  6. Politico: The AI industry won a primary fight. Now its target is inspiring lawmakers nationwide.. “A super PAC network backed by artificial intelligence executives hoped to make an example of Alex Bores when it targeted him for defeat in a Democratic House primary over his authorship of a New York AI law. 7. "In 2023, 60 per cent of Australians rejected a constitutionally recognised Voice for Aboriginal and Torres Strait Islander people. A body that could only make representations, only on matters concerning the people whose ancestors have been here sixty thousand years.
"Too much, the No campaign shrieked. Division. Privilege. Special treatment.
"Nine months later, Anthony Albanese handed Jillian Segal what the Voice never dreamed of asking for. Not a right to be heard. Power. No election. No parliamentary vote. No hearing. A three year commission reporting personally to the Prime Minister, with a mandate reaching into every campus, newsroom, classroom, gallery, charity, arts contract and visa file in the Commonwealth."

  25. David Bernhardt Sets Up His Own Shop to Lobby (indirectly) For Twin Metals

I missed this June Politico story about David Bernhardt breaking with Brownstein Hyatt and setting up his own lobbying shop at 1455 Pennsylvania Avenue NW, just a block away from the White House. The former Secretary of the Interior, who oversaw Trump’s first assault on the Boundary Waters, will now run the Twin Metals lobbying game.

The most recent Senate lobbying disclosures show Brownstein Hyatt filing a termination report on July 16, after collecting $110,000 for lobbying the Senate, House, and the Department of the Interior on behalf of Twin Metals in the second quarter of this year.

Just one day before that, on July 15, the Bernhardt Group LLC filed a new registration, to lobby — not directly for Twin Metals, but for Brownstein Hyatt “obo” (on behalf of) Twin Metals LLC. The Bernhardt Group has the same arrangement “on behalf of” other Brownstein clients, including Barrick Gold, USA Rare Earth, Bakelite, Denver Water, and the Central Arizona Water Conservation District.

In these cases, the Bernhardt Group LLC will lobby for a lobbying firm on behalf of the lobbying firm’s clients. I suppose “subcontractor” is the charitable term here.

Former Brownstein lobbyists with a Twin Metals track record, including Kate Gonzales, William McGrath, and Luke Johnson, will lead the Bernhardt Group’s lobbying effort for their former lobbying firm on behalf of Twin Metals. Their declared focus will be “mine leasing issues.” The Group billed $40,000 in the second quarter for its work.

In 2023, Bernhardt wrote a self-promoting book all about accountability and the “failing” administrative state. So it’s a little odd to see the former Secretary of the Interior’s new lobbying firm enclosed like a Matryoshka doll within another lobbying firm — an arrangement that should raise serious questions about public accountability and what people like Bernhardt call the DC swamp.

Maybe this is just another small reminder that David Bernhardt and the America First crowd were never talking about public accountability; they are complaining that sometimes the DC bureaucracy cannot be brought readily to heel.

For years, this crowd has worked behind the scenes to discredit the very idea of American government while exerting power within it and influence over it; now they are also dismantling the parts that stand in their way, so that their clients and cronies can strip, hoard, and sell our natural resources, our public lands, and other public goods.

  26. A quotation from Teddy Roosevelt

Now, this means that our government, national and state, must be freed from the sinister influence or control of special interests. Exactly as the special interests of cotton and slavery threatened our political integrity before the Civil War, so now the great special business interests too often control and corrupt the men and methods of government for their own profit. We must drive the special interests out of politics.

Theodore Roosevelt (1858-1919) American politician, statesman, conservationist, writer, US President (1901-1909)

  28. Lobbyists for a coalition of six groups succeeded in getting changes into a 2021 Portman-Cardin bill governing IRS #oversight of #private #retirement #plans.

    Fact sheets provided to POLITICO
    — which a Hill staffer said the lobbyists distributed to advocate for their proposal
    — sold the changes as fixes that would help elderly Americans, such as retired government and factory workers,
who had inadvertently put too much in their retirement accounts and could face penalties from the IRS.

But the lobbyists were also targeting benefits for a different demographic.

The head of the coalition, according to his biography, specializes in tax planning for🌟 “ultra-high-net-worth clients.” 🌟

The coalition also included an advocacy group that has previously been tied to the #Koch #network
    — and which engaged in a massive lobbying campaign against efforts to restructure Puerto Rico’s debt that was owned by hedge fund managers in 2015.

