  10. Steep rise in Florida executions

    Darkness seems to reign in the Sunshine state

    November 2025

    There has been a big increase in executions in Florida – 15 so far this year and another one due to take place today (20 November) of Richard Randolph. This compares with 1 last year and a downward trend in the US as a whole. The reason for this surge is hard to determine but much of the US media and opinion seems to point to the Governor Ron DeSantis. It is alleged that this sudden surge is part of his campaign to run for president in 2028 at the end (?) of the Trump era.

    There are many troubling aspects about the executions. Florida is almost unique in allowing the governor

    to have the final decision. Other states now leave this to the judiciary. But there is also disquiet about the secrecy of the decision making process. ‘Florida’s gov­er­nor has no cri­te­ria, pro­ce­dure, or guide­lines in place for select­ing who lives and who dies…Granting the gov­er­nor unfet­tered dis­cre­tion has, in prac­tice, led to a com­plete­ly arbi­trary process for deter­min­ing who lives and who dies‘ [attorney for Thomas Gudinas]. De Santis has offered no explanation for this sudden increase in executions.

    High level of mistakes

    Anyone who has read Clive Stafford-Smith’s book Injustice will know the inefficient court process in the US particularly for poor people. The level of mistakes in the state is high. Since 1989 there have been no less than 93 individuals wrongfully convicted and exonerated. Needless to say, if someone has already been executed it’s a mistake that cannot be rectified.

    The judicial process seems to offer little confidence with 6 or the seven justices on the Florida Supreme Court appointed by the governor. The jury system has been altered so that only 8 out of the 12 jurors is needed for a guilty verdict. The results are clear to see with 35% of those on death row are Black whereas they represent only 17% of the population.

    There is no evidence that the death penalty is a deterrence. As we have noted, mistakes cannot be afterwards rectified. It would appear that this sudden rise is due to the Governor’s desire to raise his credibility with a view to the presidential election in 2028. As the Palm Beach Post notes, ‘the system is riddled with issues ..’ (18 November).

    "Four crosswalks in Fort Lauderdale are in the crosshairs of the Florida Department of Transportation.

    "The state recently sent the city a non-compliance letter, demanding the different designs and murals be removed.

    " 'It’s an attempt to try to erase the presence of anything to do with the #LGBTQCommunity,' Fort Lauderdale Mayor Dean Trantalis said.

    "The state sent similar letters to Miami Beach, Key West and #DelrayBeach, citing safety issues, but Trantalis says it has nothing to do with safety.

    " 'It could be the gay community this year -- who knows what’s going to be next year,' he said. 'We don’t know where they are going to keep trying to eliminate the diversity of what represents Florida.'

    "Four crosswalks in Fort Lauderdale are in the crosshairs of the Florida Department of Transportation.

    "The state recently sent the city a non-compliance letter, demanding the different designs and murals be removed.

    " 'It’s an attempt to try to erase the presence of anything to do with the #LGBTQCommunity,' Fort Lauderdale Mayor Dean Trantalis said.

    "The state sent similar letters to Miami Beach, Key West and #DelrayBeach, citing safety issues, but Trantalis says it has nothing to do with safety.

    " 'It could be the gay community this year -- who knows what’s going to be next year,' he said. 'We don’t know where they are going to keep trying to eliminate the diversity of what represents Florida.'

    "Two of the crosswalks in Fort Lauderdale on the state’s list are along Breakers Avenue at Terramar and Riomar streets.

    On the generic congressional ballot, #Democrats have a 22-point advantage:
    54% support the Democratic candidate while 32% support the #Republican; 15% are undecided. 

    A third of voters (33%) support the proposal to redraw California’s congressional map ahead of the 2026 Midterm Elections, while a quarter (25%) oppose; 42% are unsure. 
    “Support to redraw the state’s congressional map ahead of the Midterm Elections is strongest among Democrats by a 23-point margin, 42% to 19%,
    and opposed by an eight-point margin among Republicans, 36% to 28%.

    A majority of independent voters are unsure, while 25% oppose and 23% support,” Kimball said.

