L’operazione a carattere internazionale "Carbone delle Alpi" ha rivelato come migliaia di consumatori siano stati ingannati da un sistema capace di spacciare scarti tossici per eccellenze ecologiche
Il cuore dell'inchiesta, coordinata dalla Procura di #Trento e condotta dal Nucleo Operativo Ecologico (#NOE) dei #Carabinieri, svela una sofisticata "alchimia cartolare". L'inchiesta vede sotto la lente d'ingrandimento alcuni funzionari dell'APPA (Agenzia provinciale per l'ambiente) di Bolzano. Secondo l'ipotesi accusatoria, queste figure avrebbero tradito il proprio mandato istituzionale trasformandosi in veri e propri facilitatori del crimine.
Il loro contributo è stato tecnico e normativo, sfruttando le pieghe del regolamento REACh (la normativa europea sulle sostanze chimiche) per fornire una parvenza di legalità al traffico:
- Redazione di note interpretative "su misura" per declassificare i rifiuti in sottoprodotti;
- Ritardi strategici nell'emissione di sanzioni;
- Suggerimenti operativi su come eludere i controlli nazionali ed europei.
Senza questo supporto amministrativo, il sistema sarebbe crollato ai primi controlli. È il fallimento del sistema di vigilanza: chi doveva proteggere la salute pubblica ha invece costruito lo scudo legale dietro cui il traffico ha prosperato per anni.
La rete non conosceva frontiere, estendendosi tra Italia, Austria, Germania, Croazia, Serbia e Svizzera. Per abbattere questo impero, è stato necessario un coordinamento massiccio: oltre 100 militari dell'#Arma, inclusi gli specialisti del #ROS (Raggruppamento Operativo Speciale) e il supporto del 3° Nucleo Elicotteri di Bolzano, operando in sinergia con #Europol, #Eurojust e #OLAF.
L'inchiesta coinvolge attualmente 19 persone e 3 società, con 12 arresti già eseguiti. La dimensione transnazionale non è casuale: spostare i rifiuti attraverso diversi confini permetteva di sfruttare le asimmetrie normative e di "ripulire" la provenienza delle ceneri, rendendo il tracciamento quasi impossibile per i controllori ordinari.
Il gruppo criminale operava secondo una logica di doppio profitto. Da un lato, l'evasione totale dei costi di smaltimento delle ceneri tossiche (un risparmio stimato in centinaia di migliaia di euro). Dall'altro, la vendita di quello stesso scarto come prodotto di lusso o credito di CO₂. Il volume d'affari illecito complessivo si aggira intorno ai 4 milioni di euro.
Il mercato dei prodotti sostenibili è oggi un terreno di caccia per organizzazioni criminali che vedono nella "sensibilità green" del consumatore un'opportunità di profitto facile. La trasparenza deve diventare un obbligo, non un'opzione commerciale.
