Another delay in the Boundary Waters litigation will open the door to even more political finagling
No one should be surprised by the Joint Status Report just filed in the Boundary Waters litigation before the DC District Court of Appeals. Twin Metals, joined by the federal government, has asked for yet another 180-day abeyance. The mining company clearly sees that it has little chance of succeeding at law, so it has joined forces with the federal government, the putative defendant in this case, to keep the Twin Metals project on a strictly political path.
This is the same strategy they’ve pursued for a while. By petitioning for delay at the DC Circuit, the mining company and its lobbyists can make headway on the political front. They have already made some. Last July, the Department of the Interior revoked the Biden-era legal opinion that canceled (or re-canceled) the zombie leases revived by a legal opinion issued by the Solicitor of the Interior during Trump’s first term. There is still time over the next few weeks for the Chilean mining company and its lobbyists to push the republican-controlled Senate to pass House Joint Resolution 140, which would overturn the 20-year Rainy River watershed mineral withdrawal. And just last week, the Trump administration announced the dismantling of the US Forest Service, closing more than 57 research facilities and virtually shutting down the agency’s ability to conduct scientific research — the kind of careful, incremental, localized research that the 20-year mineral withdrawal would allow and for which it was designed.
Another 180-day abeyance would bring us to October 3rd or thereabouts (depending on when exactly the court issues the order). That’s about a month before the November elections, after which the the political finagling behind closed doors should face some much-needed congressional scrutiny.
We are still waiting to hear from Intervenor Defendant Appellees — the group of non-profits and small businesses that I call the Civil Society Group. Though the federal government has done an about-face, the Civil Society Group has not, so I would expect them to oppose this request. I am not confident the court will see it their way, though. For now, here’s today’s Joint Status Report.

The plan is to keep justice at bay, sideline science, and let the mining company’s lobbyists (led by Trump’s former Secretary of the Interior) dictate to the corrupted agencies. And remember, there is still a chance — a slim chance at this point, but a chance all the same — that the Senate votes to overturn the 20-year mineral withdrawal.
If all this reads like so much inside baseball, that’s because it is: this is a complex and coordinated political project, with many moving parts.

Anti-War or Anti-Trump?
You can be anti-Trump but still pro-war. Among Trump’s political opponents are those who criticize his execution of the Iran war, but don’t oppose waging war against Iran per se, or those who disapprove of the way he went about things in Venezuela, “but,” or those who decry his belligerence over Greenland, not because it is a belligerent resource-grab but on the grounds that it alienates NATO allies. Now, however, you cannot be anti-war without being anti-Trump. It is no longer possible, for example, for people to identify as MAGA and anti-war. A coherent anti-war position necessarily entails opposition to this war-mongering president.
Of the two, anti-war and anti Trump, anti-war may make for more durable resistance: if Trump were to vacate office or die tomorrow we would still have his Iran war, all his wars, from the Caribbean to Minneapolis to the Strait of Hormuz, and opposition to these wars would still be the appropriate moral and political position to take.
This is not to say that the anti-war position can take the place of opposition to Trump, or that it is enough for the moment. If all of Trump’s wars were magically to end tomorrow, there would still be plenty of reasons for responsible, decent, and reasonable people to be anti-Trump: authoritarianism, corruption and self-dealing, criminal depravity, illegitimacy, ecocidal policy, insufferable vanity, brute ignorance and gutter racism, adherence to might-makes-right, non-stop lying, chaos-monkeyism, incompetence, reckless demagoguery, and so on. And yet all of those failings, I would suggest, were always going to lead us to where we find ourselves today, to war.

Where lawful corporate governance ends and the personalist regime begins
I embarrassed myself when, back in January, I asked whether wind energy investors had standing to sue the Trump administration over a presidential memorandum pausing all federal approvals for wind power development. I was suffering at the time from the delusion — common to most writers, I suppose — that readers would respond or at least consider the point. Instead, crickets. I guess it was what the experts would call a dumb question, which wouldn’t be the first one I’ve asked and won’t be the last, or it just wasn’t the sort of thing that grabs people’s attention nowadays. (I would never claim to have my finger on the popular pulse.) In any case, it was a failed bid.
I was, however, on to something. I just didn’t know what, but now I think I have a slightly better idea. It’s not only that Trump’s Quixotic madness about windmills has been on full display ever since; “adverse market development in the US,” as an Ørsted executive euphemistically puts it, has interrupted big projects like Empire Wind and sent wind energy stocks plummeting. It’s also that Trump continues to assert his (unlawful) prerogative to control and extort companies, whole industries, and markets.
Acting arbitrarily, corruptly (witness the Paramount or Tim Cook bribes), and with undisguised prejudice, Trump is trying to replace the invisible hand that we were supposed to believe was at work in the free market with his own bruised, rotting Chaos Monkey paw.
He has reserved for his regime a “golden share” as a condition for approving deals (auguring “a ‘meaningful shift’ in America’s approach to capital markets,” as a writer in the FT delicately puts it), spooked investors by calling unflattering economic data rigged, imposed import and export taxes with unfair exemptions for cronies and flatterers, arrogated to himself powers reserved for boards (witness the call, last week, for the CEO of Intel to step down), and repeatedly offended shareholder rights and prerogatives.
L’actionnaire c’est moi, or something like that, and though boards have gotten very good at ignoring ordinary investors, they are hardly known for standing up to this kind of political pressure. As for CEOs, they have shown that they are all too ready to capitulate and collude.
This non-stop chaos, oafish meddling, and strong-arm interference may at times look clownish, but it will have serious consequences. Sure, it creates “uncertainty” (the rhetorical fig leaf the business press uses when the Chaos Monkey exposes himself), and of course it will lead to misallocation of capital. But that’s hardly the main trouble.
It marks the spot where lawful corporate governance (such as we knew it) ends and the personalist regime begins.
Greg Ip, with whom I usually disagree, appears to make a fair point when he calls this “State Capitalism with American Characteristics,” but I would prefer State Capitalism with Coherent Industrial Policy to to what we actually have, and Ip’s label doesn’t quite capture the personalist element: L’etat c’est moi donc l’actionnaire c’est moi, or something like that.
Let’s just say that it looks like we are heading for — or perhaps we are already in the throes of — a full-blown governance crisis. It may already be too late to push back, but it sure would be nice to see boards and big institutional investors try.
