A library in rural Alaska needed help providing free Wi-Fi and getting kids to read. A children’s museum in Washington wanted to expand its Little Science Lab. And a World War I museum in Missouri had a raft of historic documents it needed to digitize. They received funding from a little-known federal agency before the Trump administration unsuccessfully tried to dismantle it last year.

The Institute of Museum and Library Services is now accepting applications for its 2026 grant cycle. But this time, it has unusually specific criteria.

In cover letters accompanying the applications, the institute said it “particularly welcomes” projects that align with President Donald Trump’s vision for America.

These would include those that foster an appreciation for the country “through uplifting and positive narratives,” the agency writes, citing an executive order that attacks the Smithsonian Institution for its “divisive, race-centered ideology.” (Trump has said the museum focused too much on “how bad slavery was.”) The agency also points to an executive order calling for the end of “the anti-Christian weaponization of government” and one titled Making Federal Architecture Beautiful Again.

The solicitation marks a stark departure for the agency, whose guidelines were previously apolitical and focused on merit.

Former agency leaders from both political parties, as well as those of library, historical and museum associations, expressed concern that funded projects could encourage a more constrained or distorted view of American history. Some also feared that by accepting grants, institutions would open themselves up to scrutiny and control, like the administration’s wide-ranging audit of Smithsonian exhibits “to assess tone, historical framing and alignment with American ideals.”

The new guidelines are “chilling,” said Giovanna Urist, who served as a senior program officer at the agency from 2021 to 2023. “I think that we just need to look at what’s happening with the Smithsonian to know that the administration has a very specific goal in mind when it comes to controlling the voice of organizations and museums across the country.”

An agency spokesperson told ProPublica it is not unusual for the institute to publish directors’ letters with grant applications, and that this one informs readers “about this Administration’s thematic emphases in the semi-quincentennial year.” He did not comment on criticisms that those letters insert political themes into a historically nonpartisan program.

“Under President Trump’s leadership, IMLS is working to revitalize our cultural institutions, urging less traditional applicants to consider working with us, and to promote civic pride and a deep sense of belonging among all Americans,” he said, adding that any institution that “meets programmatic requirements and goals” outlined in the funding opportunity “will receive all due consideration and undergo peer review.”

“You’re Not Going to Investigate a Federal Officer”

It doesn’t happen often, but local law enforcement can arrest and charge federal agents. Legal experts say there’s a moral obligation to at least try to hold federal immigration officers accountable when they violate the Constitution and the law.

Minutes after a federal agent shot and killed a Mexican immigrant in a Chicago suburb last September, a group of police officers stood on the sidewalk trying to figure out the answer to a question of protocol: Who would investigate the shooting?

“Wouldn’t it be state’s, at a minimum?” one Franklin Park officer asked, according to body camera footage.

Chief Mike Witz shook his head. “No, because it’s a federal shooting,” he said. “You’re not going to investigate a federal officer.”

His officers didn’t investigate. In their report, they didn’t even note the names of the two Immigration and Customs Enforcement agents at the scene of Silverio Villegas González’s death. Instead, they deferred to the FBI.

Local law enforcement officials also did not investigate when a Border Patrol agent shot and wounded a U.S. citizen in her car in Chicago less than a month later. Or when an ICE agent in Phoenix shot a Honduran man during a traffic stop later that month.

In fact, local police did not open investigations into six of the 12 shootings by on-duty federal agents that have led to the deaths or injuries of citizens and immigrants since September, a ProPublica analysis found. In three other shooting cases, state or local police said they have opened inquiries, which they called a routine practice in those jurisdictions. And in Minnesota, where ICE and Border Patrol shot and killed two U.S. citizens and injured a Venezuelan man last month, state police have tried to conduct independent investigations only to be thwarted by the Trump administration, which has gone so far as to block officers from a scene, even when they had a judicial warrant.

In almost every instance, President Donald Trump’s administration blamed the injured and dead for the shooting within hours of the incident, raising questions about whether federal officials can fairly and objectively investigate their own. Legal experts and advocates for immigrants say this apparent lack of accountability demands that local authorities step up and exercise their power to investigate and prosecute federal agents who break state laws — from battery to murder.

