  1. To recap yesterday's #DesignDay:

    - No announcement about the #PatentBar

    - Lots of hating on Curver/SurgiSil

    - No mention at all of the biggest thing going on in design patent litigation right now, the #ScheduleA phenomenon*

    ______
    * The first-appealed Schedule A design patent case did get mentioned, but only as to its own merits.

  2. And we're done with #DesignDay 2023. No word on the #PatentBar. And only the vaguest allusion to the biggest thing going on in design patent litigation rn (IMHO): #ScheduleA cases.

  3. Young: "Stay tuned to future USPTO-related events and postings." They will "provide their training materials online" and will "be providing webinars over the summer."

  4. Back to Karen Young, Director, Technology Center 2900.

  5. Up next: A "Report from the Front Lines" from Rebekah Holtz.

  6. O'Dea: Even if LKQ waived the Rosen issue here, we may see others pick it up.

    #DesignDay

  7. Again, if you're interested in my view on Rosen, see: patentlyo.com/patent/2022/12/d

tl;dr: Rosen is good but the Federal Circuit is applying it too strictly.

  8. This is a generous explanation of step 2 of the Durling test.

Really, the judges who came up with it didn't even agree on what it meant.

  9. And the "major design patent case" is....LKQ!!

  10. Up next: “Spotlight on a Major Design Patent Case” by Brendan O’Dea. #DesignDay

  11. It's probably a good thing that we can't submit questions online. #DesignDay

  12. The next #DesignDay session will be a "Spotlight on a Major Design Patent Case."

What case do you think it will be?

  13. To be clear: People will respect IP rights if they're reasonable. The idea that people should "respect" a claim to a right simply because it cleared USPTO/Copyright Office scrutiny is....really something.

  14. I'm very grateful for the online attendance option for #DesignDay because, inter alia, I have no poker face.

  15. Allen: "Please respect intellectual property rights." 🙄

    #DesignDay

  16. Allen: "Copyright balances artistic craftsmanship against useful articles."

    Does it?

    #DesignDay

  17. Allen: "Why do we care about copyright protection?"

A: "It exists automatically upon creation," but registration has significant benefits--including CBP enforcement at the border (which is not available for design patents).

Copyright also lasts "much, much longer" than a design patent.
