Gorsuch concurrence is something else--this is inside federal Indian law baseball, but he describes Kagama with its extraconstitutional plenary power as a wrong turn from which federal Indian law is recovering & argues plenary power does not permit abrogation of tribal sovereignty. That goes beyond even what J Thurgood Marshall wrote. #Brackeen #ICWA #Law

Disaster averted for now with the Supreme Court's decision on #Brackeen . That concurrence is worth reading: "Often, Native American Tribes have come to this Court seeking justice only to leave with bowed heads and empty hands. But that is not because this Court has no justice to offer them. Our Constitution reserves for the Tribes a place—an enduring place—in the structure of American life. Another day without a #SCOTUS decision in #Brackeen. Today's decision keeping alive the #VotingRightsAct gives me hope that #ICWA may survive this Court. Plus, Justice Gorsuch did not write an opinion this round, so maybe he gets Brackeen??

States preparing for the possible fallout of the US Supreme Court overturning (or eviscerating?) the Indian Child Welfare Act (ICWA):
"Minnesota also codified the federal ICWA language into state law this year, while New Mexico enacted a state-specific version with expanded protections last session. Eleven states now have either done so or passed a state-specific version of the federal law with greater protections. "

Great news--Wyoming is the latest state to codify #ICWA into law, undermining potential #Brackeen holdings on #StatesRights (but not #EqualProtection ones). Republican Governor Mark Gordon declared "This bill celebrates the partnership between the tribes and the state of Wyoming, and our willingness to work together on these important issues that affect all of us." #Indigenous
