'Senior White House official Stephen Miller, speaking on behalf of the Trump administration, has asserted that federal officers possess complete “federal immunity” from state law. Vice President JD Vance echoed this stance, publicly stating in the aftermath of the Renee Good killing, and before the Alex Pretti killing that federal officers possess “absolute immunity” for what he called an officer just “doing his job.”
'These assertions are absolutely wrong. Far from being immune from criminal law (including state criminal law), federal officers who engage in actions outside the scope of their lawful constitutional authority are fully subject to prosecution and punishment under state as well as federal criminal law. In addition, state law, as well as federal law, can furnish civil-law remedies against federal officers in the form of authorizing lawsuits for damages or injunctions. More than that, higher-ranking federal officials who direct, instruct, authorize, encourage, promote or assist unconstitutional criminal conduct by federal officers — including by telling agents, falsely, that they can do as they please, with impunity and immunity — might themselves be subject to state criminal prosecution and punishment.'
