What do we think, friends: Are these #SubFeistDesigns?
In other words, would LV have been able to get valid copyrights on any features of these designs?

That is partly (but not entirely) a rhetorical question. One obvious answer is that they want protection for #SubFeistDesigns.

Key point: Copyright already protects disembodied designs--assuming they can meet copyright's (low!) standards. Copyright is free. So why would people want to pay (a lot) more to get design patents? Among other reasons, it's to get protection for #SubFeistDesigns. See generally:
