  1. Specifically #AudioEye (best known for SLAPP suits versus useful tooling) and #UserWay (best known for destroying the Level Access brand). Anyway, utter disappointment to see #CSUNATC giving them a platform.

  2. #AudioEye claims it can find more issues than other #overlay vendors:
    adrianroselli.com/2023/02/audi

It makes this claim on a page with 44 WCAG issues according to axe (or 83–111 “valid issues” if AudioEye is to be believed).

Report is linked so you can judge the methodology, outcome.

  3. I heard an explicit reference to #AudioEye from the CSUNATC keynote today (Arizona company, Arizona rep), but I understand that #AudioEye also coaxed people to a post-keynote mixer.

I am curious if anyone knows who attended that mixer.

  4. Oh, I also see CSUNATC is letting an #overlay vendor run a its Friday “Fireside Chat: The Future of AI and Accessibility.”

I may be judging the people from D2L, Yahoo, ETS, and Davis Wright Tremaine LLP who have chosen to share a stage with #AudioEye.

  5. It wasn’t just a legal threat, these bullies used a SLAPP to sue me for the post. They tried to bankrupt and silence me.

  6. Later today, #AudioEye board member Tony Coelho (also a sponsor of the ADA and confirmation anyone can be scammed by #overlays) will be speaking at #AxeCon and I am curious if he will shill for AudioEye on Deque’s dime.

  7. The whistleblower lawsuit against serial bully (personal opinion) #AudioEye has been dismissed (with prejudice):
    adrianroselli.com/2023/02/audi

It always felt like a petty fight between petty people at a petty company.

  8. I am reminded of that time the cowards at #overlay company #AudioEye sued me over tweets:

“Unfair and Impolite Tweets Aren’t Defamatory–Flynn v. Wilson”

  9. This a good distillation of #accessibility #overlays:
    chriscoyier.net/2024/07/13/its

If they were actually useful, they wouldn’t need to use SLAPPs to silence detractors (#AudioEye, #Faciliti), or see their clients or themselves sued for failing to work (#accessiBe), or regularly misrepresent their relationship with standards bodies (#UserWay)

    Scams upon scams.

  10. It’s been two weeks now and I don’t want y’all to forget what kind of company #AudioEye is (anchor link):
    adrianroselli.com/2023/02/audi

I know I must be doing something right because I have never been sued for stock manipulation.

Nor did I ever threaten my employees like this.

    Maybe I just techbro’d wrong.

  11. Overlays in the news:
Former AudioEye executive David Kovacs launched a wrongful dismissal suit against AudioEye, claiming that he was terminated for refusing to participate in a stock manipulation scheme developed by AudioEye's CEO David Morelli. [1]

  12. On 10 April (a couple months prior), AudioEye and its CEO Moradi (pre-emptively?) jointly filed suit against the whistleblower:
    trellis.law/doc/208445719/comp

It is lighter on attributable quotes but does suggest #AudioEye might be a toxic workplace with poor due diligence on top of its other failings.

  13. I encourage you to read the full complaint against #AudioEye and Moradi, which I have embedded (tagged PDF):
    adrianroselli.com/2023/02/audi

Or get it from the NYS courts site (same tagged PDF):
    iapps.courts.state.ny.us/nysce

It seems like AudioEye might be a toxic work environment and I feel for anyone trapped there.

  14. “I will not support your healthcare and your salary, you mother**cker, earn your keep. You do what I say and when I say it. Respect your elders, mother**cker. You will do the reviews and you will do what I tell you to do with AudioEye’s stock. Do what I tell you and set it [the VPN] up now.”

  15. “I am the law, I have the best lawyers in the world, I will never be in trouble, Buddy. I’m worth $200 million, and you’re a f*cking employee at AudioEye working for me.”

    — attributed to #AudioEye CEO David Moradi at prnewswire.com/news-releases/l

  16. “Buddy, if you’re not going to help with this, maybe you won’t get your equity in First Contact, and maybe I won’t feel like supporting your health benefits or your role at AudioEye anymore.”

    — attributed to #AudioEye CEO David Moradi at prnewswire.com/news-releases/l

  17. Hey. Turns out #AudioEye might be just as immoral as we all suspect:

“Lawsuit Accuses NASDAQ-listed AudioEye CEO and its Executive Chairman of Stock Manipulation”
    prnewswire.com/news-releases/l

I pulled out its CEO’s threats against the whistleblower so they are easier to read:

  18. I updated my post “#AudioEye Will Get You Sued” with the image and a little extra nugget — but as a comment to leave the original post pure as the driven snow:

That may be my only #AccessU2024 blog post given my schedule.

  19. I would be pissed with Google’s new fake search if I was WebAIM. It directly sources WebAIM (from an old survey), but it doesn’t link to the WebAIM survey results it cites. Instead it links to BoIA (an #AudioEye #overlay company) and Assistiv Labs.

The option to see web results is buried in the “More” kebab, and even then the link is third from last.

Reminder not to use Google to search (in case you still do).

  20. Oh hey, it’s #GAAD.

Be on the lookout for the (mostly corporate) performative A11yship of #GAAD which is about to fill your timelines.

A couple years ago I demonstrated #overlay companies as the worst offenders:

  21. Starting to think this transition #AudioEye has made from not participating in conferences (with the people who do the work and have the disabilities) to having a presence is an intentional effort at chilling criticism at the very place people know how shit the #overlay is.

Having this thought because I am seeing it in action.

Also, reputation washing is in fact working the opposite direction to that intended.

  22. I got name-checked in Jessica Weber’s 2024 #AccessU2024 Legal Update! It was for #AudioEye’s SLAPP #overlay suit.

Got to lunch very late because people wanted to ask me questions, but not in front of the AudioEye executive who was in the room.

  23. “Socks, lies, and accessibility”
    janmaarten.com/gaad-2023/

Where @janmaarten shows that just a couple days after #accessiBe’s CEO promised to stop being such a lying liarface it went and used sock puppet Twitter accounts to promote its #overlay.

As I keep saying, past behavior is a predictor of future behavior (side-eyes #AudioEye, #UserWay, #FACILiti).
