    It declares, among other things that: "Public legal information is digital common property and should be accessible to all on a non-profit basis and free of charge"

  26. Taught Zeran vs. AOL today and set a timer on loop to go off every 2 minutes. It was annoying, which was the point!

    Context: Zeran vs. AOL was a landmark Section 230 case. Zeran claimed to receive tons of hate calls, due to an anon user’s AOL posts falsely linking Zeran to offensive merchandise, w/call frequency peaking at 1 call every 2 min.

    The big Q the court had to decide was whether S230 protected AOL from liability. Spoiler alert: They said yes!

  27. We need a name for the property-protecting canon the Supreme Court used in Sackett, the recent Clean Water Act case, and I propose calling it the Sagebrush Canon.

    The name is inspired, of course, by the Sagebrush Rebellion, which admittedly more involved public lands as opposed to public regulation of private lands. But the vibes line up.

  28. From tort law to cheating, what is ChatGPT’s future in higher education?

    It passed the bar exam, first with a mediocre score and then with a ranking among the top tier of newly minted lawyers. It scored better than 90% of SAT takers. It nearly aced the verbal section of the GRE — though it has room for improvement with AP Composition.

    What's next? As one Berkeley Law professor summed up the task for his class: Try to “beat it.”

  34. This was our panel today at #aals2023 for the Associate Dean section. It was an honor to learn from Dr. Nickey Woods, Deepika Sharma, and Chalak Richards. We discussed learning and motivation theory, and I presented strategies for teaching with intrinsic motivations that promote mastery and personal formation (not just extrinsic motivations of grades and competition). I always welcome opportunities to bring clinical moves to the doctrinal crowds.

I discussed an empirical project on #SupremeCourt briefing practices. In particular, I've studied how litigants have changed their approach to arguing statutory cases during the era of the rise of textualism.

    We don't have much systematic data on briefs.
