, it was an opportunity to help create a narrative against our tribe and our supporters,' said Wasté Win Young, a citizen of the Standing Rock Sioux Tribe and the one of the plaintiffs in a class action civil rights lawsuit against TigerSwan and local law enforcement. Young’s social media posts repeatedly showed up in the documents. 'We weren’t motivated by money or payoffs or anything like that. We just wanted to protect our homelands.'"

With a major public relations crisis on its hands, the pipeline’s parent company, Energy Transfer, hired the firm TigerSwan to revamp its security strategy.
"By October, TigerSwan — founded by James Reese, a retired commander of the elite special operations Army unit Delta Force — had established a military-style pipeline security strategy.