“Local police and the state have gotten a free pass,” said Craig Futterman, a law professor at the University of Chicago and the co-founder and director of its Civil Rights and Police Accountability Project. “Residents have every right and should be demanding that, ‘Hey, state authorities, police, local police: Protect us. Arrest people who kill us, who batter us, who point guns at us and threaten and assault us without legal cause to do so.’”

It’s usually the opposite scenario: federal authorities coming in to investigate a troubled police department. But local authorities have investigated and charged federal agents in the past. It’s just rare and complicated. The federal supremacy clause in the U.S. Constitution bars local interference with federal law enforcement officers when they act reasonably and within the scope of their duties.

But given the aggressive tactics employed by immigration agents under the Trump administration, Futterman and other legal experts said local police and prosecutors are morally obligated to at least try to hold federal law enforcement officers accountable.

“We’re in an environment right now where ICE officers are blatantly and egregiously violating the Constitution and the law,” said Joanna Schwartz, a law professor at the University of California, Los Angeles. “The federal government has made it very clear that they are not going to do anything to provide any sort of accountability backstop to its officers. Unfortunately, because Congress is not taking any steps to rein ICE officers in, there really is no option other than states protecting their constituents’ rights.”

Two CBP Agents Identified in Alex Pretti Shooting

The two federal immigration agents who fired on Minneapolis protester Alex Pretti are identified in government records as Border Patrol agent Jesus Ochoa and Customs and Border Protection officer Raymundo Gutierrez.

The records viewed by ProPublica list Ochoa, 43, and Gutierrez, 35, as the shooters during the deadly encounter last weekend that left Pretti dead and ignited massive protests and calls for criminal investigations.

Both men were assigned to Operation Metro Surge, an immigration enforcement dragnet launched in December that sent scores of armed and masked agents across the city.

CBP, which employs both men, has so far refused to release their names and has disclosed few other facts about the deadly incident, which came days after a different immigration agent shot and killed another Minneapolis protester, a 37-year-old mother of three named Renee Good.

Pretti’s killing, and the subsequent secrecy surrounding the agents involved, comes as the country confronts the consequences of President Donald Trump’s aggressive immigration crackdown. The sweeps in cities across the country have been marked by scenes of violence, against immigrants and U.S. citizens, by agents allowed to hide their identities with masks — an almost unheard of practice in law enforcement. As a result, the public has been kept from one of the chief ways it has to hold officers involved in such altercations accountable: their identity.

Both Democratic and Republican lawmakers have called for a transparent investigation into the killing of Pretti, a 37-year-old intensive care unit nurse working at a Department of Veterans Affairs hospital.

“We must have a transparent, independent investigation into the Minnesota shooting, and those responsible—no matter their title—must be held accountable,” Republican Sen. John Curtis of Utah wrote on X on Monday.

The agency sent a notice to some members of Congress on Tuesday acknowledging that two agents fired Glock pistols during the altercation that left Pretti dead. That notice does not include the agents’ names. A spokesperson for the Department of Homeland Security, which oversees CBP, said the agents had been placed on leave after the Jan. 24 shooting. And after a week of protests and calls from lawmakers for a review, the Justice Department said Friday that its Civil Rights Division is investigating the shooting. A DOJ spokesperson did not answer questions, including whether DHS has shared materials, such as body-camera footage, with its investigators.

Ochoa is a Border Patrol agent who joined CBP in 2018. Gutierrez joined in 2014 and works for CBP’s Office of Field Operations. He is assigned to a special response team, which conducts high-risk operations like those of police SWAT units. Records show both men are from South Texas.

In the aftermath of the shooting, Gregory Bovino, who has orchestrated high-intensity immigration sweeps and arrests in a string of Democratic-led cities since early 2025, was removed from his role as Border Patrol commander at large and reassigned to his former post in El Centro, California.

A spokesperson for DHS declined to answer questions about the two agents and referred ProPublica to the FBI. The FBI declined to comment. ProPublica made several attempts to call Ochoa and Gutierrez but neither answered.

Ochoa, who goes by Jesse, graduated from the University of Texas-Pan American with a degree in criminal justice, according to his ex-wife, Angelica Ochoa. A longtime resident of the Rio Grande Valley, Ochoa had for years dreamed of working for the Border Patrol and finally landed a job there, she said. By the time the couple split in 2021, he had become a gun enthusiast with about 25 rifles, pistols and shotguns, Angelica Ochoa said.

DHS’ disclosure to Congress was drawn from an internal review of the agents’ body-camera footage, which has not been released to the public. State investigators, meanwhile, have accused their federal counterparts of blocking them from investigating the shooting.

Donald Trump fired Federal Trade Commission (FTC) Commissioner Rebecca Slaughter earlier this year. She sued.

In a landmark 1935 decision, Humphrey’s Executor, the Supreme Court held that Congress could put limits on the president’s authority to remove certain executive branch officials. That longstanding precedent has been on a collision course with Donald Trump’s quest for maximal power for as long as he’s been in office. Today, a Court that has been very sympathetic to Trump heard argument in Slaughter’s case.

The type of executive branch positions at stake are appointments to high-ranking positions in quasi-independent federal agencies like the FTC and others, including the Federal Reserve. The top line question is whether presidents can fire them in the absence of misconduct. We discussed the backstory to Humphrey’s Executor here, back in March. President Franklin Delano Roosevelt fired an FTC Commissioner, writing to him that “your mind and my mind [don’t] go along together on either the policies or the administering of the Federal Trade Commission.” The Court held that Congress intended to restrict a president’s power of removal to cases involving inefficiency, neglect of duty, or malfeasance in office, and that Roosevelt couldn’t dismiss Humphrey simply because they were of different minds on policy.

That precedent is about as on-point as they come. It suggests that Slaughter, who had done nothing wrong, should win her case. She was advised of her termination in an email that said her “continued service on the FTC is inconsistent with [the Trump] Administration’s priorities.”

But our tea leaf reading at the start of the term, which concluded that the Court would weigh in for Trump, appears to have been on target. We based that analysis on the fact that the Court declined to stay Slaughter’s dismissal from the FTC until it could hear the case. If there had been a majority, or something close to it, inclined to follow Humphrey’s Executor and rein Trump in, the Court would have prevented the firing from taking effect until it could hear the case. The fact that they allowed her dismissal to take effect implied the Court was prepared to undo the precedent that would have prohibited it. Oral argument bore out that conclusion.

Justice Kagan went straight to the heart of the matter when Solicitor General John Sauer argued the government’s case. She pointed out that “the central proposition of your brief” was that the Vesting Clause of the Constitution gives all of the executive power to the president. “Once you’re down this road, it’s a little difficult to see how you stop,” Justice Kagan said. Sauer talked over her and around her, but never disagreed. The government’s position, even though it didn’t go this far today, is that everything that happens in the executive branch is at the president’s pleasure. Everything. That could include matters like who DOJ indicts, what businesses the EPA regulates, and all sorts of individualized decisions that are currently made by people with expertise, guided by long-standing practices and ethical constraints.

“To that point, when Justice Kagan asked whether a decision against Slaughter would apply to other similarly situated agencies, Sauer ducked. He told her the Court could just “reserve” making a decision on other agencies because those cases were not in front of the Court today. Justice Kagan responded that “logic has consequences,” and that even if the Court dropped a footnote saying it wasn’t deciding other cases as Sauer suggested, it would just be a dodge; it wouldn’t mean anything for future cases, where the government would be free to argue for an unprecedented level of control in the hands of the president, using Slaughter as support, if the Court decides it in the manner the government requested.” Joyce Vance’s Quote…

Justice Sotomayor said to Sauer, “You’re asking us to destroy the structure of government and to take away from Congress its ability to protect its idea that the government is better structured with some agencies that are independent.” Justice Alito invited Sauer to respond. “The sky will not fall,” he said, adding, “The entire government will move toward accountability to the people.” Justice Sotomayor ultimately responded, “What you’re saying is the president can do more than the law permits.” There was silence for a moment. Then Sauer hurriedly repeated a few of his earlier points and concluded that Humphrey should be reversed.

We don’t know precisely how the Court will rule, but the Chief Justice tipped his hand a bit, saying “the precedent” had “nothing to do with what the FTC looks like today,” and claiming that the FTC back then was different, and “had very little, if any executive power,” suggesting different rules might apply today for an agency that had become more powerful. It’s the sophistic kind of reasoning we have seen before when the Roberts Court twists itself into pretzel logic so that it can reverse longstanding precedent—while pretending it is doing nothing of the sort.

