"Save My Louisiana organized a #protest against the #AppliedDigital #datacenter being built in the small Central Louisiana community of Boyce on Saturday, July 18.
"Those at the protest were concerned with non-disclosure agreements [#NDA's] signed by local officials, higher utility costs and the #EnvironmentalImpact of the Applied Digital data center. A few also questioned the true economic impact of the project, which they think will benefit the company, but not Central #Louisiana.
"Applied Digital, a Dallas-based digital infrastructure company, broke ground in January on #DeltaForge1, a large-scale artificial intelligence data center located at James Road and La. 121 near Boyce. A news release issued by the Louisiana Economic Development states it is expected to be finished by mid-2027.
"At a news conference held in May announcing the building of the $3.6 billion data center, Applied Digital board director Richard Nottenburg said that the Delta Forge 1 data center is not a traditional data center.
"Applied Digital has been working on transitioning from air cooled to liquid cooled data centers, said Applied Digital president and co-founder Jason Zhang at the same news conference.
“ 'Our design is a proprietary design that allows us to use very minimal water,' he said, adding that it’s an issue that is very important to communities where data centers are built." [So, in other words, an alleged "closed loop system"! But even closed loop systems have to be flushed periodically!!!]

This entirely unnecessary NDA culture has been commercial poison for me for the past 15+ years and also a huge problem for the open source projects themselves. NDAs are a legalese subversion of open source's social contract: Not being able to create case studies or otherwise publicly document how useful and time-saving the many tools on offer have been for many of my clients has been so damaging in the long run and it's making me question why I even continue with it...
Clients get an incredible discount from using open technology, but then do not even allow you to mention their name as reference or talk about how the projects were used to solve specific problems for which they approached you in the first place. It's PR death for these projects (and CV death for people like myself) by a thousand cuts...

Вы наверняка не раз слышали следующее: «Рынок всё порешает». Если работодатель – самодур, платит копейки и заставляет работать по выходным за «спасибо», то невидимая рука рынка просто должна дать ему пощёчину. Люди уйдут, новые не придут, и контора либо исправится, либо обанкротится.
Звучит красиво. Только вот чтобы рынок работал, ему нужна информация. Если вы покупаете машину, вы хотите знать, не битая ли она. Если вы продаёте свой труд, вы хотите знать, не является ли покупатель бесчувственным психопатом, который кинет вас на бонус. И вот тут в игру вступает cтационарный бандит (государство) со своей дубиной, помогая корпорациям ломать механизм обратной связи.
Очень часто работников заставляют подписывать NDA. А особенно стоит выделить пункты Non-disparagement (недопущение дискредитации/критики). Это юридический новояз, который переводится так: «Мы будем платить тебе ниже рынка, орать матом на планерках и заставлять перерабатывать, но если ты напишешь об этом в соцсетях или отзыв на Glassdoor/Хабр Карьере – мы засудим тебя до трусов, и наш ручной государственный суд в этом поможет».
Почему это ломает рынок? В экономике есть термин «рынок лимонов» от экономиста Джорджа Акерлофа. Если покупатель не может отличить хорошую машину от хлама, продавцы хлама вытесняют честных продавцов. С работой то же самое. Плохая компания платит юристам, чтобы те составили драконовские договоры. Сотруднику говорят: «Подпиши, что не имеешь претензий и обязуешься не говорить о нас плохо, иначе не получишь выходное пособие или рекомендацию».
Человек, загнанный в угол ипотекой и детьми, подписывает и молчит. А новый соискатель не знает, что в компании творится ад. Рыночный сигнал искажён. Токсичный бизнес продолжает существовать, потому что стационарный бандит предоставляет ему силовую поддержку для обеспечения кабального контракта. Вместо честной репутации, которая в либертарианском обществе должна быть главной валютой, мы получаем стерильное пространство, где все компании «белые и пушистые», пока ты не попадёшь внутрь.
Самое смешное, что иногда государственные суды всё же не выдерживают этого абсурда. Да, государство – это машина насилия, но даже у этой машины иногда сгорают предохранители от наглости корпораций. Вот несколько примеров, когда право говорить правду побеждало право корпорации на тишину:
1) Кейс McLaren Macomb и NLRB (США, 2023). Национальный совет по трудовым отношениям (NLRB) в Штатах постановил, что само предложение сотруднику подписать соглашение о неразглашении и запрете на критику при увольнении – незаконно. Логика простая: это нарушает права сотрудников объединяться и обсуждать условия труда. Да и нельзя заставлять людей выбирать между выходным пособием и свободой слова.
2) Дело Glassdoor. Суды неоднократно вставали на сторону площадок с отзывами, когда компании требовали выдать IP-адреса авторов негативных отзывов. Они признавали, что мнение сотрудника о «токсичной атмосфере» – это просто оценочное суждение, защищённое Первой поправкой (в США), а не клевета.
3) Российская практика (да, и такое бывает). Даже в наших широтах суды признают ничтожными пункты трудовых договоров, запрещающие сотрудникам работать у конкурентов или разглашать размер своей зарплаты. Право на свободное выражение мнения и распространение информации всё ещё работает в некоторых сферах, как бы ни хотелось HR-директору обратного.
Что делать нормальному человеку? Читайте, что подписываете (можете использовать ИИ-модели для поиска «подводных камней»). Если видите пункт Non-disparagement без чётких временных рамок и определений – это красный флаг. Помните про «Эффект Стрейзанд». Если компания судится с бывшим сотрудником за отзыв о том, что там плохо работать, – это лучшая реклама того, что там действительно плохо работать. Кроме того, не забывайте, что мы живём в эпоху криптоанархизма и Tor. Сейчас ничто не мешает исполнить моральный долг и рассказать всем о токсичном работодателе анонимно, без последствий для себя.