    The #economy is the top issue for 30% of California voters,
    down from 40% in April,
    followed by #housing affordability at 19%,
    #immigration at 15% (up from 7% in April),
    threats to democracy at 13%,
    and #healthcare at 8%.

    Housing affordability is 14 points higher for California voters compared to U.S. voters overall,
    while concern for threats to #democracy is ten points lower than the national poll.

    A majority (61%) of California voters view #tariffs as more of a tax on U.S. consumers,
    while 26% view tariffs as a tax on the foreign country. 

    Democrats view tariffs as a tax on the consumer, 79% to 11%, while Republicans see tariffs as a tax on the foreign country, 54% to 32%. 

    A majority of California voters (60%) think mass deportations of undocumented/illegal #immigrants in California are a bad thing,
    consistent with the April Emerson poll;
    40% think mass #deportations are a good thing.

    Forty-nine percent of voters think the California government should spend more on #firefighter staffing and equipment,
    knowing that increased funding may require a tax increase, down from 62% in February;

    43% think the government should spend the same, up eight points from February, and 8% think it should spend less.

    Just over half of California voters (51%) agree that Los Angeles is an ideal host city for the 2028 Summer #Olympic Games, while 27% disagree. Twenty-three percent are unsure. 

    Black voters (64%), voters aged 30-39 (57%), male voters (54%), and college-educated voters (54%) most agree that Los Angeles is an ideal host city for the Olympics.

    Republican voters (42%) and voters aged 50-59 (33%) are most likely to disagree that Los Angeles is an ideal host city for the 2028 Summer Olympic Games.

    A new law under consideration in the state Legislature would roll back child labor laws to make up for a dwindling labor pool.

    "As Florida officials enable Trump’s #MassDeportation policies, lawmakers in the state are looking to children to take on some of the jobs that have typically been done by immigrants.

    "Making its way through the state Senate is a new law, Senate Bill 918, that aims to loosen child labor laws and allow teenagers to work overnight shifts.

    "As CNN reported: 'The state’s legislature on Tuesday advanced a bill that would loosen child labor laws, allowing children as young as 14 years old to work overnight shifts. If the new law is passed, teenagers would be able to work overnight jobs on school days. They are currently prevented from working earlier than 6:30 am or later than 11 pm per state law.'

    "#SB918 also 'includes a number of changes including eliminating working time restrictions on teenagers aged 14 and 15 if they are home-schooled and ending guaranteed meal breaks for 16 and 17 year olds,' CNN reported.

    "Florida Gov. #RonDeSantis backs the law and has defended the idea of teenagers and college students working these jobs. DeSantis also explicitly linked the effort to the loss of immigrant labor. Speaking about the consequences of state verification laws at an event with border czar #TomHoman, the governor said, 'Yes, we had people that left because of those rules, but you’ve also been able to hire other people. And what’s wrong with expecting our young people to be working part-time now?'

    "In recent years, several states — many of them led by #Republican governors — have rolled back child labor laws. This map from the Economic Policy Institute illustrates the spike in states rolling back these laws from 2021 to 2024. Back in 2023, for example, #Arkansas Gov. #SarahHuckabeeSanders signed a bill that made it easier for companies to hire children without getting consent from their parents. One month earlier, The New York Times published a bombshell report about the exploitation of immigrant children in #factories operated by some of the most well-known companies in the U.S.

    "That story should have spurred a nationwide push to strengthen child labor laws. Instead, states like Florida are going in the opposite direction, weakening such laws in part to deal with the fallout from the conservative movement’s demonization of immigrants. They’re essentially using child labor to paper over the gaps left by their draconian immigration policies.

    "#Project2025, the far-right playbook for Trump’s second term, specifically calls for rolling back #HazardRegulations around child labor. The text claims, 'Some young adults show an interest in inherently dangerous jobs' and argues that 'with parental consent and proper training, certain young adults should be allowed to learn and work in more dangerous occupations.'

    "Even as child labor laws are being rolled back, the Trump administration is working to gut social services, including funds that help provide school lunches to children and programs, like the supplemental nutrition assistance program, that help feed poor families. And if those cuts stay in place, they may leave American families with few alternatives to sending their children to work to keep food on the table."

