    SAN FRANCISCO — Lurking beneath the shiny promise of artificial intelligence in health care is a host of potential liability issues. Chief among them: a lack of consent from patients, whether any doctor checks the machine’s work, and, if they do, whether that even helps. 

    A panel of legal and medical experts at STAT’s Breakthrough Summit West explained the myriad legal questions hanging over the adoption of AI in health care. The discussion wove notes of caution into an otherwise hopeful collection of conversations about the use of such technology in medical care and drug development. 

    One of the speakers, Christopher Longhurst, chief clinical and innovation officer at UC San Diego Health, just published an article calling on clinicians to disclose to patients any time generative AI is used in their communications. “We just think that’s the right thing to do,” he said.

    TITLE: STAT+: State AI laws would be banned under clause buried in House budget bill

    A small but powerful nugget is buried in the text of the House budget reconciliation bill released this week: A clause that would ban state and local governments from enforcing any laws on AI, even ones that have already been put into effect. 

    While policy experts have been calling for clarity on “preemption” of AI regulations — whether federal laws supersede state and local laws — for Congress to assert its authority without actually setting down rules of its own is unusual, and could affect many states’ efforts to regulate the use of AI in health care.

    The bill may not pass the chamber in its current form, and even if it does, the AI clause may ultimately get excised. Either way, the fact that we’re hearing about it now means this issue isn’t the last we’ll hear about it, said Max Rieper, director and counsel for technology and privacy policy at MultiState, a firm that helps companies with state government relations work.

    TITLE: STAT+: OpenAI leaps into health care with AI benchmark to evaluate models

    OpenAI on Monday released a large set of data for evaluating how well large language models answer questions related to health care. Experts lauded the open-source data and detailed evaluation rubrics, calling them “unprecedented” in scale and breadth. The project, HealthBench, marks OpenAI’s first foray into health care applications of AI, outside of external partnerships.

    “Our mission as OpenAI is to ensure AGI is beneficial to humanity,” said Karan Singhal, who leads OpenAI’s health AI team, referring to OpenAI’s goal of developing artificial general intelligence. “One part of that is building and deploying technology. Another part of it is ensuring that positive applications like health care have a place to flourish and that we do the right work to ensure that the models are safe and reliable in these settings,” he said.

    OpenAI’s HealthBench contains 5,000 “realistic health conversations,” each with a custom rubric to grade the model’s responses to health-related questions. The questions and rubrics were curated by a group of 262 physicians who have practiced in a combined 60 countries, the company said. In total, the rubrics encompass over 57,000 unique criteria, allowing the company to measure the performance of models in many more dimensions than traditional benchmarks, said Singhal.
