  2. There were 12 people on the jury, consisting of 9 women and 3 men.

    The district attorney may have mistakenly let it slip several times that it was one of the 3 men. Whenever she said "him or her," there were a few times when she paused after saying "him," as if she had to remind herself that she needed to keep the person anonymous.

    Unfortunately, Lindsay Clancy's own lawyer also may have mistakenly let it slip that it was one of the three men when he said "he" and forgot to say "she" too.

  3. There is, of course, the whole "black box" argument. Once deliberations start, the alternate jurors are essentially dead weight, just waiting to go home. But the whole reason they are often kept on standby even during deliberations is for when the need arises.

    What better need than a single juror who may have admitted they're ignoring the orders of the court, and possibly the law itself?

    Unfortunately, tradition sometimes outweighs simple logic and, in this case, purpose.

  4. The judge argued that he did not want to take a side, but that is exactly what he did.

    Think about it: 12 people are on a jury, and 11 of them have made up their minds one way or the other. One of them is not following the rules — the judge knows which rule that is — and rather than use the alternate juror that was available, he calls for a mistrial.

    The judge appears to be denying her this by rejecting the option for an alternate juror, who has already been selected from the juror pool.

    Imagine you're required to attend court every day, listen to all the facts as an alternate, and then — just when you're finally needed because someone on the jury isn't following the rules — the judge dismisses you, meaning all your time was wasted.

    Meanwhile, Lindsay Clancy must go through all of this all over again with a new jury.

Not only are providers siloed within their own employers with little incentive to communicate, there’s no universal electronic health records where they can see the totality of a patient’s care and medications. Experts following the Clancy case said if there had been someone in the driver’s seat responsible for overseeing all of her care, things may have turned out differently.
