  5. In their lawsuit, they reliably cite Bullock v Carter. But, what does that decision actually say?

Bullock v Carter decision says, "There is an interest, if not a duty, to protect the integrity of its political processes from frivolous or fraudulent candidacies".

Contra the implied power in their lawsuit, the implication of Berger's decisions is that, while a state may have an interest, there is no constitutional duty or right conferred. In fact, the Constitution gives the power of elections to the states.

I suggest the federal gov't, absent clear statutory language, has no constitutional right to insert itself to a state's right to define the confines of what constitutes "frivolous or fraudulent candidacies".

And since it decided to insert itself less than two weeks before the election, it has no right to demand prospective restrictions. Heck, we don't even know if sufficient margins would prove critical.
