  1. CW: AI, LLM, Anthropic Copyright Infringement

Apparently #Anthropic has been ordered to pay ca. $1.5 billion for #copyright #infringement on about 500K #books they used to train #Claude along with the order to destroy any #unauthorized copies & #pirated files they possess:

Considering the amount of money they stand to make from Claude's continued existence, this seems like little more than a slap on the wrist to me. Also, I find it hard to believe how it will be possible to enforce the order to destroy the illicit files.

  2. 2 hills I will die on with genAI slop.

    1. Content stolen to train the #AI generator you are using should open you up to #copyrightinfringement lawsuits.
    2. Content you generate with AI should not be eligible for #copyright protection since it’s not human created.

  3. News Summary: Hachette, Cengage, and Elsevier Sue Google over Gemini AI Copyright Infringement

There is a new AI lawsuit in town. It raises some very interesting questions. It's also seeking to establish a class action, and the class would almost certainly contain a lot of indie titles, which is why I am heading back to the AI lawsuit well once more.

  5. Artist fighting Temu to reclaim her mosaic design
    By Jenae Madden

A South Australian artist is fighting drop-ship company Temu over its selling of her mosaic design on rugs. But how did the artwork get there in the first place?

    This, this, THIS.

Except apparently this is not an actual quote (because I can’t find it). I stand behind the view though and have no time for people who defend the predatory actions of these companies and individuals, especially if you started with “well there’s no evidence of actual theft…” or “well I don’t think property should exist, and intellectual property especially…”. You know who you are. Shoo. Be gone, waster-of-my-time.

  7. News Summary: First BookTok Bestseller List Dominated by Romance; Publishers Sue Meta over AI Training

A few interesting pieces of news with which to end the week. The one I found most interesting is the long-anticipated release of the first (UK for now, following a trial in Germany) BookTok Bestseller list. In a shocking turn of events that no one could have foreseen, seventeen of the top twenty titles are romance and romantasy, with the likes of Rebecca Yarros, Chloe Walsh, and Sarah J. Maas dominating. It is also no surprise to see the ur-text of dark academia, Donna Tartt's The Secret History, standing proud in the chart.

  8. Yes, this is theft.

The good news (for artists) is that the liability can’t be washed away by running it through a software tool (a separate issue), and the artist can sue the person who published this.

Don’t be the person that publishes another’s work without authorization, not only because it’s a violation of the rights of the artist, and a breach of law, but because it’s wrong.
