" 三浦裁判官は反対意見で、男性のように医療を受けるための在留資格の人らを保護しないのは「生存に危険を生じさせ、著しく人道に反し、個人の尊厳をないがしろにするもの。日本国民と異なる法律上の取り扱いをすべき合理的な根拠はない」と指摘した。そのうえで、生活保護法が対象を国民に限る点を検討。国連の社会権規約などを踏まえれば、少なくとも医療を受けるための在留資格の外国人のほか、難民認定者や、紛争から逃れた人らを難民に準じて保護する「補完的保護対象者」を除くのは、生存権を保障した憲法25条と法の下の平等を定める憲法14条に違反して無効だと述べた。さらに審理を尽くさせるため、高裁に審理を差し戻すべきだとした。

"腎臓の病気で、医療を受けるための在留資格になって就労できなくなったガーナ国籍の男性=千葉市=が、外国人であることを理由に生活保護の申請を却下されたのは違法と訴えた訴訟で、最高裁第二小法廷（三浦守裁判長）は男性の上告を退けた。9日付の決定。却下の取り消しを認めなかった一、二審判決が確定した。裁判官4人のうち3人の多数意見。一方、検察官出身の三浦裁判官は反対意見で、男性を保護対象から除くのは「違憲」と判断。外国人の生活保護に関する法整備を国会が怠っていると指摘した。
