The supreme court ruled that Donald Trump’s firing of #Federal #Reserve governor
Lisa Cook was unconstitutional,
in a landmark ruling that limits a president’s authority over the central bank.
In its opinion, the court said that Trump does not have the constitutional authority to fire a Fed governor without cause.
The ruling is a major win for the central bank, which has spent the last year under attack from the White House.
But, in a separate case, the justices ruled that Trump can #fire leaders of #independent #agencies or commissions,
ending 90 years of court precedent that curbs executive power.
That case centered on Rebecca Slaughter, whom Trump fired as Federal Trade Commission member in March last year over email,
telling her that keeping her as a commissioner would be “inconsistent with [the] administration’s priorities”.
The court handed Trump another loss, refusing to hear his bid to overturn a $5m verdict in favor of E Jean #Carroll
in a case in which a jury found him liable for #sexually #abusing the former magazine columnist and then #defaming her.
The 2023 jury verdict and a $5m civil judgment remain in place.The high court declined to take up the case in a brief, unexplained order.
There were no noted dissents.
The supreme court sided against national Republicans and the Trump administration to allow #mail-in #ballots that arrive after election day to be counted, upholding the law in more than a dozen states.
The Republican National Committee had challenged a Mississippi state law allowing mailed ballots to be counted if they arrive within five business days of election day, so long as they were postmarked by election day.
The court’s liberal justices pointed to federal laws that allow for grace periods, while noting that a ruling here could also implicate early voting, another common practice.
The court also refused to revive a $300m #defamation lawsuit filed against #CNN over its coverage of a prominent attorney’s remarks made while defending Trump during his 2020 impeachment.
Alan Dershowitz said CNN aired only a portion of the comment made during his defense of the president,
distorting his meaning to make him look like he’d “lost his mind”.
The network said that multiple outlets had interpreted his remarks in a similar way, and Dershowitz couldn’t show CNN was trying to mischaracterize what he said.
The court’s majority declined to take up the case in a brief, unexplained order.
And finally, the supreme court threw out a judicial decision involving a Virginia man’s challenge to a #geofence #warrant used by police to access cellphone location data near a crime scene leading to his conviction for armed robbery.
The justices threw out a lower court’s ruling against defendant Okello Chatrie, who had argued he was subjected to an illegal search
and that evidence in his case should be excluded.
The court agreed that a search had occurred, but sent the case back to a lower court to conduct further analysis. -

Florida is one of more than a dozen states that have cracked down on protests in recent years,

Would cancel the visa of any individual convicted of protest-related crimes and provide for the individual’s deportation within 60 days. Under the bill, individuals convicted of any “crime (i) related to [their] conduct at and during the course of a protest; (ii) involving the defacement, vandalism, or destruction of Federal property; or (iii) involving the intentional obstruction of any highway, road, bridge, or tunnel” would be deportable. The bill requires that such individuals’ visas be “immediately” cancelled and the individuals removed from the US within 60 days. If enacted, a non-citizen convicted of even a nonviolent misdemeanor “related to” a protest, such as trespass or disorderly conduct, could face deportation. Would amend the federal #AntiRioting law to raise the maximum penalty to ten years in prison, instead of five, for participating in or inciting a “riot,” or aiding or abetting someone to do so. The federal definition of “riot” is broad, requiring only a “public disturbance” where one individual in a group commits violence. Under the bill, someone who committed or abetted an “act of violence” during the commission of a “riot” offense would face a minimum one-year sentence, while an individual who assaulted a law enforcement officer would face a sentence of at least one year and up to life in prison. Federal law defines “act of violence” broadly to include using force against #property—or just attempting or threatening to use such force. As such, if enacted, the bill could result in steep criminal penalties for protesters who do not actually engage in violence or destructive conduct. The bill’s sponsor cited protests around immigration raids in Los Angeles as the impetus for his bill.

Would create a new federal #felony offense that could apply to protests of planned or operational pipelines. The bill would broadly criminalize under federal law “knowingly and willfully” “#vandalizing, tampering with, disrupting the operation or construction of, or preventing the operation or construction of” a gas pipeline. A range of peaceful activities could be deemed “disrupting… the construction of” a pipeline, from a rally that obstructs a road used by construction equipment, to a #lawsuit challenging a pipeline’s #permit or# zoning approval. The bill does not define “disrupt,” such that even a brief delay would seemingly be covered. Further, the underlying law provides that any "attempt" or "conspiracy" to commit the offense would be punished the same as actual commission. As such, individuals as well as organizations that engage in the planning or facilitation of a protest that is deemed to “disrupt” pipeline construction could be covered. The offense would be punishable by up to 20 years in prison and a fine of up to $250,000 for an individual, or $500,000 for an organization.

"A new bill to increase regulations on lithium mining in South Dakota failed to make it out of the state House on Thursday.
"House Bill 1258, proposed by Rep. Nichole Uhre-Balk, D-Rapid City, would have placed lithium mining under the same regulations as gold and silver rather than its current sand and gravel standards.
"Hard rock mining (gold and silver) is subject to stricter #WaterPollution control regulations than sand and gravel mining.
"Organizations like #MidwestLithium are currently exploring mining operations in the hills.
