Looking at #HammvSmith, the wild #SupremeCourt case in which #Alabama is desperate to give the #DeathPenalty to someone who their own #courts found #IntellectuallyDisabled, despite it violating the #8thAmendment of the #constitution according to many past rulings. Alabama argues that his #IQtest scores range between 72 and 78, above the limit of 70. Defense counters that experts agree that #IQ is a flawed measure, that he has issues that aren't going to show on IQ tests, and that 72 is so low that the margin of error would reach below 70.
Meanwhile, the courts found multiple times that he was not competent for #execution, and let's be really honest here, everyone, even the #prosecutors, think he is #MentallyDisabled. This feels to me like #DoubleJeopardy and nitpicking: the courts already said he didn't meet the standard of #competence, and the #prosecutor is basically asking the supreme #court to have lower courts ignore facts whenever a state wants to kill people.

An impeachment and removal does not activate the #doublejeopardy clause of the #FifthAmendment. The ex-officer may face #criminal indictments and trials for the same conduct that led to their impeachment and removal from office.
So no, #trump ’s lawyers are not going to “get one over” on the judicial system because of his dementia fueled “fix this” tantrum!

2nd, they argue that charging him w/trying to block the #election results violates the legal principle of #DoubleJeopardy, because Trump was already acquitted at his congressional impeachment for his conduct leading up to the riot-marred Jan. 6, 2021, formal tabulation of electoral college votes. (Article I, §3, Clause 7 of the Constitution specifies that a President impeached by the House & convicted by the Senate is nevertheless subject to indictment, trial, judgement, & punishment "by law".)

#Trump's latest position—that the #Senate's failure to #convict his #impeachments trigger #doubleJeopardy in his #criminal cases—is going nowhere. Double-jeopardy only applies to #criminal #proceedings. #Impeachment is not a criminal proceeding, or even a #legal proceeding. Impeachment is a #political process. Trump is just making shit up, as usual. But it's troubling to see his #lawyers sign on to such rubbish. Unlike Trump, they know better.