A decision in this case is likely to come at the end of the term, late next June or the first week in July, although it could come at any time. It is likely to be one of the most consequential of this term.

A lot more happened today that is worthy of our attention. But because there is so much of it, instead of trying to cover it all, I’ll flag some of the most important developments here, and you can read further on any of them that interest you. We will take them up in more detail as they develop.

• ProPublica, widely regarded as a highly credible source of independent investigative journalism (they broke the story on Clarence Thomas and Samuel Alito accepting vacation travels and other favors from conservative power players) reported today that some of Trump’s mortgages match his description of mortgage fraud, according to records they reviewed. While living in New York, he claimed two 1993 real estate purchases made within two months of each other in Florida would both become his principal residence. The report says: “The Trump administration has argued that Fed board member Lisa Cook may have committed mortgage fraud by declaring more than one primary residence on her loans. We found Trump once did the very thing he called ‘deceitful and potentially criminal.’” Trump has accused multiple political adversaries of mortgage fraud for claiming more than one primary residence, and that appears to be the rationale behind federal criminal investigations into New York Attorney General Letitia James, California Senator Adam Schiff, and California Representative Eric Swalwell, and others, although there are at best flimsy facts to support the allegations.
• Twelve former FBI agents sued Attorney General Pam Bondi and FBI Director Kash Patel, along with others, alleging “unlawful retaliation” because they were fired for kneeling in response to protests in Washington, D.C., after George Floyd’s murder. The lawsuit is based on First Amendment violations and also points out the wisdom of the plaintiffs’ decision to kneel with the crowd: “As a result of their tactical decision to kneel, the mass of people moved on without escalating to violence.”

Donald Trump fired Federal Trade Commission (FTC) Commissioner Rebecca Slaughter earlier this year. She sued.

In a landmark 1935 decision, Humphrey’s Executor, the Supreme Court held that Congress could put limits on the president’s authority to remove certain executive branch officials. That longstanding precedent has been on a collision course with Donald Trump’s quest for maximal power for as long as he’s been in office. Today, a Court that has been very sympathetic to Trump heard argument in Slaughter’s case.

The type of executive branch positions at stake are appointments to high-ranking positions in quasi-independent federal agencies like the FTC and others, including the Federal Reserve. The top line question is whether presidents can fire them in the absence of misconduct. We discussed the backstory to Humphrey’s Executor here, back in March. President Franklin Delano Roosevelt fired an FTC Commissioner, writing to him that “your mind and my mind [don’t] go along together on either the policies or the administering of the Federal Trade Commission.” The Court held that Congress intended to restrict a president’s power of removal to cases involving inefficiency, neglect of duty, or malfeasance in office, and that Roosevelt couldn’t dismiss Humphrey simply because they were of different minds on policy.

That precedent is about as on-point as they come. It suggests that Slaughter, who had done nothing wrong, should win her case. She was advised of her termination in an email that said her “continued service on the FTC is inconsistent with [the Trump] Administration’s priorities.”

But our tea leaf reading at the start of the term, which concluded that the Court would weigh in for Trump, appears to have been on target. We based that analysis on the fact that the Court declined to stay Slaughter’s dismissal from the FTC until it could hear the case. If there had been a majority, or something close to it, inclined to follow Humphrey’s Executor and rein Trump in, the Court would have prevented the firing from taking effect until it could hear the case. The fact that they allowed her dismissal to take effect implied the Court was prepared to undo the precedent that would have prohibited it. Oral argument bore out that conclusion.

Justice Kagan went straight to the heart of the matter when Solicitor General John Sauer argued the government’s case. She pointed out that “the central proposition of your brief” was that the Vesting Clause of the Constitution gives all of the executive power to the president. “Once you’re down this road, it’s a little difficult to see how you stop,” Justice Kagan said. Sauer talked over her and around her, but never disagreed. The government’s position, even though it didn’t go this far today, is that everything that happens in the executive branch is at the president’s pleasure. Everything. That could include matters like who DOJ indicts, what businesses the EPA regulates, and all sorts of individualized decisions that are currently made by people with expertise, guided by long-standing practices and ethical constraints.

