WASHINGTON (AP) — Former special counsel Jack Smith testified Thursday about his investigation of President Donald Trump’s efforts to overturn the 2020 election, detailing how the defeated president “sought to prey” on his supporters and “looked for ways to stay in power,” culminating in the Jan. 6, 2021, Capitol attack.
It was Smith’s first public hearing since he left the department last year, and the nearly five-hour session at the House Judiciary Committee delved into far-flung details — from former White House aide Cassidy Hutchinson’s blockbuster testimony before the Jan. 6 committee to the gag order slapped on Trump during the investigation over his efforts to intimidate witnesses.
“Our investigation revealed that Donald Trump is the person who caused Jan. 6, it was foreseeable to him, and that he sought to exploit the violence,” Smith testified.
Trump, during the hearing, was live-posting his rage against Smith — suggesting the former career prosecutor should himself be prosecuted. In the room sat militant Oath Keepers founder Stewart Rhodes, and a tense encounter erupted between one audience member and police who had defended the Capitol, reminding how Jan. 6 still divides the Congress, and the country.

“I’m not going to pretend that didn’t happen because he’s threatening me,” Smith said.
Once Trump won reelection in 2024, Smith abandoned the cases against him, adhering to Justice Department protocol against prosecuting a sitting president. Trump faced a four-count indictment in the conspiracy to overthrow the election and, separately, Smith’s team indicted Trump over holding classified documents at his Mar-a-Lago home.
Throughout the session, Republicans highlighted new developments as they seek to sow doubt on Smith’s now defunct-case against Trump, while Democrats warned that Trump’s allies are trying to rewrite history after the defeated president sent his supporters to the Capitol to fight for his failed election against Democrat Joe Biden.
Far from done, Smith is expected to be called before the Senate, which is planning its own hearing, and he has been unable to discuss the documents case that lawmakers want to probe. Trump-appointed U.S. District Judge Aileen Cannon halted the release of a report by Smith’s team on that case with an injunction that is set to expire next month, but lawyers for Trump have asked to leave it permanently under seal.
One star witness under scrutiny, but Smith says there are ‘so many’ more
Republicans have fixated for years on countering the gripping testimony that former White House aide Cassidy Hutchinson gave to the Jan. 6 committee, trying to prove her wrong.
The young aide recounted having been told that day about Trump lunging for the steering wheel in the presidential limousine as he demanded to join supporters at the Capitol. It’s a story that others said did not happen.

Smith explained that Hutchinson’s testimony was “second hand,” and as his team interviewed other witnesses, and the Secret Service agent in the car at the time “did not confirm what happened.”
Jordan pressed whether Smith would have brought Hutchinson forward to testify anyway, and Smith said he had not made “any final determinations.”
Smith said, “We had a large choice of witnesses.”
“That says it all,” Jordan declared. “You were still considering putting her on the witness stand because you had to get President Trump.”
In fact, Smith said, one of the “central challenges” of the case was to present it in a concise way, “because we did have so many witnesses” — state officials, Trump campaign workers and advisers — to testify.
“Some of the most powerful witnesses were witnesses who, in fact, were fellow Republicans who had voted for Donald Trump, who had campaigned for him and who wanted him to win the election,” Smith said.

Federal District Judge Amit Mehta ruled in Jan 2025 that Rhodes & other members of the #OathKeepers needed to seek #court permission to travel to #DC or be on Capitol Grounds.
According to the ADL, the Oath Keepers is an anti-government #extremist org within the #militia movement.

This scumbag walked into a massive anti-ICE/anti-Trump protest in Tampa with a holstered sidearm and a large pro-Trump flag. Marshalls glommed onto him and he thought better of staying in the crowd. He was escorted to the corner without incident and ended up crossing the street to escape the marshalls.

Regarding Stewart Rhodes re-launching the #OathKeepers (Dare I call them Oath Breakers?):
Don't be surprised if we have to fight them again up in DC. They and their Proud Boys and 3%'er friends invaded DC three fucking times culminating at J6, and all three times they assaulted and terrorized random DC residents. One of them was even seen with a "Six Million Wasn't Enough" T-shirt celebrating the Holocaust. This is who supported Trump then, and it's who supports Trump now.
I was in all three of those huge and vicious late 2020/early 2021 battles. The first was Nov 14 2020, opposing the "Million MAGA March." I was wounded that night, I was back in action in time for Dec 12 2020, opposing the March4 Trump. Finally, on J6 itself I was at the defense of Black Lives Matter Plaza itself.
These three battles were quite similar: about 20,000 mainstream Trump supporters backed by about 1,000 of the heavies. A division of low quality troops, a reinforced batallion of more capable troops. We faced this with less than 300 fighters on Nov 14 and it turned into a literal knife fight when we blocked their march on BLM PLaza and they pulled knives. Body armor and shields both saved lives that night. Also note that a cop was stabbed that night by members of the same groups that were also showing the Thin Blue Line flag! Unknown how well their vest performed but they didn't get killed.
Dec 12 was similar, we had about 800 people most of them able to handle themselves in a tough situation, again enemy forces of about 1K heavies and 20K semi-civvies. Unknown if we could have held the line ourselves, as our presence "tripwired" MPD into blocking all access to BLM Plaza except by those who were there first, which was us. Probably the Mayor realized open bloodshed on her watch (remember the knives of Nov 14) would be terrible press for the city. It didn't help that liberals and Dems told people to stay home. This meant the other side's fighters could draw reinforcements from a crowd of 20,000 while we were on our own. Many in DC considered this a defeat as it was MPD that kept the Enemy off the Plaza.
Then came J6: defending the Capitol was not our watch, we laid back to watch the tigers fight on that one. This paid dividends when Qanon types tried to claim J6 was "antifa in disguise" Note that the Proud Boys had stated they would be wearing copies of our "uniform" (black bloc) and not their own! This is perfidy and a war crime in open combat BTW.
On J6 we stayed well away from the Capitol as cops and unbadged fash beat the shit out of each other, with the cops being defeated outright and only the National Guard able to retake the Capitol. Instead, we drew two missions: defend the unhoused camps north of Union Station then in the underpasses, and defend BLM Plaza.
I was in the latter defense which was about a dozen kids from NE plus myself. Dumbass Proud Boys came over from the Capitol late in the day, wandering over mostly in packs of 3-5 and never outnumbering us thinking they'd destroy the artwork with ease. We could have been slaughtered if they had just stopped and gathered 20-30 people bloc'ing up. They never thought of that, so we cleaned their clocks. Those packs of 3-5 fash had to fight all of us at once, someone called it a "self-serve beat down station." One of the fash was knocked out cold.
After about 1/2 hour of this fighting, I got friendly fire pepper spray in one eye. With no medic support I had to withdraw on the other eye to ensure I made it home at all. Remember a whole division's worth of enemies was still in town, and we had no medic support at BLM Plaza!
Sometimes the only easy day is NOT yesterday folks!
