If you are a member of the patent bar: How long did it take for you to study/prepare to take the exam? How much time time lapsed between the date you applied (or decided to apply) and the date you took the exam?
-
Are you a law student or attorney who is interested in joining the design patent bar? If you haven't applied yet, why not?

To recap yesterday's #DesignDay:
- No announcement about the #PatentBar
- Lots of hating on Curver/SurgiSil
- No mention at all of the biggest thing going on in design patent litigation right now, the #ScheduleA phenomenon*
______
* The first-appealed Schedule A design patent case did get mentioned, but only as to its own merits. -
And we're done with #DesignDay 2023. No word on the #PatentBar. And only the vaguest allusion to the biggest thing going on in design patent litigation rn (IMHO): #ScheduleA cases.

The #USPTO is EXTENDING the deadline for two pending requests for comments: https://content.govdelivery.com/accounts/USPTO/bulletins/341f573
This includes the one request that asks, among other things whether the Office should create a separate design patent bar.
Instead of being due on Tuesday, the comments are now due January 31.

Side note: From the way this job description is written, it seems clear that anyone who has limited admission to the patent bar based on their design examining experience would not qualify to be an APJ, since the technical background is a separate requirement.
It's true that there aren't a *ton* of design patent cases at the PTAB. But I often wonder about how much knowledge/expertise the APJs have in that space.