Tax lawyers who reviewed the statutory changes said they would in fact
👉 make it far more difficult for the IRS to penalize supersized retirement accounts where owners avoided millions of dollars in taxes. 👈

“The lobby power of these groups is tremendous,” said Rep. Lloyd Doggett (D-Texas), a member of the tax-writing House Ways and Means Committee.

“There has been little lobby effort for [low-income taxpayers] and plenty of lobbying from those people in the financial services industry that benefit from those retirement plans

  29. Five months before Congress faced a near-catastrophic 2022 standoff over the debt ceiling,
with Republicans demanding restrictions to food and Medicaid programs to rein in spending,
a bill that raised the cost of private retirement savings accounts to $282 billion per year was quietly signed into law.

In this era of deeply divided politics, the 2022 bill known as "#Secure 2.0" was hailed as a bipartisan success — a victory for average Americans.
It had sailed through the House by a whopping 414-5 vote.
It followed four other major bills passed between 1996 and 2019 that 🔸dramatically expanded taxpayer savings 🔸– all equally lauded as bipartisan victories.

But that rare issue that brought a divided Washington together also 💥increased wealth disparities and the federal deficit. 💥

And the victory was most strongly applauded by the burgeoning #financial #services #industry, for whom #tax-#advantaged #retirement #savings has transformed a $7 trillion retirement market in 1995 to a $38.4 trillion behemoth in 2023.

👉Tax-advantaged savings has become a staple of the American retirement system, with 60 million savers squirreling away $6.6 trillion in their 401(k)s, alone.

But a yearlong POLITICO investigation found that Secure 2.0 and its predecessor bills have expanded the system well beyond its goal of helping the middle class.

Today, ⭐️wealthy taxpayers can protect up to $452,500 per year ⭐️in tax-advantaged accounts in a single year, 👉saving up to $203,600 on their #taxes.

And they can keep their money in tax-advantaged accounts far longer.

More striking is how these victories were achieved:
A quarter-century partnership between two senators
    — Democrat Ben #Cardin of Maryland and Republican Rob #Portman of Ohio
    — joined more recently by the former House Ways and Means Committee Chair Richard #Neal (D-Mass.).

Backed by one of the most highly skilled and lavishly funded industry #lobbying teams, and greased by campaign contributions, Portman, Cardin and Neal turned what could have been a deeply controversial giveback to higher-income taxpayers into a staple of the American Dream.

They appealed to core beliefs in both parties
    — free enterprise for Republicans, economic security for Democrats
    – to enact what is arguably the most costly series of non-Defense bills in recent decades.

Indeed, that success now vexes many retirement experts, alarmed by how easily Congress acquiesces to tax breaks for retirement savings that 🔹disproportionately help the wealthy 🔹while treating the benefits relied upon by most retirees
    — Social Security and Medicare
    — as "budget-busters ripe for reform".

🔥“The 401(k) industry owns Congress,” 🔥said Daniel Hemel, a professor and tax law scholar based at NYU School of Law.
“Either lawmakers were trying to pull a fast one on the American people or lobbyists were trying to pull a fast one on Congress.
I don’t know which story is better. I don’t know which one I should want to believe.”

  32. @QLC

As congressional Republicans advanced legislation that would clear the way for new oil and gas infrastructure, #Valero contributed $250,000 each to the #House and #Senate #GOP #super #PACs.

The company also reported spending $60,000 lobbying the House and Senate on “issues related to infrastructure permitting,” among other topics.

While the push for “permitting reform” stalled, the deal reached by the Joe Biden administration and congressional Republicans in May to raise the federal debt limit included a provision expediting the controversial #Mountain #Valley #Pipeline — which opponents say will cause emissions equivalent to twenty-six new coal-fired power plants — and shielding the project from further legal challenges.

#Valero reported #lobbying on permitting issues in the debt ceiling deal, as did Texas-based #Energy #Transfer #Partners, whose billionaire chairman Kelcy Warren gave $5,000 to the Congressional Leadership Fund in March. Energy Transfer also donated $2 million to the fund last year.

While neither Valero nor Energy Transfer are among the consortium of companies involved with the Mountain Valley Pipeline, both companies have faced their own recent permitting woes.

In 2021, legal challenges and intense public opposition halted a planned pipeline that would have transported crude oil from Valero’s Memphis, Teneessee, refinery to Mississippi for export — but local activists fear the company is looking for a way to revive the project.

And Energy Transfer, the company behind the fiercely contested Dakota Access Pipeline, is currently at odds with the Biden administration over the denial of a permit for a planned liquefied natural gas export terminal in Louisiana.
