Interesting situation:
The third-party doctrine is a precedent in US jurisdiction that says: when you voluntarily give information to third parties,you have no reasonable expectation of privacy in that information.
It enables the government to simply buy sensitive data that you "voluntarily" handed over to third parties, as in: every company (including, "app") whose services you are using.
Without any warrant that is usually needed, should they want to seize the very same information from you, directly.
The same doctrine also enables judges to tell your lawyer to hand over sensitive documents that you shared with an "#AI" provider to create or polish it using "AI" – the respective provider being considered such a third party.
So, should you support the proposed Surveillance Accountability Act (H. R. 8470), because it tries to ban this overreach?
Or should you oppose it, because that precedent is a brilliant and powerful way to contain, or even roll back, the spread of "AI"?

Thanks to #Microsoft, 2025 and beyond really is now the era of the #Linux #desktop. I don't consider myself a luddite and am an early adopter of most technology, but #CoPilot is much too invasive and Microsoft's implementation of CoPilot and #ReCall are even more invasive! I have a plus subscription to ChatGPT and a pro subscription to Perplexity. It's not that I'm afraid of #ai/ #LLMs or don't want to use it! The difference is, neither ChatGPT or Perplexity are uploading my sensitive (and private) documents to the cloud.
Here's a simple fact:Once data leaves your domain (your control), for the purposes of the 4th Amendment protection in the United States you are no longer the custodian and you have very little protection.
Cases like Carpenter v. United States (2018), and Riley v. California (2014) have restricted the third-party doctrine but they haven't abolished it.
For comparison, last year Microsoft admitted it processed over 5600 warrants and subpoenas for user data with over half of those warrant coming with indefinite gag orders.
Today the US Government is already going after people left and right for thought crimes. Now Microsoft has a searchable index of a lot of your thoughts if you still use Windows and CoPilot or ReCall.
