- No mention at all of the biggest thing going on in design patent litigation right now, the #ScheduleA phenomenon*

* The first-appealed Schedule A design patent case did get mentioned, but only as to its own merits. -
And we're done with #DesignDay 2023. No word on the #PatentBar. And only the vaguest allusion to the biggest thing going on in design patent litigation rn (IMHO): #ScheduleA cases.

To be clear: People will respect IP rights if they're reasonable. The idea that people should "respect" a claim to a right simply because it cleared USPTO/Copyright Office scrutiny is....really something.

Allen: "Why do we care about copyright protection?"
A: "It exists automatically upon creation," but registration has significant benefits--including CBP enforcement at the border (which is not available for design patents).
Copyright also lasts "much, much longer" than a design patent.