“To that point, when Justice Kagan asked whether a decision against Slaughter would apply to other similarly situated agencies, Sauer ducked. He told her the Court could just “reserve” making a decision on other agencies because those cases were not in front of the Court today. Justice Kagan responded that “logic has consequences,” and that even if the Court dropped a footnote saying it wasn’t deciding other cases as Sauer suggested, it would just be a dodge; it wouldn’t mean anything for future cases, where the government would be free to argue for an unprecedented level of control in the hands of the president, using Slaughter as support, if the Court decides it in the manner the government requested.” Joyce Vance’s Quote…

Justice Sotomayor said to Sauer, “You’re asking us to destroy the structure of government and to take away from Congress its ability to protect its idea that the government is better structured with some agencies that are independent.” Justice Alito invited Sauer to respond. “The sky will not fall,” he said, adding, “The entire government will move toward accountability to the people.” Justice Sotomayor ultimately responded, “What you’re saying is the president can do more than the law permits.” There was silence for a moment. Then Sauer hurriedly repeated a few of his earlier points and concluded that Humphrey should be reversed.

We don’t know precisely how the Court will rule, but the Chief Justice tipped his hand a bit, saying “the precedent” had “nothing to do with what the FTC looks like today,” and claiming that the FTC back then was different, and “had very little, if any executive power,” suggesting different rules might apply today for an agency that had become more powerful. It’s the sophistic kind of reasoning we have seen before when the Roberts Court twists itself into pretzel logic so that it can reverse longstanding precedent—while pretending it is doing nothing of the sort.

A decision in this case is likely to come at the end of the term, late next June or the first week in July, although it could come at any time. It is likely to be one of the most consequential of this term.

A lot more happened today that is worthy of our attention. But because there is so much of it, instead of trying to cover it all, I’ll flag some of the most important developments here, and you can read further on any of them that interest you. We will take them up in more detail as they develop.

• ProPublica, widely regarded as a highly credible source of independent investigative journalism (they broke the story on Clarence Thomas and Samuel Alito accepting vacation travels and other favors from conservative power players) reported today that some of Trump’s mortgages match his description of mortgage fraud, according to records they reviewed. While living in New York, he claimed two 1993 real estate purchases made within two months of each other in Florida would both become his principal residence. The report says: “The Trump administration has argued that Fed board member Lisa Cook may have committed mortgage fraud by declaring more than one primary residence on her loans. We found Trump once did the very thing he called ‘deceitful and potentially criminal.’” Trump has accused multiple political adversaries of mortgage fraud for claiming more than one primary residence, and that appears to be the rationale behind federal criminal investigations into New York Attorney General Letitia James, California Senator Adam Schiff, and California Representative Eric Swalwell, and others, although there are at best flimsy facts to support the allegations.
• Twelve former FBI agents sued Attorney General Pam Bondi and FBI Director Kash Patel, along with others, alleging “unlawful retaliation” because they were fired for kneeling in response to protests in Washington, D.C., after George Floyd’s murder. The lawsuit is based on First Amendment violations and also points out the wisdom of the plaintiffs’ decision to kneel with the crowd: “As a result of their tactical decision to kneel, the mass of people moved on without escalating to violence.”

THACKER PASS, #Nevada -- "While descendants of the survivors of the massacre of #Paiutes at Peehee Mu'huh struggled to protect the sacred remains from the digging of a #LithiumMine, owned by Lithium Americas on Canada -- law enforcement had a spider web of surveillance.

"The law enforcement surveillance of defenders of Peehee Mu'huh, Thacker Pass, began before #MyronDewey was killed, and continued afterwards.

"ProPublica and Nevada Independent expose the spy trail of law enforcement and private security of Lithium Americas. The surveillance web of 10 agencies included the #BIA, and a #CounterTerrorism task force.

"During a meeting in April of 2021, the sheriff met with a spinmaster who linked the resistance to #StandingRock. This was six months before Myron Dewey was killed when a truck driven by a mining
engineer hit Myron head on.

"Myron was well known for his #reporting and #drone coverage at Standing Rock 2016--2017. Myron was livestreaming the day before he was killed near his home in #YombaNevada, Sept. 26, 2021.