    HB 275 / SB 340: New penalties for protests near gas and oil #pipelines

    Creates a new felony offense for trespassing that could cover some protests near pipelines and other infrastructure that do not involve actual property damage. The law broadly defines “#CriticalInfrastructure” to include above or belowground pipelines, as well as a range of other gas, electricity, water, mining, and telecommunications facilities. Under the law, entering onto critical infrastructure property with notice that such entrance was prohibited is a 3rd degree felony offense. As such, protesters who cause no damage but merely enter onto posted property that contains a pipeline in the course of their protest could face felony charges and up to 5 years in prison if convicted. By contrast, trespassing onto private property is generally a 2nd degree misdemeanor, punishable by at most 60 days in jail. The House bill as originally also created an overbroad “improper tampering” felony offense, which would have included any unauthorized action to “change…the physical condition of the property or any portion thereof,” or to “knowingly and intentionally… deface” critical infrastructure property, but these provisions were removed by amendment.

    HB 1435/SB 1954: Charging protest organizers for the costs of responding to a protest

    Would allow local authorities to require protest organizers to pay for "all relevant costs and fees associated with designating and enforcing" the zone established for a "special event," "including, but not limited to, costs and fees for the provision of supplemental law enforcement and sanitation services." While the bill's sponsors indicate that it was motivated by large, disruptive "pop-up" gatherings of cars like the "Daytona Truck Meet," it is written broadly enough to cover street protests and demonstrations. The bill defines a "special event" as an "unpermitted temporary activity or event organized or promoted via a social media platform" which is attended by 50 or more persons and substantially increases or disrupts the normal flow of traffic on a roadway, street, or highway." The bill also authorizes law enforcement to "enforce occupancy limits" in "special event zones"; which if applied to protests could allow police could limit the number of protest participants in a certain area.

    HB 1/SB 484: Expanded definition of "#riot" and new penalties for #protesters

    **Note: Provisions of HB1 related to the law's new definition of "riot" were preliminarily enjoined by a federal district judge on September 9, 2021, temporarily blocking enforcement of those provisions.**

    Enlarges the legal definition of "riot," a 3rd degree felony, to include any group of three or more individuals whose shared intent to engage in disorderly and violent conduct results in "imminent danger" of property damage or personal injury, or actual damage or injury. Notably, the new definition does not require that the individuals' conduct be disorderly or violent, or that they commit any actual damage or injury. Under the new law, a "riot" consisting of 25 or more people, or one that "endangers the safe movement of a vehicle," is automatically an "aggravated riot," a new 2nd degree felony offense under the law. As such, large groups of protesters or ones that block traffic, even temporarily, could face up to 15 years in prison. Under the new law, "inciting" someone to participate in a riot is a 3rd degree felony, punishable by 5 years in prison. The law also creates a new criminal offense of "mob intimidation," defined as a group of three or more people who act with a "common intent" to compel "or attempt to compel" another person to "do or refrain from doing any act," or "assume, abandon, or maintain a particular viewpoint" against their will. The offense is a first degree misdemeanor, punishable by up to one year in jail. The law creates a new 3rd degree felony offense, punishable by up to 5 years in prison, for anyone who "willfully and maliciously #defaces, injures, or otherwise damages by any means" #statues, #flags, #paintings, displays, or other "#memorials" and the value of the damage is more than $200. As "deface" is not defined, protesters who apply paint or graffiti to a monument in the course of a peaceful protest could face up to 5 years in prison. The law may encourage violence against protesters by creating a new affirmative defense in civil lawsuits for personal injury, death, or property damage, such that a defendant can avoid liability by establishing that the injury, death, or damage they committed "arose from" conduct by someone "acting in furtherance of a riot." Finally, the law creates a new civil right of action against a municipal government that fails to "respond appropriately to protect persons and property during a riot or unlawful assembly," making them civilly liable for damages, including personal injury or property damage. These provisions may encourage municipal governments to adopt overly aggressive law enforcement responses to protests in order to avoid lawsuits.
